Vasavada for the<br \/>\npetitioners.\n<\/p>\n<p>1.1\tHeard<br \/>\nShri Shantaram Gangaram Chaudhary, the Power of Attorney of the<br \/>\nrespondent.\n<\/p>\n<p>2.0\tThe<br \/>\nlearned senior advocate for the petitioners stated that the<br \/>\npetitioner is ready and willing to allow the respondent to resume the<br \/>\nduties on same terms and conditions on which he was working when his<br \/>\nservices came to an end on expiry of contract (as is the say of the<br \/>\npetitioner).\n<\/p>\n<p>2.1\tThe<br \/>\nPower of Attorney of the respondent has objection to the same and he<br \/>\nstated that the petitioner be directed to reinstate him as a<br \/>\npermanent employee at the wages payable to a regularly appointed<br \/>\nWatchman.  The Power of Attorney invited attention of the Court to<br \/>\ndifferent documents in support of the contention that there was no<br \/>\nvalidly executed contract between the parties.  In this regard, he<br \/>\nalso invited attention of the Court to the Office Orders, to mention<br \/>\nthe few, exhs. 41, 40, 83, 85, 44, 45, 46 and other similar<br \/>\ndocuments.  The Power of Attorney also argued that when the matter<br \/>\nwas referred to by the Conciliation Officer to the Labour Court,<br \/>\nholding the petitioner to be an &#8216;Industry&#8217;, the said order was not<br \/>\nchallenged by the petitioner.  Hence, it is not open for the<br \/>\npetitioner to contend that the petitioner is not an &#8216;Industry&#8217;.\n<\/p>\n<p>3.0\tThe<br \/>\nmatter is already admitted by order dated 29th September<br \/>\n2011.  Today the matter is before the Court for confirmation of<br \/>\nad-interim relief. The ad-interim relief was granted in terms of Para<br \/>\n10(d).  Taking into consideration the fact that the Power of Attorney<br \/>\nhas objection against reporting for duty, the ad-interim relief<br \/>\ngranted is ordered to be continued till final disposal of the matter.\n<\/p>\n<p>3.1\tTaking<br \/>\ninto consideration the fact that the respondent is out of job and not<br \/>\nwilling to report for duty, it is deemed proper that the matter be<br \/>\nordered to be listed for final hearing on<br \/>\n12th<br \/>\nDecember 2011.\n<\/p>\n<p>[<br \/>\nRavi R.
