Pahwa, learned advocate appearing for the applicant, has<br \/>\nsubmitted that while disposing of LPA No.1535 of 2006 this Court has<br \/>\nnot only dismissed the said appeal on the ground of maintainability<br \/>\nbut also made observations on merits to the effect that since the<br \/>\nlearned Industrial Tribunal and the learned Single Judge have taken<br \/>\nconcurrent view and this is the fourth stage of proceedings, we do<br \/>\nnot want to entertain the appeal. She has, therefore, submitted that<br \/>\nthis would amount to dismissal of the appeal on merits as when this<br \/>\nCourt is not entertaining the appeal on the ground that the learned<br \/>\nSingle Judge has decided the petition under Article 227 of the<br \/>\nConstitution of India, these observations are not required and it<br \/>\nwould come in her way.\n<\/p>\n<p>3.\t\tSince<br \/>\nthere was delay in preferring the Misc. Civil Application for<br \/>\nreview\/recall of the order, the  Civil Application for condonation of<br \/>\ndelay  is moved.\n<\/p>\n<p>4.\tWe<br \/>\nhave considered the application and also perused the order passed by<br \/>\nus in the LPA. We are, however, of the view that the Court has<br \/>\ndismissed the LPA firstly on the ground that the petition is filed<br \/>\nunder Article 227 of the Constitution of India and the learned Single<br \/>\nJudge has also passed the order in a petition treating the same as<br \/>\nfiled under Article 227 of the Constitution of India and hence LPA is<br \/>\nnot maintainable. This Court has further observed in the order that<br \/>\nthere was concurrent finding given by the learned Industrial Tribunal<br \/>\nas well as the learned Single Judge. This additional ground was given<br \/>\nby the Court in support of the order of dismissal of LPA. In any<br \/>\ncase, this would not amount to any observation on merits of the case.<br \/>\nHowever, the fact was stated in the order. Hence, there is no mistake<br \/>\nin the order passed by us for review\/recall of the order dated<br \/>\n20.6.2007 passed by this Court in LPA No.1535 of 2006.\n<\/p>\n<p>5.\tSince<br \/>\nwe are not entertaining the MCA, there is no question of condonation<br \/>\nof delay. Accordingly, Civil Application No.2890 of 2008 for<br \/>\ncondonation of delay is rejected and the registration of Misc.
