BRAHMDEO KESHARI S\/O BUDHAN KESHRI R\/O VILL.-\n         SIKANDRA, P.S.- SIKANDRA, DISTT.- JAMUI\n                                         -----------\n<\/pre>\n<p>2.   28.01.2011            Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                           The petitioner appears to be having a private<\/p>\n<p>                  dispute with private respondent no. 10.       The dispute<\/p>\n<p>                  relates to a house property.     Learned counsel for the<\/p>\n<p>                  petitioner submits that the local Police at the behest of<\/p>\n<p>                  respondent no. 10 has forcibly entered the premises,<\/p>\n<p>                  locking certain portions and demolished certain portions.<\/p>\n<p>                  He places reliance in support of the same on Annexure-3<\/p>\n<p>                  dated 31.10.2009 to urge that it was the Police who was<\/p>\n<p>                  acting in excess of power in a private dispute. Reliance is<\/p>\n<p>                  also placed on pleadings in Paragraph-5 that the officer<\/p>\n<p>                  incharge Sikandra Police Station was acting at the behest<\/p>\n<p>                  of private respondent no. 10. The submission therefore is<\/p>\n<p>                  that the Police cannot interfere in a purely private civil<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>dispute more particularly by intrusion into the property of<\/p>\n<p>a citizen without authority of law.\n<\/p>\n<p>          The writ petition was filed on 31.8.2010 after<\/p>\n<p>serving two copies in the office of Advocate General. More<\/p>\n<p>than six months later the official respondents seem to be<\/p>\n<p>in no hurry to file a counter affidavit. Learned counsel for<\/p>\n<p>the State from Annexure-3       dated 31.10.2009 submits<\/p>\n<p>that the Circle Officer had only called for a report from the<\/p>\n<p>Officer incharge, Sikandra Police Station and directed him<\/p>\n<p>to ensure that peace and tranquility is not disturbed.<\/p>\n<p>          In a private dispute between citizens, when both<\/p>\n<p>of them have remedies available to them under the Civil<\/p>\n<p>law, the Police has no authority to interfere unless there<\/p>\n<p>be any competent orders of a Court of law. If the dispute<\/p>\n<p>takes a criminal camouflage there have to be appropriate<\/p>\n<p>orders instituting a case and investigation followed by<\/p>\n<p>preliminary orders to interfere under provisions of the<\/p>\n<p>Penal Code or the Cr.P.C. as the case may be on orders by<\/p>\n<p>a competent authority.\n<\/p>\n<p>          This aspect has been emphasized by this Court<\/p>\n<p>in more than one case of the present nature and the Court<\/p>\n<p>has deprecated the interference of the Police in purely civil<\/p>\n<p>matters between private parties.\n<\/p>\n<p>          Let   the   petitioner      represent   before   the<\/p>\n<p>Superintendent of Police, Jamui with regard to his<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>           grievance that the officer incharge, Sikandra Police<\/p>\n<p>           Station, was unlawfully intruding into a purely private<\/p>\n<p>           dispute. The Superintendent of Police is required to hear<\/p>\n<p>           the concerned parties and then pass a reasoned and<\/p>\n<p>           speaking order.        If he comes to the conclusion that<\/p>\n<p>           without any authority of law the officer incharge, Sikandra<\/p>\n<p>           Police Station has intruded into the private dispute,<\/p>\n<p>           necessary consequential orders shall be passed by the<\/p>\n<p>           Superintendent of Police restoring status quo ante existing<\/p>\n<p>           before any action was taken by the officer incahrge. If the<\/p>\n<p>           officer incharge had acted in pursuance of any order of a<\/p>\n<p>           competent authority exercising statutory powers or a<\/p>\n<p>           Court of law, the Superintendent of Police should be at<\/p>\n<p>           liberty to consider the same. If the officer incharge acted<\/p>\n<p>           without authority of law any action directed by the<\/p>\n<p>           Superintendent of Police shall not prejudice private<\/p>\n<p>           respondent no. 10 or any other person from instituting<\/p>\n<p>           appropriate proceeding in a competent Court of law which<\/p>\n<p>           shall have to be decided on its own merits in accordance<\/p>\n<p>           with law.\n<\/p>\n<p>                       The writ application stands disposed.\n<\/p>\n<\/p>\n<pre>P.
