MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nwrit petition has been preferred by the petitioner against the order<br \/>\ndated 25.10.2010 whereby the notice for removal of<br \/>\nencroachment\/demolition has been issued for the reasons as mentioned<br \/>\ntherein.\n<\/p>\n<p>2.\tThe<br \/>\nlearned counsel for the petitioner would contend that as the building<br \/>\nviz. Vrajednra Complex situated on Sub Plot No. 1 over an area<br \/>\nadmeasuring 463 sq. mtrs. of Final Plot No. 201 in Town Planing<br \/>\nScheme No. 29 (Wadaj) was constructed long ago, the petitioner has a<br \/>\nright to apply for regularization of unauthorized portion of the<br \/>\nbuilding under the provisions of the Gujarat Regularization of<br \/>\nUnauthorized Development Act, 2001 read with the Rules framed<br \/>\nthereunder.  He would further submit that the petitioner having made<br \/>\nprovision for parking, the authority ought not have issued notice on<br \/>\nsuch ground.\n<\/p>\n<p>3.\tFrom<br \/>\nthe record, it is not clear the year in which the building was<br \/>\nconstructed and whether any notice was earlier issued  by the<br \/>\nauthorities to find out whether the petitioner is covered by the<br \/>\nGujarat  Regularization of Unauthorized Development Act, 2001 read<br \/>\nwith the Rules framed thereunder.  Such details having not given, the<br \/>\nlearned counsel for the petitioner sought permission to withdraw the<br \/>\npetition to enable the petitioner to move before the competent<br \/>\nauthority alongwith the relevant documents for regularization of the<br \/>\nbuilding in question and to bring to their notice that parking space<br \/>\nhas been made available.\n<\/p>\n<p>4.\tIn<br \/>\nview of such request made by the learned counsel for the petitioner,<br \/>\nwe allow the petitioner to move before the appropriate authority, who<br \/>\nmay notice the relevant facts and evidence as being produced by the<br \/>\npetitioner and may pass appropriate orders in accordance with law.<br \/>\nWe only observe that this Court has not decided the case on merit nor<br \/>\nhas passed any interim order against the notice in question.\n<\/p>\n<p>\tThe<br \/>\nwrit petition stands disposed of.\n<\/p>\n<p>\t\t\t\t\t\t[S.J.\n<\/p>\n<p>MUKHOPADHAYA, CJ.]<\/p>\n<p>\t\t\t\t\t\t\t[K.\n<\/p>\n<p>M.
