Ofcourse in the meantime for a short<br \/>\nperiod of three months by an order dated 14.10.1977 she<br \/>\nhad been given an employment as Typist.     However, the<br \/>\npetitioner had raised a dispute about her unlawful<br \/>\ntermination in January\/February,1977 from the post of<br \/>\nStenographer.   This dispute was referred to the Labour<br \/>\nCourt, Baroda. On 28.3.1988 in reference (LCA) No.14 of<br \/>\n1980.    The Labour Court, Baroda granted relief of<br \/>\nreinstatement in favour of the petitioner without any<br \/>\nbackwages whatsoever.      Against   this   award   dated<br \/>\n28.3.1988, Baroda Municipal Corporation preferred Special<br \/>\nCivil Application No. 3483 of 1988 contesting the relief<br \/>\nof reinstatement as was granted by the Labour Court but<br \/>\nthis petition failed. While rejecting the corporation&#8217;s<br \/>\npetition summarily the Division Bench observed that &#8221; in<br \/>\nFebruary, 1977 when the respondent was terminated from<br \/>\nservice as Stenographer provision of Section 25F was<br \/>\nviolated by the petitioner corporation and therefore her<br \/>\ntermination was void&#8221;.\n<\/p>\n<p>The present petitioner workman had also filed<br \/>\nSpecial Civil Application No.      5497 of 1988 contesting<br \/>\nfor the backwages and consequential reliefs and this<br \/>\nSpecial Civil Application filed by the workman was<br \/>\ndismissed and the notice was discharged. The award dated<br \/>\n28.3.1988 as aforesaid thus attained the finality.      It<br \/>\nappears that this award dated 28.3.1988 granting relief<br \/>\nof reinstatement to the workman was not implemented by<br \/>\nthe respondent corporation and therefore a Miscellaneous<br \/>\nCivil Application No. 655 of 1988 in the nature of<br \/>\ncontempt application had been filed by the petitioner<br \/>\nworkman and this Miscellaneous Civil Application No. 655<br \/>\nof 1988 was decided by the Division Bench while noticing<br \/>\nthe statement of learned Counsel Mr.P.G.Desai for the<br \/>\nrespondent that it had complied with the direction given<br \/>\nby the Labour Court in as much as the petitioner has been<br \/>\nreinstated in service.     The Division Bench has also<br \/>\nobserved that there was some delay in reinstating the<br \/>\npetitioner   on the original post and therefore the<br \/>\nstatement of Mr.Desai was also noted that the wages for<br \/>\nthe period for which the delay had been caused in<br \/>\ncomplying with the direction will be paid to her on or<br \/>\nbefore 12.10.1990.     In view of this statement the<br \/>\nDivision Bench found that the application did not survive<br \/>\nand the same was disposed       of    as   having   become<br \/>\ninfructuous.   In this background the dispute has now<br \/>\nprecipitated between the parties about the continuity of<br \/>\nservice i.e. from January,1977 to 23.8.1988 when she was<br \/>\nreinstated on the basis of the award dated 28.3.1988.<br \/>\nThe Assistant Municipal Commissioner, 5th zone, Baroda<br \/>\nhas passed an order that all the grievances of the<br \/>\n petitioner were included in Special Civil Application No.<br \/>\n547 of 1988 and this Special Civil Application had been<br \/>\nrejected on 18.6.1992 and therefore, her request for<br \/>\ngranting continuity of service cannot be entertained.<br \/>\nThis order dated 30.10.1996 passed by the Assistant<br \/>\nMunicipal Commissioner, 5th zone, Baroda         is    under<br \/>\nchallenge in this petition.       Though it is mentioned in<br \/>\nthe award    dated    28.3.1988    that   the   relief    of<br \/>\nreinstatement is granted while denying the backwages,<br \/>\nnothing has been said in the positive terms with regard<br \/>\nto the continuity of service or otherwise but the fact<br \/>\nremains that the relief of continuity has not been denied<br \/>\nby any specific mention as has been done for the<br \/>\nbackwages.   Thus the petitioner may have failed before<br \/>\nthe Division Bench in getting the relief of backwages for<br \/>\nthe intervening period but that does not mean the<br \/>\nforfeiture of the continuity of the service because it is<br \/>\nnot a case of denying the continuity of service by any<br \/>\npositive penal order. The rejection of the petitioner&#8217;s<br \/>\nSpecial Civil Application No. 5497 of 1988 on 18.6.1992<br \/>\nonly means that her claim for the backwages was not<br \/>\naccepted by this Court nor it can be said on the basis of<br \/>\nthe order passed in Miscellaneous Civil Application<br \/>\nNo.655 of 1988 on 28.9.1990 that everything due to the<br \/>\npetitioner under the award had been given. In a facts of<br \/>\na given case if the Court comes to the conclusion that<br \/>\nthe contempt proceedings are not warranted, the Court may<br \/>\nnot proceed to initiate the contempt proceedings but the<br \/>\nmere fact that the Court does not initiate the contempt<br \/>\nproceedings does not mean that the rights of the party if<br \/>\nthey are otherwise available to her on the basis of the<br \/>\naward passed after adjudication would come to an end. An<br \/>\norder or action may not be contemptuous per se, still it<br \/>\nmay be illegal order. However, every illegal order may<br \/>\nnot be a contemptuous order and therefore the rejection<br \/>\nof the application in the nature of seeking contempt<br \/>\nproceedings would not impeach upon otherwise illegal<br \/>\norder or action. In this view of the matter, in my<br \/>\nconsidered   opinion,     neither   the rejection of the<br \/>\npetitioner&#8217;s Special Civil Application No. 5497 of 1988<br \/>\non 18.6.1992   nor    the    rejection   of Misc.      Civil<br \/>\nApplication No. 655 of 1988 in the nature of contempt<br \/>\nproceedings on the ground of being infructuous by the<br \/>\nDivision Bench comes in the petitioner&#8217;s way for claiming<br \/>\nrelief of continuity of service on the strength of the<br \/>\naward dated 28.3.1988, if at all it is available to her<br \/>\non the basis of that award itself.       It is therefore,<br \/>\nplain and simple case of interpretation of the relief<br \/>\ngranted by the Labour Court while passing the award dated<br \/>\n28.3.1988. By this award the relief of reinstatement has<br \/>\nbeen granted but the relief of backwages has been denied<br \/>\n specifically and the relief of continuity of service has<br \/>\nnot been denied in any terms except that along with the<br \/>\nrelief of reinstatement the word &#8216;continuity&#8217; has not<br \/>\nbeen mentioned. It may be straight way observed that<br \/>\nonce   the   relief of reinstatement is granted, the<br \/>\ncontinuity of service is the direct consequence rather<br \/>\ninherent in the relief of this nature, more particularly<br \/>\nwhen the Division Bench has already held that the<br \/>\ntermination was void. If the termination order was void<br \/>\nthe meaning is that in the eye of law the relief of<br \/>\nreinstatement has to be granted as if the impugned award<br \/>\nhad never been passed.    The question of backwages is<br \/>\ntherefore   dependent on variable factors of gainful<br \/>\nemployment during the period of enforced idleness and<br \/>\ntherefore in a given case the relief of backwages may not<br \/>\nbe granted depending upon the finding on the question of<br \/>\ngainful employment or otherwise during the period of<br \/>\nenforced idleness.     When the relief of reinstatement is<br \/>\ngranted and the continuity of service is not specifically<br \/>\ndenied the party has to be relegated to the same position<br \/>\nas was held by it at the time of termination.    When the<br \/>\norder of termination has been found to be void the<br \/>\npetitioner holds the relief of reinstatement with no<br \/>\nmention of specific denial of continuity of service the<br \/>\noncerned workman has to be relegated to the position<br \/>\nwhich was obtaining at the time of termination of her<br \/>\nservices and there is no question of denying           the<br \/>\ncontinuity of services for the period for which the<br \/>\nservices have been interrupted on account of an unlawful<br \/>\nand void order.\n<\/p>\n<p>For the reasons aforesaid I find that the order<br \/>\ndated   30.10.1996 passed by the Assistant Municipal<br \/>\nCommissioner is not based on any sound         reasoning.<br \/>\nReasons given therein are extraneous and not tenable and<br \/>\nthis order suffers from an error of law and appears to<br \/>\nhave been passed without objective application of mind<br \/>\nand the same cannot be sustained in the eye of law. This<br \/>\norder dated 30.10.1996, therefore, deserves to be quashed<br \/>\nand set aside, which I hereby do and direct           the<br \/>\nrespondent to grant the relief of continuity of service<br \/>\nand such other alike benefits except the backwages for<br \/>\nthe intervening period.     It is also pointed out by<br \/>\nMr.Supehia that the petitioner has already retired on<br \/>\n31.1.1997 on reaching the age of superannuation and a<br \/>\ngrievance has been made that no pension is paid to the<br \/>\npetitioner.   It is, therefore, made clear that the<br \/>\npetitioner being retired, due retiral benefits shall be<br \/>\ncomputed to her keeping the continuity of service in view<br \/>\nas if she had never been terminated in 1977 and as if she<br \/>\nhad continued in service through out till the date of<br \/>\n retirement. Rule is made absolute   in   the   terms   as<br \/>\naforesaid.
