             Heard learned Counsel.\n<\/p>\n
     The petitioner was employed with Baroda Municipal
\n     Corporation on 7.7.1975 as Stenographer and her services
\n     were   terminated   in   January\/February,1997    without
\n     following requirements of Section 25F of the Industrial
\n Disputes Act. Ofcourse in the meantime for a short
\nperiod of three months by an order dated 14.10.1977 she
\nhad been given an employment as Typist.     However, the
\npetitioner had raised a dispute about her unlawful
\ntermination in January\/February,1977 from the post of
\nStenographer.   This dispute was referred to the Labour
\nCourt, Baroda. On 28.3.1988 in reference (LCA) No.14 of
\n1980.    The Labour Court, Baroda granted relief of
\nreinstatement in favour of the petitioner without any
\nbackwages whatsoever.      Against   this   award   dated
\n28.3.1988, Baroda Municipal Corporation preferred Special
\nCivil Application No. 3483 of 1988 contesting the relief
\nof reinstatement as was granted by the Labour Court but
\nthis petition failed. While rejecting the corporation’s
\npetition summarily the Division Bench observed that ” in
\nFebruary, 1977 when the respondent was terminated from
\nservice as Stenographer provision of Section 25F was
\nviolated by the petitioner corporation and therefore her
\ntermination was void”.\n<\/p>\n
The present petitioner workman had also filed
\nSpecial Civil Application No.      5497 of 1988 contesting
\nfor the backwages and consequential reliefs and this
\nSpecial Civil Application filed by the workman was
\ndismissed and the notice was discharged. The award dated
\n28.3.1988 as aforesaid thus attained the finality.      It
\nappears that this award dated 28.3.1988 granting relief
\nof reinstatement to the workman was not implemented by
\nthe respondent corporation and therefore a Miscellaneous
\nCivil Application No. 655 of 1988 in the nature of
\ncontempt application had been filed by the petitioner
\nworkman and this Miscellaneous Civil Application No. 655
\nof 1988 was decided by the Division Bench while noticing
\nthe statement of learned Counsel Mr.P.G.Desai for the
\nrespondent that it had complied with the direction given
\nby the Labour Court in as much as the petitioner has been
\nreinstated in service.     The Division Bench has also
\nobserved that there was some delay in reinstating the
\npetitioner   on the original post and therefore the
\nstatement of Mr.Desai was also noted that the wages for
\nthe period for which the delay had been caused in
\ncomplying with the direction will be paid to her on or
\nbefore 12.10.1990.     In view of this statement the
\nDivision Bench found that the application did not survive
\nand the same was disposed       of    as   having   become
\ninfructuous.   In this background the dispute has now
\nprecipitated between the parties about the continuity of
\nservice i.e. from January,1977 to 23.8.1988 when she was
\nreinstated on the basis of the award dated 28.3.1988.
\nThe Assistant Municipal Commissioner, 5th zone, Baroda
\nhas passed an order that all the grievances of the
\n petitioner were included in Special Civil Application No.
\n547 of 1988 and this Special Civil Application had been
\nrejected on 18.6.1992 and therefore, her request for
\ngranting continuity of service cannot be entertained.
\nThis order dated 30.10.1996 passed by the Assistant
\nMunicipal Commissioner, 5th zone, Baroda         is    under
\nchallenge in this petition.       Though it is mentioned in
\nthe award    dated    28.3.1988    that   the   relief    of
\nreinstatement is granted while denying the backwages,
\nnothing has been said in the positive terms with regard
\nto the continuity of service or otherwise but the fact
\nremains that the relief of continuity has not been denied
\nby any specific mention as has been done for the
\nbackwages.   Thus the petitioner may have failed before
\nthe Division Bench in getting the relief of backwages for
\nthe intervening period but that does not mean the
\nforfeiture of the continuity of the service because it is
\nnot a case of denying the continuity of service by any
\npositive penal order. The rejection of the petitioner’s
\nSpecial Civil Application No. 5497 of 1988 on 18.6.1992
\nonly means that her claim for the backwages was not
\naccepted by this Court nor it can be said on the basis of
\nthe order passed in Miscellaneous Civil Application
\nNo.655 of 1988 on 28.9.1990 that everything due to the
\npetitioner under the award had been given. In a facts of
\na given case if the Court comes to the conclusion that
\nthe contempt proceedings are not warranted, the Court may
\nnot proceed to initiate the contempt proceedings but the
\nmere fact that the Court does not initiate the contempt
\nproceedings does not mean that the rights of the party if
\nthey are otherwise available to her on the basis of the
\naward passed after adjudication would come to an end. An
\norder or action may not be contemptuous per se, still it
\nmay be illegal order. However, every illegal order may
\nnot be a contemptuous order and therefore the rejection
\nof the application in the nature of seeking contempt
\nproceedings would not impeach upon otherwise illegal
\norder or action. In this view of the matter, in my
\nconsidered   opinion,     neither   the rejection of the
\npetitioner’s Special Civil Application No. 5497 of 1988
\non 18.6.1992   nor    the    rejection   of Misc.      Civil
\nApplication No. 655 of 1988 in the nature of contempt
\nproceedings on the ground of being infructuous by the
\nDivision Bench comes in the petitioner’s way for claiming
\nrelief of continuity of service on the strength of the
\naward dated 28.3.1988, if at all it is available to her
\non the basis of that award itself.       It is therefore,
\nplain and simple case of interpretation of the relief
\ngranted by the Labour Court while passing the award dated
\n28.3.1988. By this award the relief of reinstatement has
\nbeen granted but the relief of backwages has been denied
\n specifically and the relief of continuity of service has
\nnot been denied in any terms except that along with the
\nrelief of reinstatement the word ‘continuity’ has not
\nbeen mentioned. It may be straight way observed that
\nonce   the   relief of reinstatement is granted, the
\ncontinuity of service is the direct consequence rather
\ninherent in the relief of this nature, more particularly
\nwhen the Division Bench has already held that the
\ntermination was void. If the termination order was void
\nthe meaning is that in the eye of law the relief of
\nreinstatement has to be granted as if the impugned award
\nhad never been passed.    The question of backwages is
\ntherefore   dependent on variable factors of gainful
\nemployment during the period of enforced idleness and
\ntherefore in a given case the relief of backwages may not
\nbe granted depending upon the finding on the question of
\ngainful employment or otherwise during the period of
\nenforced idleness.     When the relief of reinstatement is
\ngranted and the continuity of service is not specifically
\ndenied the party has to be relegated to the same position
\nas was held by it at the time of termination.    When the
\norder of termination has been found to be void the
\npetitioner holds the relief of reinstatement with no
\nmention of specific denial of continuity of service the
\noncerned workman has to be relegated to the position
\nwhich was obtaining at the time of termination of her
\nservices and there is no question of denying           the
\ncontinuity of services for the period for which the
\nservices have been interrupted on account of an unlawful
\nand void order.\n<\/p>\n
For the reasons aforesaid I find that the order
\ndated   30.10.1996 passed by the Assistant Municipal
\nCommissioner is not based on any sound         reasoning.
\nReasons given therein are extraneous and not tenable and
\nthis order suffers from an error of law and appears to
\nhave been passed without objective application of mind
\nand the same cannot be sustained in the eye of law. This
\norder dated 30.10.1996, therefore, deserves to be quashed
\nand set aside, which I hereby do and direct           the
\nrespondent to grant the relief of continuity of service
\nand such other alike benefits except the backwages for
\nthe intervening period.     It is also pointed out by
\nMr.Supehia that the petitioner has already retired on
\n31.1.1997 on reaching the age of superannuation and a
\ngrievance has been made that no pension is paid to the
\npetitioner.   It is, therefore, made clear that the
\npetitioner being retired, due retiral benefits shall be
\ncomputed to her keeping the continuity of service in view
\nas if she had never been terminated in 1977 and as if she
\nhad continued in service through out till the date of
\n retirement. Rule is made absolute   in   the   terms   as
\naforesaid. No order as to costs.\n<\/p>\n
