Justice T.R.RAMACHANDRAN NAIR\n\n Dated :27\/01\/2009\n\n O R D E R\n                T.R.RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.20836 of 2007\n                      --------------------------\n              Dated this the 27th January,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      This writ petition is filed seeking for a direction to<\/p>\n<p>the respondents to grant grade promotion and enhanced<\/p>\n<p>rate of pension reckoning petitioner&#8217;s military service<\/p>\n<p>towards his civil pension from K.S.E.B. According to the<\/p>\n<p>petitioner, he had in his credit a total embodied service of<\/p>\n<p>two years and 85 days under the Territorial Army.<\/p>\n<p>Petitioner seeks for a direction to the KSEB as noted<\/p>\n<p>above to revise the pensionary benefits after counting the<\/p>\n<p>earlier service under the Territorial Army.<\/p>\n<p>      2.    Learned standing counsel for the respondents<\/p>\n<p>pointed out that for the very same reliefs, the petitioner<\/p>\n<p>had approached this Court earlier by filing O.P No.15329<\/p>\n<p>of 1998 and the original petition was dismissed.        The<\/p>\n<p>relevant portion of the judgment is extracted below.<\/p>\n<blockquote><p>            &#8220;The relief sought for in the Original<br \/>\n      Petition is that the service rendered by the<br \/>\n      petitioner in Territorial Army, prior to joining<br \/>\n      the Electricity Board should be counted as<\/p>\n<p>W.P ( C) No.20836 of 2007<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>      military service for the purpose of grade<br \/>\n      promotion and pensionary benefits. But in view<br \/>\n      of Rule 2 (9A) of Part I of the Kerala State and<br \/>\n      Subordinate Services Rules        service in the<br \/>\n      Territorial Army cannot be reckoned as military<br \/>\n      service.      Therefore, the Original Petition is<br \/>\n      devoid of any merit and the same is accordingly<br \/>\n      dismissed&#8221;.<\/p><\/blockquote>\n<p>      Since the relief sought for in this writ petition stands<\/p>\n<p>rejected by the earlier judgment of this Court, the writ<\/p>\n<p>petition is not maintainable. Learned counsel for the<\/p>\n<p>petitioner submitted that the said judgment will not bind<\/p>\n<p>the petitioner in view of subsequent communications.<\/p>\n<p>When there is a clear finding in the earlier judgment, on<\/p>\n<p>the same claim, against the petitioner which has become<\/p>\n<p>final, a second writ petition cannot be entertained.
