HEMA, J.\n         =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n                      B.A. No. 7961 of 2008\n         =-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=\n           Dated this the 13thday of February, 2009\n\n                               O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 143, 147, 148,<\/p>\n<p>153A, 332 read with section 149 IPC.                   According to<\/p>\n<p>prosecution, about 50 persons formed themselves into an<\/p>\n<p>unlawful assembly and with intention to promote communal<\/p>\n<p>hatred started shouting provocative slogans and when police<\/p>\n<p>intervened to disperse the assembly, stones were pelted at them<\/p>\n<p>and glass of the jeep was damaged.\n<\/p>\n<p>       3. Petitioner is the 4th accused in the crime. According to<\/p>\n<p>petitioner, no injury is caused to any body. Petitioner is willing<\/p>\n<p>to abide by any conditions. He will not tamper with evidence or<\/p>\n<p>influence any witness and hence, anticipatory bail may be<\/p>\n<p>granted. It is also his case that he is falsely implicated.<\/p>\n<p>       4. Learned Public Prosecutor submitted that on the facts<\/p>\n<p>of this case this is not a fit case to grant anticipatory bail. Nature<\/p>\n<p>of the allegations made against petitioner and others is very<\/p>\n<p>serious.\n<\/p>\n<p>       5. On considering the rival contentions, I am satisfied that<\/p>\n<p>the allegations against petitioners are serious in nature and this<\/p>\n<p>is not a fit case to grant anticipatory bail. The incident happened<\/p>\n<p>BA 7961\/09                        -2-\n<\/p>\n<p>as early as on 1-11-2008 and petitioner could not be arrested so<\/p>\n<p>far. Petitioner is bound to surrender before the Investigating<\/p>\n<p>Officer or before the Court and co-operate with the investigation.<\/p>\n<p>Hence, the following order is passed:-\n<\/p>\n<blockquote><p>      1)    Petitioner is directed to surrender before the<\/p>\n<p>            Investigating Officer without any delay and co-<\/p>\n<p>            operate with the investigation. Whether he<\/p>\n<p>            surrenders or not, police is at liberty to arrest<\/p>\n<p>            him and proceed in accordance with law.<\/p>\n<\/blockquote>\n<blockquote><p>      2)    No further application for anticipatory bail by<\/p>\n<p>            petitioner in this crime will be entertained by<\/p>\n<p>            this Court, since on the facts in this case, this<\/p>\n<p>            Court ordered that this is not a fit case to grant<\/p>\n<p>            anticipatory bail and any order to the contrary in<\/p>\n<p>            any subsequent anticipatory bail application will<\/p>\n<p>            amount to review, which is impermissible in law.<\/p>\n<p>      The petition is dismissed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                           K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>mn.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Ashraf.K.V. vs State Of Kerala Represented By The on 13 February, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7961 of 2008() 1.
