For that, present petition is filed by petitioner.\n<\/p>\n<p>If<br \/>\n\tpetitioner wants a change in school leaving certificate on the basis<br \/>\n\tof birth register, then, as per decision of  Division Bench of this<br \/>\n\tCourt in case of Regional Passport Officer versus Kokilaben, 2009(2)<br \/>\n\tGLR 1246, para 9 to 12, petitioner should approach either the<br \/>\n\tMagistrate or the Civil Court for getting corrected the birth date<br \/>\n\tin school leaving certificate on the basis of the birth register.<br \/>\n\tRelevant Para 9,10,11 and 12 of said decision are quoted as under:\n<\/p>\n<p> 9.\tWe<br \/>\n\tmay indicate that Registration of Births and Deaths Act, 1969 was<br \/>\n\tenacted to provide for births and deaths and matters connected<br \/>\n\ttherewith, which came into force with effect from 1.4.1970.  Chapter<br \/>\n\t3 of the Act provides for registration of births and deaths and<br \/>\n\tSection 13 is pertaining to delayed registration of births and<br \/>\n\tdeaths.  Sub-section (3) of Section 13 empowers a Magistrate of the<br \/>\n\tFirst Class to pass an order in case if birth or death is not<br \/>\n\tregistered within one year by its occurrence.  Initial registration<br \/>\n\tof births and deaths within a period of one year remain with the<br \/>\n\tauthority as provided under sub-section (1) and sub-section (2) of<br \/>\n\tSection 13 of the Act.  Section 15 of the Act deals with correction<br \/>\n\tor cancellation of entries in the register of Births and Deaths.<br \/>\n\tSection 15 of the Act, read with Rule 11 of the Gujarat Registration<br \/>\n\tof Births and Deaths Rules, 2004 provides for detailed procedure to<br \/>\n\tbe followed.  It says where it is proved to the satisfaction of the<br \/>\n\tregistrar that any entry of a birth or death in any register kept by<br \/>\n\thim under this Act is erroneous in form or substance, or has been<br \/>\n\tfraudulently or improperly made, he may, subject to such rules as<br \/>\n\tmay be made by the State Government with respect to the conditions<br \/>\n\ton which and the circumstances in which such entries may be or<br \/>\n\tcancel the entry by suitable entry<br \/>\n\tin original entry, and shall sign the marginal entry and add thereto<br \/>\n\tthe date of the correction or cancellation.  Thus, it is clear that<br \/>\n\tif it is proved to the satisfaction of the Registrar that entry<br \/>\n\tbeing erroneous in the register of births and deaths, and it has<br \/>\n\tbeen fraudulently or improperly made, he can make a report giving<br \/>\n\tnecessary details to the officer authorized by the Chief Registrar<br \/>\n\tby general or special order in this behalf under Section 25 of the<br \/>\n\tAct and on hearing from him, take necessary action in the matter.<br \/>\n\tLearned Single Judge of this Court in Nitaben Nareshbhai Patel Vs.<br \/>\n\tState of Gujarat   2008 (1) G.L.R 884 elaborately considered the<br \/>\n\tscope of above mentioned provisions, and the learned Single Judge<br \/>\n\talso examined at length the provisions of Gujarat Secondary<br \/>\n\tEducation Act, 1972 and Gujarat Secondary Education Regulation,<br \/>\n\t1974.  With regard to the change of date of birth entered in the<br \/>\n\tschool record, referring to Regulation 12(A), it was stated that if<br \/>\n\tthe student has actually left the school, no change can be effected<br \/>\n\tin the record of the school.  For making a change in the name, as<br \/>\n\tprovided under Regulation 12(5)(1), an application in prescribed<br \/>\n\tproforma with certain documents as narrated in Regulation 5(1)(A) to<br \/>\n\t(D) are required to be submitted.   Regulation 12(6) deals with<br \/>\n\tcorrection of date of birth, which is permissible only when student<br \/>\n\tis studying in the school, and thereafter it can be corrected by the<br \/>\n\tconcerned Magistrate of First Class, upon<br \/>\n\tproof of correct birth date.\n<\/p>\n<p>\t10.\tReference may also be<br \/>\n\tmade to the order passed by the Division Bench of this Court in<br \/>\n\tLetters Patent Appeal No. 699 of 2003 in Special Civil Application<br \/>\n\tNo. 8122 of 2003, decided on 11.8.2003 (unreported). In Minor<br \/>\n\tJagdishbhai Prabhatbhai Gohil Vs. State of Gujarat and others,<br \/>\n\treferring to Gujarat Secondary Education Regulation, this Court took<br \/>\n\tthe view that the only remedy available to the party with regard to<br \/>\n\tcorrection of date of birth\/place of birth is to approach the<br \/>\n\tauthority for redressal of his grievance as provided under Section<br \/>\n\t13 of the Act.\n<\/p>\n<p>\t11.\tThe above discussion<br \/>\n\twould amply show that for carrying out correction of date of birth<br \/>\n\tor place of birth or name, powers have been conferred under the Act<br \/>\n\ton the Registrar as well as the Judicial Magistrate, as the case may<br \/>\n\tbe, and also Magistrate First Class when the correction is sought to<br \/>\n\tbe made in school record, which is governed by Gujarat Secondary<br \/>\n\tEducation Act, 1972 and Regulation framed thereunder.\n<\/p>\n<p>12.\tWe<br \/>\n\tare therefore, clearly of the view that Passport Authorities are not<br \/>\n\texpected to make their own independent enquiry when there is a<br \/>\n\tdispute or difference with regard to the date of birth, place of<br \/>\n\tbirth or name entered in the Passport, especially when entries were<br \/>\n\tonce made on the basis of records produced by  the Passport holder.<br \/>\n\tIf there is any mistake on the records already produced, based on<br \/>\n\twhich entries<br \/>\n\twere already made, then it is for the party who seeks correction to<br \/>\n\tproduce documents after carrying out necessary correction by the<br \/>\n\tconcerned statutory authorities, Judicial Magistrate or the Civil<br \/>\n\tCourt, as the case may be.  Passport Authorities are always<br \/>\n\tcompetent to direct the parties to produce relevant documents either<br \/>\n\tfrom the authorities functioning under the Births and Deaths<br \/>\n\tRegister or from the Judicial Magistrate or from the Civil Court, as<br \/>\n\tthe case may be. On production of corrected documents, Passport<br \/>\n\tAuthorities will immediately carry out necessary correction in the<br \/>\n\tPassport.\n<\/p>\n<p>In<br \/>\n\tview of the observations made by the Division Bench of this Court in<br \/>\n\taforesaid decision, let petitioner may approach the concerned<br \/>\n\tMagistrate or the Civil Court for getting corrected date of birth<br \/>\n\trecorded in school leaving certificate on the basis of the birth<br \/>\n\tdate recorded in birth register as early as possible within period<br \/>\n\tof fifteen days from the date of receipt of copy of this order. As<br \/>\n\tand when concerned Magistrate or Civil Court receives such<br \/>\n\tapplication from petitioner, it is directed to concerned<br \/>\n\tMagistrate\/Civil Court to consider it and examine it on the basis of<br \/>\n\toriginal record which will be produced by petitioner and,<br \/>\n\tthereafter, to pass appropriate orders in accordance with law after<br \/>\n\tgiving reasonable opportunity of hearing to petitioner as early as<br \/>\n\tpossible, within period of four weeks from the date of receiving<br \/>\n\tsuch application from petitioner and communicate decision to<br \/>\n\tpetitioner.\n<\/p>\n<p>In<br \/>\n\tview of these observations and directions, this petition is disposed<br \/>\n\tof by this court without expressing any opinion on merits.
