With the consent of the parties, the matter is taken up<br \/>\nfor hearing today.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the impugned award dated 14.05.2009 passed by the Labour Court,<br \/>\nRajkot in Reference [LCR] No. 85\/2008, whereby the Labour Court has<br \/>\nrejected the said reference.\n<\/p>\n<p>3.\t\tThe<br \/>\nshort facts of the case are that the petitioner at the relevant time<br \/>\nwas working as Conductor with the respondent Corporation. The<br \/>\nallegation against the petitioner is that on 03.02.2006 while he was<br \/>\ndischarging his duties, the bus was checked by the checking squad and<br \/>\nit was found that he has committed certain financial irregularities.<br \/>\nIn view of the aforesaid misconduct, the petitioner was served with<br \/>\nthe charge sheet being Charge Sheet no.189\/2006 dated 16.05.2006.<br \/>\nThereafter, departmental inquiry was initiated against him and<br \/>\nultimately, show cause notice dated 03.02.2007 was issued to the<br \/>\npetitioner to show cause as to why he should not be dismissed from<br \/>\nthe service. The petitioner replied to the said show cause notice<br \/>\nvide reply dated 10.02.2007. After considering the case of the<br \/>\npetitioner, as well as the documents of the departmental inquiry, the<br \/>\nguilt of the petitioner was proved and the respondent vide order<br \/>\ndated 14.03.2007 dismissed the petitioner from service.  Against the<br \/>\nsaid order, the petitioner preferred First Appeal before the<br \/>\nappellate authority, which came to be rejected vide order dated<br \/>\n28.04.2008.\n<\/p>\n<p>3.1.\t\tIn<br \/>\nview of that the petitioner raised industrial dispute which was<br \/>\nultimately referred to the Labour Court, Rajkot for adjudication<br \/>\nbeing Reference [LCR] No. 85\/2008. Before the Labour Court,  both the<br \/>\nparties adduced parties evidence and after appreciating the material<br \/>\nproduced before it,  the Labour Court rejected the said reference.<br \/>\nHence,  this petition.\n<\/p>\n<p>4.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Looking to the peculiar facts and circumstances of the<br \/>\ncase,  and in view of the allegations levelled against the<br \/>\npetitioner,  I am of the opinion, that ends of justice will be<br \/>\nserved, if the petitioner is  reinstated in service on his original<br \/>\nbasic pay-scale.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances, the petition is partly allowed.  The impugned<br \/>\naward dated 14.05.2009 passed by the Labour Court, Rajkot in<br \/>\nReference [LCR] No. 85 of 2008 is quashed and set aside. The<br \/>\nrespondent will reinstate the petitioner in service on his original<br \/>\npay scale. The respondent  will reinstate the petitioner within a<br \/>\nperiod of four weeks from the date of receipt of the order of this<br \/>\nCourt.
