Please tell-\n<\/p>\n<p>     a) Whether the present status of the aforesaid Writ Same as given in point 1 \u00a9.<br \/>\n         Petition was brought to the notice \/knowledge of<br \/>\n         the XLRI consultant before preparation and<br \/>\n         submission of the report \/ documents to the bank<br \/>\n         detailing the career path of various categories of<br \/>\n         Specialist Officers of Allahabad Bank or not.\n<\/p>\n<p>     b) Whether the matter of the said Writ Petition was Same as given in point 1 \u00a9.<br \/>\n         taken into consideration by the committee of<br \/>\n         General Managers at Head Office level during<br \/>\n         their discussion and examination of the report \/<br \/>\n         documents submitted to the bank by XLRI<br \/>\n         ,before placing the proposal regarding Career<br \/>\n         Path of specialist officers of Allahabad bank<br \/>\n         including Tea Officer for Board&#8217;s approval or<br \/>\n         not.\n<\/p>\n<p>Grounds for First Appeal:\n<\/p>\n<p>Non supply of certain documents by the PIO.\n<\/p>\n<p>Order of the First Appellate Authority:\n<\/p>\n<p>I have perused the RTI application, the disposal\/decision of the CPIO &amp; the appeal. The appellant was<br \/>\nnot provided information on points 1 (c), 1 (d), 2(a) and 2(b)0 on the grounds that disclosure of<br \/>\ninformation would be an infringement of MOU between Bank &amp; XLRI.<br \/>\nIt is observed that under point 1 &#8216;(c) &amp; 1(d) copies of reports are sought, whereas under2(a) &amp;<br \/>\n2(b) only some confirmation is sought. ,<br \/>\nIn many past decisions of the CIC, it was held that any material on the basis of which a decision is to<br \/>\nbe taken, should be made public after the decision has been taken.(\u00ecn this case, if the decision has<br \/>\nalready been taken, the material can be made public, if it is otherwise not exempt from disclosure<br \/>\nunder Section 8 &amp; 9 of the Act. The CPIO should re-examine the matter.\n<\/p>\n<p>Grounds for Second Appeal:\n<\/p>\n<p>The Appellant states that the direction of the FAA was not been complied with by the CPIO.\n<\/p>\n<p>Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant : Mr. Sumit K.Bose, on video conference from NIC-Kochi Studio;<br \/>\nRespondent : Mr. Chitranjan Sahai, PIO &amp; AGM(Law) on video conference from NIC-Kolkata<br \/>\n               Studio;\n<\/p>\n<p>        The PIO appears to have sent most of the information to the Appellant. The appellant would<br \/>\nhowever like to inspect the relevant records on 06\/09\/2011 from 10.30AM onwards.<br \/>\nThe PIO is directed to facilitate an inspection of the relevant records by the Appellant on<br \/>\n06 September 2011 from 10.30AM onwards at the office of the PIO. In case there are any records or<br \/>\nfile which the appellant believes should exist, which are not shown to him, he will give this in writing<\/p>\n<p>                                                                                         Page\u00a02\u00a0of\u00a03<br \/>\n to the PIO at the time of inspection and the PIO will either give the files\/records or give it in writing<br \/>\nthat such files\/records do not exist.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The PIO is directed to facilitate an inspection of the relevant records by the Appellant<br \/>\non 06 September 2011 from 10.30AM onwards.
