Justice K.HEMA\n\n Dated :22\/06\/2010\n\n O R D E R\n                               K.HEMA, J\n                          -----------------------\n                       B.A No.3246 OF 2010\n                      --------------------------------\n               Dated this the 22nd day of June 2010\n\n                                 ORDER\n<\/pre>\n<p>           This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offences are under Sections 341, 323, 308<\/p>\n<p>r\/w Section 34 of IPC. According to prosecution, on 15\/05\/2010 at<\/p>\n<p>about 6 p.m, while de facto complainant was walking along road,<\/p>\n<p>petitioners came in a motorcycle and wrongfully restrained de<\/p>\n<p>facto complainant, beat him with hands, pushed him down and<\/p>\n<p>thereafter hit him with a stone, and committed various offences.<\/p>\n<p>      3.  Learned counsel for the petitioner submitted that no<\/p>\n<p>incident as alleged had taken place. De facto complainant had<\/p>\n<p>sustained only minor injuries and offence under Section 308 of IPC<\/p>\n<p>is not involved.   The allegations made against petitioners are<\/p>\n<p>false.\n<\/p>\n<p>      4.  Learned Public Prosecutor opposed this petition and<\/p>\n<p>submitted that de facto complainant sustained two injuries which<\/p>\n<p>include swelling and abrasion. Stone was used for commission of<\/p>\n<p>offence.  It is also submitted that first accused is involved in<\/p>\n<p>various theft cases and offence under Abkari Act.<\/p>\n<p>        5. On hearing both sides, considering the various<\/p>\n<p>submissions made, I find that petitioner has a strong and<\/p>\n<p>arguable case in respect of involvement of offence under Section<\/p>\n<p><span class=\"hidden_text\">B.A No.3246 OF 2010                2<\/span><\/p>\n<p>308 of IPC. But, considering the serious nature of allegations<\/p>\n<p>made, I find that it is a fit case to grant anticipatory bail. No<\/p>\n<p>ground is made out to grant anticipatory bail.          Hence, the<\/p>\n<p>following order is passed.\n<\/p>\n<p>         (1) Petitioners     shall   surrender     before   the<\/p>\n<p>              Investigating Officer within seven     days from<\/p>\n<p>              today and co-operate with investigation.<\/p>\n<p>        (2) On such surrender, if the petitioners are arrested,<\/p>\n<p>             offence under Section 308 of IPC will be treated as<\/p>\n<p>             not included for the purpose of bail.\n<\/p>\n<p>                   Petition is disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                                  K.HEMA<br \/>\n                                                   JUDGE<\/p>\n<p>vdv<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sudheer vs State Of Kerala on 22 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3246 of 2010() 1.
