With the consent of the learned Advocates<br \/>\n                     these Appeals are decided by this common order.\n<\/p>\n<p>                                  These two Appeals preferred under Clause<br \/>\n                     10 of the Letters Patent arise from the common judgment<br \/>\n                     and order dated 19th January 2011 passed by the learned<br \/>\n                     single Judge in Civil Review Nos. 10 of 2011 and 11 of<br \/>\n                     2011 and C.W.J.C. Nos. 13130 of 2009 and 17389 of<br \/>\n                     2010.\n<\/p>\n<p>                                  The appellant in both these appeals is Bhim<br \/>\n                     Rao Ambedkar College, Nawada. The appellant is<br \/>\n                     running an Intermediate School comprising standards XI<br \/>\n                     and XII since the year 1991. In the year 1999 or<br \/>\n                     thereabout    the    appellant   approached     the   Bihar<br \/>\n                     Intermediate Education Council (hereinafter referred to<br \/>\n                     as &#8220;the Council&#8221;) established under Section 3 of the<br \/>\n                     Bihar Intermediate Education Council Act, 1992<br \/>\n<span class=\"hidden_text\">                -3-<\/span><\/p>\n<p>(hereinafter referred to as &#8220;the Act of 1992&#8221;) for<br \/>\napproval\/recognition under the Act of 1992. As the said<br \/>\napplications were not processed the appellant approached<br \/>\nthis court in above C.W.J.C. No. 13130 of 2009 for<br \/>\ndirection to the Council to grant recognition to the<br \/>\nappellant.\n<\/p>\n<p>             By order dated 12th October 2009 made by<br \/>\nthis Court (Coram : Navin Sinha, J.) the appellant was<br \/>\ndirected to apply afresh in accordance with the required<br \/>\nstandards without paying fees afresh and the Council was<br \/>\ndirected to take a decision afresh within a maximum<br \/>\nperiod of six months. As the said direction was not<br \/>\ncarried out the appellant once again approached this<br \/>\nCourt in above C.W.J.C. No. 17389 of 2010. The<br \/>\nappellant also prayed for issuance of examination forms<br \/>\n(OMR forms) to its students. By order dated 23rd<br \/>\nNovember 2010 the learned single Judge directed; &#8220;&#8230;if<br \/>\nthe inspection has been carried out for purposes of<br \/>\nrecognition on 3.5.2010, as is contended on behalf of<br \/>\nthe petitioner, let the respondents take all necessary<br \/>\nsteps to conclude the issue of recognition preferably<br \/>\nwithin a maximum period of three months&#8230;..&#8221;. Since<br \/>\nthe aforesaid order the respondent Bihar School<br \/>\nExamination Board (hereinafter referred to as &#8220;the<br \/>\nBoard&#8221;) approached the learned single Judge in Civil<br \/>\nReview Nos. 10 of 2011 and 11 of 2011 for recall of the<br \/>\nabove referred orders dated 12th October 2009 and 23rd<br \/>\nNovember 2010.\n<\/p>\n<p>             According to the Board, in view of the<br \/>\nprevailing statutory position the exercise to accord<br \/>\n<span class=\"hidden_text\">               -4-<\/span><\/p>\n<p>recognition to the appellant cannot be undertaken by the<br \/>\nBoard. The learned single Judge has, by the impugned<br \/>\njudgment and order, considered the prevailing law and<br \/>\nallowed the review applications to recall the above<br \/>\nreferred orders dated 12th October 2009 and 23rd<br \/>\nNovember 2010 and has dismissed the writ petitions.<br \/>\nTherefore, the present appeals.\n<\/p>\n<p>            The facts stated above are not in dispute. The<br \/>\nonly question that arises for our consideration is whether<br \/>\nthe appellant has a right to recognition by the Board in<br \/>\nview of the prevalent statutory provisions.\n<\/p>\n<p>            The Act of 1992, inter alia, governs the<br \/>\nestablishment of the Intermediate School education<br \/>\n[standards XI and XII referred to as (+2)] imparted in the<br \/>\nState of Bihar. Section 3 of the Act of 1992 provides for<br \/>\nthe establishment of the Council known as &#8220;the Bihar<br \/>\nIntermediate Education Council&#8221;.\n<\/p>\n<p>            Section 2 (i) thereof defined &#8220;Intermediate<br \/>\nEducation&#8221; to mean &#8220;the education of (+2) standard<br \/>\nimparted according to the Intermediate syllabus in<br \/>\nthe subjects and up to the standard prescribed by the<br \/>\nState Government from time to time, and it includes<br \/>\n(+2) or the post 10th standard and the pre-degree<br \/>\n(three years) standard education of two years<br \/>\nduration imparted in secondary schools.&#8221;\n<\/p>\n<p>            Section 41 of the Act of 1992 envisaged<br \/>\nestablishment of the Intermediate Schools with prior<br \/>\napproval of the Council. Sub-Section (4) thereof<br \/>\ndebarred the intermediate schools not recognized by the<br \/>\nCouncil from sending-up students in the examination<br \/>\n<span class=\"hidden_text\">                -5-<\/span><\/p>\n<p>conducted by the Council. Sub-section (6) thereof<br \/>\nprovided for recognition of Intermediate School. Thus, it<br \/>\nis apparent that under the Act of 1992 no institution was<br \/>\npermitted to impart +2 education unless it had the prior<br \/>\napproval of the Council and it was recognized by the<br \/>\nCouncil. Indisputably, the appellant neither had prior<br \/>\napproval nor was it recognized under the Act of 1992. In<br \/>\nthe year 2007, the State Government enacted the Bihar<br \/>\nIntermediate Education Council (Repeal) Act, 2007 (Act<br \/>\n17 of 2007) (hereinafter referred to as &#8220;The Repeal<br \/>\nAct&#8221;). Under the Repeal Act, the Act of 1992 was<br \/>\nrepealed. However, under Section 7 of the Repeal Act<br \/>\nthe acts done or actions taken in exercise of powers<br \/>\nconferred by or under the Act of 1992 have been saved.\n<\/p>\n<p>             Simultaneously, the State of Bihar enacted<br \/>\nthe Bihar School Examination Board (Amendment) Act,<br \/>\n2007 (hereinafter referred to as &#8220;the Act of 2007&#8221;) to<br \/>\namend the Bihar School Examination Board Act, 1952.<br \/>\nBy the said amendment two definitions have been added<br \/>\nin the Act of 1952. The term &#8220;Secondary School&#8221; is<br \/>\ndefined to mean, &#8220;a school imparting education of<br \/>\ncourses up to grade 10 as prescribed by the Board&#8221;<br \/>\nand the term &#8220;Senior Secondary School&#8221; is defined to<br \/>\nmean, &#8220;a school imparting education of courses up to<br \/>\ngrade 12 as prescribed by the Board, and includes<br \/>\ninstitutions of Intermediate (+2) Education, duly<br \/>\nrecognized     under   Section    39   of   the   Bihar<br \/>\nIntermediate Education Council Act, 1992&#8221;.\n<\/p>\n<p>             A conjoint reading of the Act of 1992 and<br \/>\nthe Act of 2007 discloses the legislative intention to<br \/>\n<span class=\"hidden_text\">                -6-<\/span><\/p>\n<p>recognize only those institutions which impart education<br \/>\nfrom the grades 1 to 10 or from the grades 1 to 12. In<br \/>\nother words, the legislative intention is not to allow the<br \/>\ninstitutions to impart (+2) education alone i.e. only<br \/>\nstandards XI and XII, unless such institution was already<br \/>\nrecognized under the Act of 1992.\n<\/p>\n<p>            It is an admitted fact that the appellant did<br \/>\nnot receive recognition under the Act of 1992 until it was<br \/>\nrepealed in the year 2007 by the Repeal Act. It is also not<br \/>\nin dispute that the appellant imparts (+2) education i.e.<br \/>\nstandards XI and XII alone and it does not impart<br \/>\neducation from standards 1 to 10. The appellant is,<br \/>\ntherefore, not a &#8220;Senior Secondary School&#8221; within the<br \/>\nmeaning of the Act of 1952 as amended by the Act of<br \/>\n2007. Consequently, the appellant is neither recognized<br \/>\nunder the Act of 1992 nor can it be recognized under the<br \/>\nAct of 1952.\n<\/p>\n<p>            These statutory provisions were not brought<br \/>\nto the notice of the learned single Judge earlier when the<br \/>\nabove referred orders were made on 12th October 2009<br \/>\nand 23rd November 2010. In view of the aforesaid<br \/>\nstatutory position the learned single Judge has recalled<br \/>\nthe earlier orders made on 12th October 2009 and 23rd<br \/>\nNovember 2010 and has dismissed the writ petitions.\n<\/p>\n<p>            Learned Counsel Mr. Y.V. Giri has appeared<br \/>\nfor the appellant. He has emphatically relied upon<br \/>\nSection 7 of the Repeal Act. He has submitted that<br \/>\nanything done or any action taken under the Act of 1992<br \/>\nhas been saved by the aforesaid Section 7 of the Repeal<br \/>\nAct. In that view of the matter, the appellant having<br \/>\n<span class=\"hidden_text\">                         -7-<\/span><\/p>\n<p>          made application for recognition and having paid fees for<br \/>\n          inspection; the inspection having been carried out on 3rd<br \/>\n          May 2010 by the Sub Divisional Officer, Nawada, the<br \/>\n          action under the Act of 1992 has been taken; it must be<br \/>\n          held to have been saved as aforesaid.\n<\/p>\n<p>                      We are afraid, we are unable to agree with<br \/>\n          Mr. Giri. Anything done or action taken under the Act of<br \/>\n          1992 should necessarily mean an action taken or an act<br \/>\n          done by an officer empowered to take such action or to<br \/>\n          do such act under the provisions of the Act of 1992. We<br \/>\n          do not need elaborate discussion to hold that mere<br \/>\n          making an application for recognition under the Act of<br \/>\n          1992 or payment of inspection fee would not enjoin the<br \/>\n          authority to continue to operate the Act of 1992 to accord<br \/>\n          recognition to the appellant. The inspection carried out<br \/>\n          by the Sub Divisional Officer on 3rd May 2010, long<br \/>\n          after the repeal of the Act of 1992, is of no consequence.\n<\/p>\n<p>                      In our view, the learned single Judge has<br \/>\n          rightly considered the statutory provisions to recall the<br \/>\n          earlier orders made on 12th October 2009 and 23rd<br \/>\n          November 2010 and to dismiss the writ petitions.\n<\/p>\n<p>                      No case for interference is made out. The<br \/>\n          Appeals are dismissed in limine.\n<\/p>\n<p>                      Interlocutory Applications stand disposed of.\n<\/p>\n<p>                              (R.M.
