The present application has been focused only on the<br \/>\nmedical ground for which the documents are produced on record.<br \/>\nHowever, in order to confirm, when the learned Counsel Mr. P.G.Desai<br \/>\nappearing for the bank has resisted along with the learned APP, the<br \/>\nreport was called for from the Civil Hospital for which the order was<br \/>\npassed on 31.08.2010. The certificate which was produced by APP in<br \/>\nthe morning today did not specifically state as to whether the<br \/>\napplicant is able to attend his daily routine or not and it has been<br \/>\nstated that &#8216;patient is walking without aids&#8217;. Since the issue is<br \/>\nwith regard to the disability of the applicant to such an extent he<br \/>\nis not in a position to move or to do daily routine work alone and<br \/>\ntherefore he should be released on bail, the learned A.P.P. was asked<br \/>\nto confirm and at 4:15 p.m. another certificate is produced which<br \/>\nstates that  looking to disability &amp; muscle chart, he is not<br \/>\nable to perform his activity of daily living (ADL) . Leaving the<br \/>\nmatter as it is which the Court has to note and it may also be<br \/>\nconsidered by the authorities concerned CBI. Both the certificates<br \/>\nare taken on record and in view of this opinion and considering the<br \/>\nsecond certificate also, on humanitarian ground, the present<br \/>\napplication deserves to be allowed only on the medical grounds based<br \/>\non this kind of certificate, subject to the following conditions.\n<\/p>\n<p>\t2.\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with the F.I.R. being CR<br \/>\n\tNo.I(E)\/2010 registered before the Central Bureau of Investigation<br \/>\n\tBS&amp;FC\/MUM, on his executing a bond of Rs.5,00,000\/- (Rupees Five<br \/>\n\tLac) with one solvent surety of the like amount to the satisfaction<br \/>\n\tof the lower Court and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM till<br \/>\nthe trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(h)\tnot<br \/>\nleave the India without the prior permission of this Court.\n<\/p>\n<p>7.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be  free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\n\tis made absolute to the aforesaid   extent.
