Public Prosecutor, Mr.L.R.Pujari for the respondent No.1.<br \/>\n\tSales Tax Officer of Sales Tax Department, Mr.R.S.Trivedi on behalf<br \/>\n\tof the respondent No.2 is also present in Court.\n<\/p>\n<p>Mr.R.S.Trivedi,<br \/>\n\tSales Tax Officer of the Sales Tax Department, has stated at the bar<br \/>\n\tthrough learned APP, that entire tax is paid by the petitioners<br \/>\n\tafter filing of complaint with the Sales Tax Department. A letter to<br \/>\n\tthis effect was sent to the learned Public Prosecutor of the trial<br \/>\n\tcourt seeking to withdraw the complaint. He has also stated that now<br \/>\n\tthere is no due qua the present petitioners and necessary<br \/>\n\tinstructions have been given by the concerned Officer to the learned<br \/>\n\tPublic Prosecutor of the trial who was in charge of the case for<br \/>\n\twithdrawal of the same. However, it has not been withdrawn by the<br \/>\n\tlearned Public Prosecutor.\n<\/p>\n<p>In<br \/>\n\tview of the facts that the entire tax amount has been paid by the<br \/>\n\tpetitioners and no amount is left due towards tax to the Sales Tax<br \/>\n\tDepartment coupled with the fact that Sales Tax Department has<br \/>\n\tinstructed the learned Public Prosecutor of the trial court  to<br \/>\n\twithdraw the complaint, there is no purpose in proceeding with the<br \/>\n\tcomplaint and the<br \/>\n\timpugned complaint is required to be quashed and set aside.\n<\/p>\n<p>Hence,<br \/>\n\tthe present petition is allowed.
