Justice THOMAS P.JOSEPH\n\n Dated :18\/10\/2010\n\n O R D E R\n                 THOMAS P JOSEPH, J.\n\n                ----------------------------------------\n\n                Tr.P(C).Nos.5 and 6 of 2010\n\n                ---------------------------------------\n\n             Dated this 18th day of October, 2010\n\n                              ORDER\n<\/pre>\n<p>     These petitions are for transfer of O.P.Nos.1500 and 1501<\/p>\n<p>of 2009 from Family Court, Nedumangad to Family Court,<\/p>\n<p>Kannur. The said petitions are filed by the respondent\/husband<\/p>\n<p>for custody of the minor child and for restitution of conjugal<\/p>\n<p>rights.  Petitioner\/wife, it is not disputed is a resident of<\/p>\n<p>Taliparamba, in Kannur District while respondent is a permanent<\/p>\n<p>resident of Trikkaripur in Kannur District but now staying at<\/p>\n<p>Thiruvanathapuram in connection with his employment as a<\/p>\n<p>Software Engineer (learned counsel for respondent was however<\/p>\n<p>not able to say about the permanent residence of respondent).<\/p>\n<p>Learned counsel for petitioner states that she has to travel all the<\/p>\n<p>distance from kannur to Nedumangad to contest the cases.<\/p>\n<p>Learned counsel for respondent states that if the cases are<\/p>\n<p>transferred to Kannur it may not be possible for respondent to<\/p>\n<p>appear in that court and it may also affect his employment as a<\/p>\n<p>Software Engineer at Thiruvananthapuram as he has to often<\/p>\n<p>take leave. As I stated, fact of residence of petitioner at<\/p>\n<p>Taliparamba is not disputed. Petitioner is aged about 27 years.<\/p>\n<p>Tr.P(C).Nos.5 and 6 of 2010<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>The distance from Kannur to Thiruvanathapuram is more than<\/p>\n<p>500 kms even going by train and from Thiruvananthapuram<\/p>\n<p>petitioner has to travel by bus to reach Nedumangad. It may<\/p>\n<p>even take 2 days for her to go to Nedumangad and same time to<\/p>\n<p>return to her place of residence. Petitioner\/wife is aged 27 years,<\/p>\n<p>has necessarily to be accompanied by some relatives which<\/p>\n<p>involves expense also. The Supreme Court in Sumitha Singh<\/p>\n<p>Vs. Sanjay Kumar &amp; Another (AIR 2002 SC 396) and Arti<\/p>\n<p>Rani Lrs. Pinki Devi and Another Vs. Darmendra Kumar<\/p>\n<p>Gupta (2008(9) SCC 353) stated that while considering request<\/p>\n<p>for transfer in matrimonial proceedings convenience of the wife<\/p>\n<p>has to be looked into.         Having regard to the facts and<\/p>\n<p>circumstances of the case I am inclined to think that comparative<\/p>\n<p>hardship of petitioner\/wife if the cases continued at Nedumangad<\/p>\n<p>is much more than the hardship that respondent may be put to, if<\/p>\n<p>the cases are transferred to Family Court, Kannur. I must also<\/p>\n<p>bear in mind that petitioner has filed M.C.No.483 of 2008 in the<\/p>\n<p>Family Court, Kannur claiming maintenance from respondent and<\/p>\n<p>that petition is pending in that court. In connection with that<\/p>\n<p>case respondent has to go to that court. So far, no request for<\/p>\n<p>transfer of that case is made by respondent.               In the<\/p>\n<p>Tr.P(C).Nos.5 and 6 of 2010<br \/>\n<span class=\"hidden_text\">                                    : 3 :<\/span><\/p>\n<p>circumstances stated above I am inclined to allow the transfer<\/p>\n<p>requested by petitioner\/wife.\n<\/p>\n<p>      Resultantly this petition is allowed in the following lines:<\/p>\n<pre>               (i)     O.P.Nos.1500 of 2009 and 1501 of 2009\n\n        pending      in   Family   Court,  Nedumangad      are\n\n<\/pre>\n<p>        withdrawn from that court and made over to Family<\/p>\n<p>        Court, Kannur.\n<\/p>\n<p>               (ii)    The transferor court shall transmit<\/p>\n<p>        records of the cases to the transferee court with due<\/p>\n<p>        intimation to counsel on both sides as to the date of<\/p>\n<p>        appearance in transferee court.\n<\/p>\n<p>                (iii)   Transferor court shall ensure that all<\/p>\n<p>         the cases between the parties are posted as far as<\/p>\n<p>         possible on the same dates.\n<\/p>\n<p>               (iv)    It is made clear that except when<\/p>\n<p>        physical presence of respondent is required, he can<\/p>\n<p>        appear through counsel in the transferee court.<\/p>\n<p>                                 (THOMAS P JOSEPH, JUDGE)<\/p>\n<p>Sbna\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Meera Krishnan vs Pavan.C.Adiyodi on 18 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Tr.P(C).No. 5 of 2010() 1.
