With the consent of the parties,<br \/>\nthe matter is taken up for final hearing today.\n<\/p>\n<p>2.\tThe<br \/>\npresent Appeal from Order has been preferred by the appellant being<br \/>\naggrieved by the order dated 15.10.2009 passed by the Additional<br \/>\nSenior Civil Judge, Jamnagar below Ex. 5 in Special Civil Suit No. 67<br \/>\nof 2008 whereby the interim injunction application of the appellant<br \/>\nwas rejected.\n<\/p>\n<p>3.\tIt<br \/>\nis the case of the appellant that he preferred Civil Suit being<br \/>\nSpecial Civil Suit No. 67 of 2008 in the Court of Principal Senior<br \/>\nCivil Judge, Jamnagar for declaration and partition of his share in<br \/>\nthe ancestral property. The appellant preferred an interim injunction<br \/>\napplication Ex. 5 and the same was rejected by the trial court vide<br \/>\norder dated 15.10.2009.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Mapara, learned advocate appearing for the appellant has submitted<br \/>\nthat the trial court has failed to appreciate the fact that the<br \/>\naffidavit was challenged before the competent authority and the<br \/>\nrevenue entry thereof was cancelled. He has submitted that despite<br \/>\nholding that the appellant is a co-sharer in the suit property the<br \/>\ntrial court rejected the injunction application.\n<\/p>\n<p>5.\tAs<br \/>\na result of hearing and perusal of records, this court is of the<br \/>\nopinion that the interim injunction application was rejected by the<br \/>\ntrial court on the ground that though the appellant is a co-sharer in<br \/>\nthe suit property, he had relinquished his rights in the said<br \/>\nproperty by virtue of a Notarized Affidavit (mark 21\/2) which is not<br \/>\nchallenged by the appellant.  Hence the appellant having relinquished<br \/>\nhis right in the suit property by executing a notarized affidavit is<br \/>\nnot entitled to injunction.  However, it appears from the records<br \/>\nthat the affidavit is under challenge before the competent authority<br \/>\nand the revenue entry is cancelled.  This position is not disputed by<br \/>\nlearned advocate for the defendant.  In such an event, the said<br \/>\nground shall not be sustainable for rejecting the injunction<br \/>\napplication.  Thus, the appeal deserves to be allowed.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the order dated 15.10.2009 is hereby quashed<br \/>\nand set aside.  Since the revenue entry was cancelled by the<br \/>\nauthority which is subject matter of appeal, both the sides shall<br \/>\nmaintain status quo as on today pending the suit.  It is made clear<br \/>\nthat if an application for expediting the suit is filed by the<br \/>\nappellant, the trial court shall consider the same in accordance with<br \/>\nlaw.
