Justice K.T.SANKARAN\n\n Dated :12\/10\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                      B.A. NO. 5843 OF 2009\n             ------------------------------------------------------\n             Dated this the 12th day of October, 2009\n\n                                O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure.      The petitioner is the first accused in Crime<\/p>\n<p>No.20 of 2009 of Thalassery Excise Range.<\/p>\n<p>       2.  The offences alleged against the accused persons are<\/p>\n<p>under Section 55(a) of the Abkari Act and Rules 9 and 26 of the<\/p>\n<p>Foreign Liquor Rules.\n<\/p>\n<\/p>\n<p>       3. The prosecution case is that on 22.9.2009, a quantity of 34<\/p>\n<p>litres of Indian Made Foreign Liquor was seized from the<\/p>\n<p>autorickshaw driven by the second accused.                  According to the<\/p>\n<p>prosecution, the petitioner was also travelling in the autorickshaw.<\/p>\n<p>The petitioner states that he runs a bar hotel in Mahe on partnership<\/p>\n<p>business, of which he is a partner.             The allegation is that the<\/p>\n<p>petitioner is involved in the transportation of Indian Made Foreign<\/p>\n<p>Liquor. The petitioner was arrested on 22.9.2009 itself and he was<\/p>\n<p>remanded to judicial custody.\n<\/p>\n<p>B.A. NO. 5843 OF 2009<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<\/p>\n<p>      4. It is submitted by the learned counsel for the petitioner that<\/p>\n<p>the petitioner is not involved in any other case of a similar nature.<\/p>\n<p>      5.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner.<\/p>\n<p>      6. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First          Class,<\/p>\n<p>Thalassery, subject to the following conditions:<\/p>\n<blockquote><p>       a)    The petitioner shall report before the investigating officer<br \/>\n             between 9 A.M.        and 11 A.M. on all Mondays, till the<br \/>\n             final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)    The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)    The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)    The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<p>B.A. NO. 5843 OF 2009<\/p>\n<p>                                   :: 3 ::\n<\/p>\n<\/p>\n<p>      e)    In case of breach of any of the conditions mentioned<br \/>\n            above, the bail shall be liable to be cancelled.<\/p>\n<p>      The Bail Application is allowed as above.<\/p>\n<p>                                                   (K.T.SANKARAN)<br \/>\n                                                          Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Govindan C. vs State Of Kerala on 12 October, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5843 of 2009() 1.
