(Oral) :\n\n<\/pre>\n<p>            This is revision petition by Bahadur Singh, who was convicted<br \/>\nand sentenced by learned Judicial Magistrate Ist Class, Muktsar vide<br \/>\njudgment and order dated 31.05.1999, as affirmed in appeal by learned<br \/>\nAdditional Sessions Judge, Muktsar vide judgment dated 09.04.2002. The<br \/>\npetitioner stands convicted under Sections 279, 337, 338, 427 and 304-A of<br \/>\nthe Indian Penal Code (in short &#8211; the IPC) and sentenced to undergo<br \/>\nrigorous imprisonment for four months under Section 279 IPC, for five<br \/>\nmonths under Section 337 IPC, for seven months under Section 338 IPC<br \/>\nand also for seven months under Section 427 IPC.         He has also been<br \/>\nsentenced to undergo rigorous imprisonment for one year and to pay fine of<br \/>\n<span class=\"hidden_text\">                              Crl. Revn. No. 766 of 2002                   2<\/span><\/p>\n<p>Rs.500\/- and in default thereof, to undergo further rigorous imprisonment<br \/>\nfor two months under Section 304-A IPC. All the substantive sentences<br \/>\nhave been ordered to run concurrently.\n<\/p>\n<p>             According to the prosecution version, on 15.06.1996, Major<br \/>\nSingh (since deceased) was going on his scooter, whereas his brother Mehar<br \/>\nSingh (complainant) and son Simranjit Singh were following him on other<br \/>\nscooter.   At about 05:30 P.M., they reached near bus stand of Village<br \/>\nBhullar.    Offending tractor No. PIB 1120 being driven rashly and<br \/>\nnegligently by the petitioner came from the opposite direction and hit the<br \/>\nscooter of Major Singh, who resultantly fell down and suffered injuries.<br \/>\nThe tractor stopped at some distance. Mehar Singh and Simranjit Singh<br \/>\ninquired the name of the tractor driver, who disclosed his name as Bahadur<br \/>\nSingh (petitioner). They started attending to Major Singh and sent him in a<br \/>\njeep to hospital and themselves chased the petitioner, who, in the meantime,<br \/>\nhad fled away. However, they could not trace the petitioner. Major Singh<br \/>\nwas admitted in the hospital by the jeep driver and Mehar Singh and<br \/>\nSimranjit Singh also reached there, but Major Singh succumbed to his<br \/>\ninjuries. The accident occurred due to rash and negligent driving of the<br \/>\ntractor by the petitioner. Mehar Singh lodged FIR by making statement to<br \/>\nthe police. Necessary investigation followed and petitioner was sent for<br \/>\ntrial after investigation.\n<\/p>\n<p>             Mehar Singh (PW-1) and Simranjit Singh (PW-2) have broadly<br \/>\nstated according to the prosecution version.       Other evidence including<br \/>\nevidence of mechanical examination of the scooter and the tractor, medical<br \/>\nevidence and investigation of case has also been led. Photographer was also<br \/>\nexamined. The tractor and the scooter were also seized from the spot by the<br \/>\npolice.\n<\/p>\n<p>             The petitioner in his examination under Section 313 of the<br \/>\nCode of Criminal Procedure (in short &#8211; the Cr.P.C.) denied all the<br \/>\n<span class=\"hidden_text\">                            Crl. Revn. No. 766 of 2002                      3<\/span><\/p>\n<p>incriminating circumstances appearing against him        in the prosecution<br \/>\nevidence and claimed to be innocent. He stated that he was sitting near the<br \/>\nbus stand for repair of tractor as its tyre had got burst. The petitioner did<br \/>\nnot lead any evidence in his defence.\n<\/p>\n<p>             I have heard learned counsel for the parties and perused the<br \/>\ncase file.\n<\/p>\n<p>             Both the eye-witnesses have supported the prosecution version.<br \/>\nFIR was lodged very promptly. The accident occurred at 05:30 P.M. and<br \/>\nFIR was registered at 08:00 P.M. Manner of accident was described in the<br \/>\nFIR. Registration number of the offending tractor as well as name and<br \/>\naddress of the petitioner as its driver were mentioned in the FIR. The<br \/>\nstatements of both the eye-witnesses are thus fully corroborated by the FIR,<br \/>\nwhich was lodged very promptly. There is concurrent finding of guilt of the<br \/>\npetitioner by both the courts below on appreciation of evidence. The said<br \/>\nfinding is neither perverse nor illegal so as to warrant interference in<br \/>\nexercise of revisional jurisdiction.\n<\/p>\n<p>             Learned counsel for the petitioner vehemently contended that<br \/>\nMehar Singh complainant in cross-examination could not identify the<br \/>\npetitioner being the driver of the offending tractor at the time of the<br \/>\naccident. However, merely on this ground, the conviction of the petitioner<br \/>\ncannot be set aside because Simranjit Singh correctly identified the<br \/>\npetitioner in the court being driver of the offending tractor at the time of<br \/>\naccident.    Moreover, name and address of the petitioner as such was<br \/>\nmentioned in the FIR lodged promptly. There is no reason why Mehar<br \/>\nSingh and Simranjit Singh would falsely implicate the petitioner.        The<br \/>\npetitioner has also not led any evidence in his defence. The petitioner has<br \/>\nadmitted his presence at the spot along with tractor. False implication is<br \/>\nreasonably ruled out.\n<\/p>\n<p>             Learned counsel for the petitioner also contended that brother<br \/>\n<span class=\"hidden_text\">                           Crl. Revn. No. 766 of 2002                        4<\/span><\/p>\n<p>and son of the deceased did not accompany him to hospital. However, it has<br \/>\nbeen explained in the FIR itself that they chased the petitioner, who had, in<br \/>\nthe meanwhile, fled away and they reached the hospital soon thereafter.<br \/>\nThe FIR was lodged by Mehar Singh in the hospital itself without any delay.<br \/>\nConsequently, it cannot be said that Mehar Singh and Simranjit Singh had<br \/>\nnot witnessed the occurrence.\n<\/p>\n<p>            In view of the foregoing discussion, I find no infirmity in the<br \/>\nconcurrent finding of both the courts below regarding guilt of the petitioner.<br \/>\nAccordingly, finding of conviction of the petitioner is affirmed.\n<\/p>\n<p>            As regards sentence also, the petitioner does not deserve any<br \/>\nrelief because the petitioner, by driving the tractor rashly and negligently,<br \/>\nprematurely put to an end the life of Major Singh aged about 42 years only.<br \/>\nSentence of imprisonment for one year for offence under Section 304-A IPC<br \/>\ncannot be said to be excessive, notwithstanding that the occurrence took<br \/>\nplace about 13 years ago. The petitioner has remained in custody for only<br \/>\nthree months and eleven days, as per Custody Certificate placed on record<br \/>\ntoday by learned State counsel. The said period of custody is not adequate<br \/>\npunishment for offence under Section 304-A IPC. The quantum of sentence<br \/>\nimposed on the petitioner does not warrant reduction.\n<\/p>\n<p>            The appeal is without any merit and is accordingly dismissed.<br \/>\nThe appellant, who is on bail, shall surrender to his bail bonds or shall be<br \/>\ntaken in custody to undergo the remaining period of his sentence.\n<\/p>\n<pre>April 23, 2009                                     ( L.
