                   and the State.\n<\/p>\n
                               2. At the time of filing of the writ petition<\/p>\n
                   petitioner was serving as Circle Inspector cum<\/p>\n
                   Kanungo. He has filed this writ petition praying inter<\/p>\n
                   alia to direct the State respondents to consider his<\/p>\n
                   case for grant of promotion on the post of Assistant<\/p>\n
                   Settlement Officer as some Circle Inspector cum<\/p>\n
                   Kanungo junior to him have been so promoted under<\/p>\n
                   notification of the Government bearing Memo<\/p>\n
                   No.1135 dated 9.10.2000, Annexure-1 to the writ<\/p>\n
                   petition.\n<\/p>\n
                               3. It is submitted on behalf of the petitioner
\n                           2<\/span><\/p>\n
that at the time when his juniors were promoted as<\/p>\n
Assistant Settlement Officer under notification dated<\/p>\n
9.10.2010, his case for grant of promotion was not<\/p>\n
considered as confidential reports were not received<\/p>\n
from his controlling officer, which was received just<\/p>\n
before filing of the writ petition in the year 2006.<\/p>\n
             4.        This   writ petition was       filed on<\/p>\n
12.04.2007 after serving two copies thereof on the<\/p>\n
office of the Advocate General and has remained<\/p>\n
pending for more than four years. Till date, however,<\/p>\n
no counter affidavit              has   been filed.    In the<\/p>\n
circumstances, I have no option but to direct the State<\/p>\n
respondents to consider the case of the petitioner for<\/p>\n
grant of promotion on the post of Assistant<\/p>\n
Settlement Officer in accordance with law in the light<\/p>\n
of the fact that his junior colleagues have already<\/p>\n
been so promoted under notification dated 9.10.2010<\/p>\n
Annexure-1 within two months from the date of<\/p>\n
receipt of a copy of this order. It is made clear that if<\/p>\n
petitioner        is    allowed    promotion   as     Assistant<\/p>\n
Settlement Officer, the same should be granted with<\/p>\n
effect from the due date i.e. the date from which his<\/p>\n

\n                             3<\/span><\/p>\n
          juniors have been so promoted. It goes without saying<\/p>\n
          that once petitioner is allowed the promotion on the<\/p>\n
          post of Assistant Settlement Officer, he should also<\/p>\n
          be paid arrears of difference of salary of the Circle<\/p>\n
          Inspector and Assistant Settlement Officer as early as<\/p>\n
          possible, in any case within two months from the date<\/p>\n
          of promotion.\n<\/p>\n
                    5. The writ application is, accordingly,<\/p>\n
