Justice HARUN-UL-RASHID\n\n Dated :08\/07\/2010\n\n O R D E R\n                       HARUN-UL-RASHID, J.\n                        ------------------------\n                       F.A.O.No.163 Of 2010\n                         ----------------------\n                Dated this the 8th day of July, 2010.\n\n                           J U D G M E N T\n<\/pre>\n<p>     This appeal is directed against the order dated 27.3.2010 in<\/p>\n<p>I.A.No.1815 of 2009 in A.S.No.145 of 2009 on the file of the Sub<\/p>\n<p>Court, Kottarakkara.       The appellants are the appellants in<\/p>\n<p>A.S.No.145 of 2009.       They filed an application for temporary<\/p>\n<p>injunction restraining the respondents and men under them from<\/p>\n<p>constructing fence or boundary wall demarcating the properties<\/p>\n<p>of the petitioners and that of the respondents and also from<\/p>\n<p>causing obstruction to the petitioners&#8217; facility for ingress and<\/p>\n<p>egress to their properties from the Kayamkulam-Punalur public<\/p>\n<p>road by fitting gate or fixing any other blocks in between the said<\/p>\n<p>road and petition schedule item No.1 property.<\/p>\n<p>     2.     After hearing both sides the learned Sub Judge<\/p>\n<p>dismissed the I.A with an observation that whatever be the<\/p>\n<p>things done by the defendants in the place shall be at their risk<\/p>\n<p>and it will be subject to the result of the appeal.<\/p>\n<p>F.A.O.No.163 Of 2010<\/p>\n<p>                               ::2::\n<\/p>\n<p>      3.   When the matter was taken up for hearing, both sides<\/p>\n<p>submitted that a direction may be issued to hear and dispose of<\/p>\n<p>A.S.No.145 of 2009. Therefore, a direction is issued to the court<\/p>\n<p>below to hear and dispose of the appeal within a period of three<\/p>\n<p>months from the date of receipt of a copy of this judgment.<\/p>\n<p>Parties shall maintain status quo as on today till the disposal of<\/p>\n<p>the appeal.\n<\/p>\n<p>      The appeal is disposed of accordingly.
