Name and designation of the official who was to take action<br \/>\n         along with the report and notings made of his response on it.\n<\/p><\/blockquote>\n<blockquote><p>      2. Photocopies of no objection\/ permission granted to anyone<br \/>\n         for erecting them on public road if any. Full details be<br \/>\n         provided if any such is under consideration as per your<br \/>\n         record.\n<\/p><\/blockquote>\n<blockquote><p>      3. Policy guidelines copies, adopted on the subject matter from<br \/>\n         time to time for granting permission\/ refusing permission.\n<\/p><\/blockquote>\n<blockquote><p>      4. Any notice\/ action taken out in the matter against persons<br \/>\n         indulging in illegal actions and or errant officials of MCD for<br \/>\n         not taking action in the matter.&#8221;<\/p><\/blockquote>\n<p>      To this he received the following reply through a letter of 4.4.2007 from<br \/>\nJE (W) received by him on 19.4.2007 after payment of Rs. 18\/- as fees<br \/>\ndemanded through a letter of PIO, DC (South Zone) of 12.4.2007<br \/>\n        S.     Information Sought           Information given<br \/>\n        No.\n<\/p>\n<p>        1.     Name and designation   The applicant is requested to<br \/>\n                                      provide copies of letters dated<br \/>\n               of the official who was to<br \/>\n               take action along with 9.3.2006,     28.8.2006       and<br \/>\n               his report and noting  7.1.2004.      As department<br \/>\n               made of his superiors  does not keep record of letters<br \/>\n               on it.                 by its dates. The question is<br \/>\n                                      not     cleared      intelligible,<br \/>\n                                      therefore, can not be reply.\n<\/p>\n<p>        2.     Photocopy     of    no No such NOC\/ permission for<br \/>\n               objection\/  permission erection of iron gates\/ barriers<br \/>\n               granted to any one for have been granted by the<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n                erecting these on public     department.<\/p>\n<pre>\n               road, if any. Policy guidelines copies     The policy framing of rules for\n               adopted on the subject       fixing of gate pertains to\n               matter from time to time     Planning           Department,\n               for granting permission\/     However,      a      copy      of\n               refusing permission.         Corporation Resolution No.\n                                            466 dated 6.11.2006 is\n                                            enclosed as taken from the\n                                            Planning Department. This\n                                            Resolution was referred back\n                                            to    commissioner,        MCD,\n                                            therefore, SE (Planning) MCD\n                                            be requested to provide\n                                            further information, if any.\n        4.     Any notice\/ action taken     No notice\/ action has been\n               out in the matter against    taken in this regard.        The\n               persons indulged in          question is not appropriate\n               illegal activities and\/ or   worded.          Hence,       not\n               errant officers of MCD       applicable.\n               for not taking action in\n               the matter.\n\n      Not    satisfied   appellant   moved    his   first   appeal   before     Addl.\n<\/pre>\n<p>Commissioner (Engineering) on 20.4.2007 upon which Addl. Commissioner<br \/>\n(Engineering) in his order of 25.5.2007 directed as follows:-\n<\/p>\n<blockquote><p>      &#8220;On examining the appeal, it has been observed question<br \/>\n      specific reply has not been provided. The information sought by<br \/>\n      the appellant is a matter of record and the information should<br \/>\n      have been provided in time.\n<\/p><\/blockquote>\n<blockquote><p>      PIO is, therefore, directed to examine the application of the<br \/>\n      appellant and provide question specific reply within 10 days.&#8221;<\/p><\/blockquote>\n<p>      However, the prayer of appellant Shri Lajinder Singh in his second<br \/>\nappeal before us is as follows:-\n<\/p>\n<p>   1. &#8220;The PIO shall be directed to provide complete, correct and<br \/>\n      specific information\/ documents.\n<\/p>\n<p>   2. The PIO\/AA shall be proceeded against under section 20 of the<br \/>\n      RTI Act, both for penalty and administrative action.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>    3. The appellant shall be compensated to the tune of RS. 500\/-<br \/>\n      incurred in filing two appeals and taking rounds of their offices.\n<\/p>\n<p>   4. The appellant shall be refunded Rs. 18\/- paid as the information<br \/>\n      was not supplied on time and further these were irrelevant<br \/>\n      papers.&#8221;\n<\/p>\n<p>          He has specifically criticized the decision of First Appellate Authority<br \/>\neven though this order that the information sought be provided to him, in his<br \/>\nsecond appeal before us as follows:-\n<\/p>\n<blockquote><p>          &#8220;That it has become a routine practice for the AA to direct PIO to<br \/>\n          supply the information without application of mind for the<br \/>\n          grounds of appeal and the AA has not passed any order of this<br \/>\n          vital aspect at all. The fact remains that AA has not heard this<br \/>\n          appeal and the same was heard by some LDC posted at<br \/>\n          Bhagirath Palace office making a mockery of RTI Act.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 22-8-2008. The following are present.\n<\/p>\n<p>          Appellant<br \/>\n          Shri Lajinder Singh.\n<\/p>\n<p>          Respondents<br \/>\n          Shri M. K. Singhla, EE, M.S. II.\n<\/p>\n<p>          Shri K. P. Singh, AE (MS) II.\n<\/p>\n<p>          Shri Mamraj, Zonal Superintendent.\n<\/p>\n<p>          Shri Rajesh Kumar, UDC.\n<\/p>\n<p>          Appellant submitted that the information supplied to him was<br \/>\nincomplete.      He also submitted that his objection to the order of First<br \/>\nAppellate Authority even though it contains a direction that information be<br \/>\nsupplied to him was that it was passed without hearing him and has not been<br \/>\ncomplied with.\n<\/p>\n<p>          He specifically cited the following information which has not been<br \/>\nreceived and of which no specific mention has been made in the order of First<br \/>\nAppellate Authority<br \/>\n   i.        The official assigned the responsibility of acting on his<br \/>\n             Report.\n<\/p>\n<p>   ii.       Full details of any move for erecting a gate at the specific site<br \/>\n             of Municipal Road between property No. 182 and D-102 B,<br \/>\n             Village Khirki.\n<\/p>\n<p>   iii.      Policy Guidelines.\n<\/p>\n<p><span class=\"hidden_text\">                                           3<\/span><\/p>\n<p>       Shri M. K. Singhla, EE, (MS) II, submitted a copy of the Policy<br \/>\nGuidelines for installation of gates dated 25.6.2007 of which a copy was given<br \/>\nto the appellant. In turn, appellant Shri Lajinder Singh provided a copy of<br \/>\nthree letters stated not to have been received by the MCD in their letter of<br \/>\n4.4.2007 to EE. A Press cutting referred in these letters was not, however,<br \/>\nattached. Appellant Shri Lajinder Singh undertook to provide a copy the same<br \/>\nday to Shri Rajesh Kumar, UDC.\n<\/p>\n<p>      Shri Lajinder Singh submitted that the information supplied to him was<br \/>\ndelayed and, therefore, penalty should apply.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>            The   applicant   Shri   Lajinder   Singh     has   approached   this<br \/>\nCommission submitting, inter-alia, that in spite of the orders passed by the<br \/>\nfirst Appellate Authority, the PIO has not complied with the orders and the<br \/>\ninformation requested has not been furnished till date.\n<\/p>\n<p>             From the facts above, it appears that this is a case of malafide<br \/>\ndenial of Information by the PIO. However since it is the responsibility of the<br \/>\nFirst Appellate Authority to ensure that the orders passed by it are duly<br \/>\ncomplied with by the PIO, and some inadequacies in exchanging documents<br \/>\nnow stand addressed, the Commission has decided to remand the case<br \/>\nback to the first Appellate Authority Addl Commissioner (Engineering)<br \/>\nto ensure that his orders under section 19(1) are duly complied with and<br \/>\nthe requested information furnished in terms of the order so passed. In doing<br \/>\nso, he will ensure the supply of specific information cited in the previous<br \/>\nparagraphs by appellant Shri Lajinder Singh.\n<\/p>\n<p>       If the compliance is not ensured within 15 days from the date of receipt<br \/>\nof this order, the FAA should approach this Commission for initiation of<br \/>\nproceedings under section 20 of the RTI Act for imposition of penalty and\/or<br \/>\nrecommending appropriate disciplinary action. This will be without prejudice to<br \/>\nthe right of the First AA to initiate other penal action under the Indian Penal<\/p>\n<p><span class=\"hidden_text\">                                       4<\/span><br \/>\n Code against the PIO for wilful violation of lawful orders promulgated by a<br \/>\npublic servant while exercising statutory powers.\n<\/p>\n<p>       Announced in the hearing.
