JUSTICE GOPAL KRISHAN VYAS<\/p>\n<p>Mr.C.S. Ojha, Dy. Govt. Counsel.\n<\/p>\n<p>Mr.Mahaveer Bishnoi, for the respondent.\n<\/p>\n<p>            Heard learned counsel for the parties.\n<\/p>\n<p>            In    this     case,       petitioner-department    is<br \/>\nchallenging        the     validity      of   award    dated   14th<br \/>\nNovember, 2007           passed by the Judge, Labour Court,<br \/>\nJodhpur.\n<\/p>\n<p>            Upon Perusal of the award, it is obvious<br \/>\nthat    services            of     respondent-workman          were<br \/>\nterminated without following provisions of Section<br \/>\n25-F   of        the     Industrial       Disputes     Act,    1947<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>therefore,        the       learned    Judge,    Labour       Court    has<br \/>\npassed an award for reinstatement of respondent-<br \/>\nworkman w.e.f. 01st November, 1995 with 50% back<br \/>\nwages alongwith continuity in service.\n<\/p>\n<p>             In    my        opinion,      admittedly        petitioner-<br \/>\ndepartment        is    an     &#8220;industry&#8221;       and    respondent      is<br \/>\nworkman, therefore, at the time of retrenchment,<br \/>\npetitioner-department was under an obligation to<br \/>\ncomply with the provisions of Section 25-F of the<br \/>\nIndustrial Disputes Act which is not complied with<br \/>\nby    the     petitioner-department,                  therefore,       the<br \/>\nJudge, Labour Court has rightly arrived at with<br \/>\nthe finding that termination of respondent-workman<br \/>\nis in violation of provisions of Section 25-F (a)<br \/>\nand    (b)    of       the     Industrial       Disputes      Act.     The<br \/>\nfinding      of    Judge,        Labour       Court     is    based     on<br \/>\nappreciation           of     cogent       evidence      produced       by<br \/>\nworkman before the Court, so also, upon admitted<br \/>\nposition of the case that respondent-workman was<br \/>\ninitially appointed on 21st May, 1991 and worked up<br \/>\nto    31st   October,         1995,       therefore,    there     is    no<br \/>\ndispute with regard to completion of 240 days by<br \/>\nthe workman in preceding one calender year from<br \/>\nthe date of retrenchment.\n<\/p>\n<p>             In this view of the matter, it is not a<br \/>\n<span class=\"hidden_text\">                                            3<\/span><\/p>\n<p>        fit case in which power under Article 226 and 227<br \/>\n        of the Constitution of India is required to be<br \/>\n        exercised.       The writ petition filed by petitioner-<br \/>\n        department is hereby dismissed.                      The petitioner-<br \/>\n        department        is        directed       to        reinstate        the<br \/>\n        respondent-workman and grant him wages and other<br \/>\n        reliefs as granted by the Judge, Labour Court in<br \/>\n        the award impugned forthwith and pay him salary<br \/>\n        also with effect from the date of award.                         However,<br \/>\n        it   is    made    clear       that       for       the     purpose    of<br \/>\n        regularization of his services, respondent-workman<br \/>\n        may file a representation alongwith copy of the<br \/>\n        judgment rendered by the Hon&#8217;ble Supreme Court in<br \/>\n        case Secretary, State of Karnataka vs. Uma Devi,<br \/>\n        reported    in    2006      (4)    SCC    1     before      petitioner-<br \/>\n        department.       Upon       filing       such       representation,<br \/>\n        department        shall       decide          the         question    of<br \/>\n        regularization         as    per    para      53     to     55   of   the<br \/>\n        aforesaid    judgment         rendered        by    Hon&#8217;ble      Supreme<br \/>\n        Court.
