Sri.P.C.Sasidharan, the learned counsel appearing for<\/p>\n<p>the petitioner and Smt.Anu Sivaraman, the learned Government<\/p>\n<p>Pleader appearing for the respondents.\n<\/p>\n<p>    2. The petitioner is presently working as Deputy Director in<\/p>\n<p>the Animal Husbandry Department. When he was superceded for<\/p>\n<p>promotion to the post of Deputy Director for the year 2006, he<\/p>\n<p>filed W.P.(C) No.27840 of 2006 in this Court. By Ext.P2 judgment<\/p>\n<p>delivered on 12.1.2007, a learned Single Judge of this Court<\/p>\n<p>directed the Departmental Promotion Committee to consider the<\/p>\n<p>review petition submitted by the petitioner, holding that he was<\/p>\n<p>entitled to be considered for promotion in the year 2006. Ext.P2<\/p>\n<p>judgment has become final. The petitioner thereafter moved the<\/p>\n<p>Secretary to Government, Animal Husbandry Department by<\/p>\n<p>submitting Ext.P3 representation. In purported implementation of<\/p>\n<p>the directions issued by this Court in Ext.P2 judgment, the<\/p>\n<p>Departmental Promotion Committee considered the claim of the<\/p>\n<p>petitioner and included him in the select list of officers eligible for<\/p>\n<p>promotion as Deputy Director for the year 2007.         Ext.P4 is the<\/p>\n<p>select list approved and published by the State Government based<\/p>\n<p>on the      recommendations    of  the  Departmental Promotion<\/p>\n<p>Committee.     The grievance voiced by the petitioner in this writ<\/p>\n<p><span class=\"hidden_text\">W.P.(C)24599\/2008                2<\/span><\/p>\n<p>   petition is that Ext.P4 select list to the extent it denies him<\/p>\n<p>   inclusion in the select list for the year 2006 is arbitrary and is not<\/p>\n<p>   in tune with the findings in Ext.P2 judgment.\n<\/p>\n<p>      3. When the writ petition came up for admission, this Court<\/p>\n<p>   had directed the learned Government Pleader to get instructions<\/p>\n<p>   and file a statement. The Joint Secretary to Government,<\/p>\n<p>   Agriculture Department has as directed by this Court filed a<\/p>\n<p>   statement dated 4.10.2008 which reads as follows:<\/p>\n<blockquote><p>             The writ petition is filed seeking inclusion<br \/>\n             of the petitioner&#8217;s name in the select list<br \/>\n             for promotion as Deputy Director, Animal<br \/>\n             Husbandry     for   the   year  2006.    It  is<br \/>\n             respectfully submitted that Government<br \/>\n             have since taken a decision to refer the<br \/>\n             case of the petitioner to the Departmental<br \/>\n             Promotion Committee (Higher). The PSC<br \/>\n             member who is the Chairman of the<br \/>\n             Departmental      Promotion    Committee     is<br \/>\n             being moved for convening a meeting of<br \/>\n             the    ad-hoc     Departmental     Promotion<br \/>\n             Committee to consider the request made<br \/>\n             by the petitioner for inclusion of his name<br \/>\n             in the select list of Deputy Director for the<br \/>\n             year 2006. It is prayed that adequate time<br \/>\n             may be granted for convening ad-hoc<br \/>\n             Departmental Promotion committee and<br \/>\n             taking a decision in the matter.&#8221;\n<\/p><\/blockquote>\n<p>   4. It is seen from the above statement that the Departmental<\/p>\n<p>Promotion Committee is reconsidering the claim of the petitioner for<\/p>\n<p>inclusion in the select list of Deputy Directors for the year 2006. In this<\/p>\n<p>state of affairs, I dispose of the writ petition with a direction to the<\/p>\n<p>Secretary to Government, Animal Husbandry Department, who is the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)24599\/2008                3<\/span><\/p>\n<p>Convenor of the      Departmental Promotion Committee to finalise the<\/p>\n<p>proceedings referred to in the statement dated 4.10.2008 and<\/p>\n<p>communicate its decision to the State Government within three months<\/p>\n<p>from the date of receipt of a copy of this judgment.             The State<\/p>\n<p>Government shall thereupon issue formal orders in the light of the<\/p>\n<p>recommendations of the Departmental Promotion Committee.
