No.212 of 2011 with Sardarnagar Police Station, Ahmedabad<br \/>\n\tfor the offences punishable under Sections 406, 420, 467, 468, 471,<br \/>\n\t120(B) and 114 of the Indian Penal Code and under Section 12(A) of<br \/>\n\tthe Passport Act.\n<\/p>\n<p>Learned<br \/>\n\tCounsel appearing for the applicant submits that the applicant is an<br \/>\n\tinnocent person and he has been wrongly arraigned in the case of the<br \/>\n\tprosecution. There are no allegations that present applicant has<br \/>\n\tcreated any forged documents or any kind of other travelling<br \/>\n\tdocuments. The applicant is resident of village Gandur of District<br \/>\n\tTiruchirappalli of Tamilnadu and she has never visited Gujarat<br \/>\n\tState. The applicant is widow  and he has to look after her two<br \/>\n\tminor kids and the entire responsibility of the family is her.<br \/>\n\tHence, by imposing suitable conditions, the applicant may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mr.  Nanavati for the respondent-State. He also<br \/>\n\tsubmitted that the applicant is involved in serious offence and<br \/>\n\ttherefore, considering the seriousness of the offence, quantum of<br \/>\n\tpunishment, the applicant may not be released on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail. I have also perused the order of this Court<br \/>\n\tpassed in Criminal Misc. Application No.12231 of 2011 dated<br \/>\n\t30.8.2011.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case,  the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.212\/2011 with<br \/>\n\tSardarnagar Police Station, Ahmedabad, on executing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that she shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender her passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat till the charge-sheet is filed<br \/>\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of her residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
