This
\n\tCourt has perused the report dated 8.9.2010.\n<\/p>\n
At
\n\tthis stage it can be said that prima facie the report and
\n\texplanation by the learned Trial Court does not appear to be proper.\n<\/p>\n
When
\n\tthe order dated 19.4.2010 requiring action to be taken against the
\n\tcontemnor under Order 39 Rule 2A was not disturbed by the learned
\n\tAppellate Court and when the learned First Appellate Court had, by
\n\tthe order dated 30.7.2010 confirmed the said order and it had, in
\n\tturn, directed that:-  defendants are hereby given a chance and\/or
\n\ttime and it is hereby directed that the order of the Trial Court
\n\tregarding civil imprisonment be implemented after 30 days from the
\n\tdate of this order , the learned Court was supposed to take
\n\tnecessary steps as per the said order dated 30.7.2010 and to ensure
\n\tthat the defendants are taken in civil imprisonment.\n<\/p>\n
It
\n\tis the case of the petitioners before this Court that though the
\n\tpetitioners i.e. original defendants tried to surrender, for one
\n\treason or another the learned Trial Court did not act on the order
\n\tdated 30.4.2010 passed by the learned First Appellate Court. The
\n\treasons mentioned in para 2 of the report dated 8.9.2010 are not
\n\tsatisfactory and it comes out that only on the ground that the Xerox
\n\tcopy were available and certified copy was not available etc. the
\n\tTrial Court did not take necessary action. It is really surprising
\n\tthat on one had when the petitioners approached the learned Trial
\n\tCourt and surrendered themselves and also submitted on the record of
\n\tthe Court, the copy of the order passed by the learned First
\n\tAppellate Court and on subsequent occasion they submitted copy of
\n\tthe order passed by this Court and despite their readiness to
\n\tsurrender, the Trial Court on the ground of want of certified copy
\n\tdid not take steps as required in law, despite the order of the
\n\tlearned First Appellate Court’s order dated 30.7.2010.\n<\/p>\n
Therefore,
\n\tthe Registrar (Judicial) is requested to look into the matter and
\n\tsubmit his report.\n<\/p>\n
From
\n\tthe report of the learned Trial Court, it appears that after
\n\t6.9.2010 i.e. when the copies of the relevant orders became
\n\tavailable with the learned Trial Court, the petitioners have not
\n\tremained present before the Court.\n<\/p>\n
Mr.\n<\/p>\n
\tJani learned advocate for the petitioners has submitted that to
\n\testablish their bonafide, the petitioners would remain present
\n\tbefore the learned Trial Court tomorrow.\n<\/p>\n
In
\n\tview of the aforesaid statement, it is directed that the petitioners
\n\therein will remain present before the learned Trial Court tomorrow
\n\tand then the learned Trial Court will take necessary steps as may be
\n\trequired in law in view of the order dated 30.7.2010 passed by the
\n\tlearned First Appellate Court read with the order dated 19.4.2010
\n\tpassed by the learned Trial Court.\n<\/p>\n
The
\n\tRegistry shall inform this order to the learned Trial Court today
\n\titself by the fax and telephone.\n<\/p>\n

In
\n\tthe meanwhile, the Registrar (Judicial) would look into the matter
\n\tand place on record his views and the learned Trial Court also shall
\n\tforward its report about the action taken in pursuance of today’s
