Justice M.SASIDHARAN NAMBIAR\n\n Dated :30\/11\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4319 OF 2010\n           ---------------------------------------------\n            Dated 30th         November, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>         Petitioner is the first accused in<\/p>\n<p>Crime  No.779\/2010               of        Aranmula       Police<\/p>\n<p>Station registered on Annexure-A FIR for<\/p>\n<p>the offences under Sections 363 and 188<\/p>\n<p>read with Section 34 of Indian Penal Code,<\/p>\n<p>based on the first information statement<\/p>\n<p>furnished by the third respondent, father<\/p>\n<p>of the second respondent. Petitioner and<\/p>\n<p>second respondent are advocates practicing<\/p>\n<p>in  Pathanamthitta            courts.            Allegation   in<\/p>\n<p>Annexure-A FIR is that petitioner abducted<\/p>\n<p>second respondent and thereby committed the<\/p>\n<p>offences. Third respondent had filed W.P.<\/p>\n<p>(Crl).No.337\/2010              before               this   court<\/p>\n<p>alleging  that        second            respondent        is  in<\/p>\n<p>Crmc 4319\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>unlawful confinement of the petitioner. By<\/p>\n<p>Annexure-B      judgment,  writ  petition   was<\/p>\n<p>dismissed finding that second respondent is a<\/p>\n<p>major       aged 25 years  and  an advocate by<\/p>\n<p>profession.     This  Court  has  accepted  her<\/p>\n<p>assertion that she is not under any illegal<\/p>\n<p>confinement or detention. Petition is filed<\/p>\n<p>under      Section  482  of  Code  of  Criminal<\/p>\n<p>Procedure to quash Annexure-A FIR contending<\/p>\n<p>that when second respondent herself asserted<\/p>\n<p>before the Division Bench of this Court that<\/p>\n<p>she is not in the illegal confinement of the<\/p>\n<p>petitioner, continuation of the proceedings<\/p>\n<p>is only an abuse of process of the court. It<\/p>\n<p>is also stated that he has      settled all the<\/p>\n<p>disputes with the second respondent.<\/p>\n<p>            2. Second    respondent    appeared<\/p>\n<p>through a counsel and filed a joint petition<\/p>\n<p>Crmc 4319\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>with the petitioner       stating that when this<\/p>\n<p>court      in habeas corpus  petition found that<\/p>\n<p>second      respondent  is  not  in  the  illegal<\/p>\n<p>detention or confinement of the petitioner<\/p>\n<p>and     second    respondent  has  no   grievance<\/p>\n<p>against the petitioner, it is not in the<\/p>\n<p>interest       of   justice   to   continue   the<\/p>\n<p>prosecution.\n<\/p>\n<p>            3.   Learned   counsel appearing for<\/p>\n<p>the         petitioner,  second  respondent   and<\/p>\n<p>learned Public Prosecutor     were heard.<\/p>\n<p>            4. Learned      Public     Prosecutor<\/p>\n<p>submitted      that   statement  of   the   third<\/p>\n<p>respondent recorded shows that        he has not<\/p>\n<p>settled the dispute and second respondent is<\/p>\n<p>now    studying in Bangalore.\n<\/p>\n<p>            5. Allegation in Annexure-A FIR is<\/p>\n<p>that petitioner abducted second respondent.<\/p>\n<p>Crmc 4319\/10<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>Based on the same allegation third respondent<\/p>\n<p>filed      habeas  corpus   petition  which   was<\/p>\n<p>dismissed by Annexure-B judgment after second<\/p>\n<p>respondent appeared before the Division Bench<\/p>\n<p>and asserted that she was      not in any illegal<\/p>\n<p>confinement      or  detention.  Joint  statement<\/p>\n<p>filed      by  the  second  respondent  with  the<\/p>\n<p>petitioner establishes that in the mediation,<\/p>\n<p>entire      disputes were   settled  between  the<\/p>\n<p>petitioner and second respondent and she has<\/p>\n<p>no objection for quashing the proceedings.<\/p>\n<p>            6.  Petitioner and second respondent<\/p>\n<p>are lawyers, second respondent, the alleged<\/p>\n<p>victim       of abduction has settled all the<\/p>\n<p>disputes with the petitioner. She has also<\/p>\n<p>stated that she has no grievance against the<\/p>\n<p>petitioner. Hence it is not in the in the<\/p>\n<p>interest       of   justice   to   continue   the<\/p>\n<p>Crmc 4319\/10<br \/>\n<span class=\"hidden_text\">                          5<\/span><\/p>\n<p>prosecution      as  ultimately,  there  is  no<\/p>\n<p>likelihood of a successful prosecution.<\/p>\n<p>            Petition   is     allowed.
