1.\tThis
\nApplication has been preferred with the following prayers :\n<\/p>\n
 9.\tThe
\npetitioner, therefore, humbly prays that;\n<\/p>\n
(A)\tYOUR LORDSHIPS may kindly
\nbe pleased to admit and allow the present application.\n<\/p>\n
(B)\tYOUR LORDSHIPS may kindly
\nbe pleased  to direct the Official Liquidator to make payment of
\nRupees 21,087\/- to the present applicant  immediately before this
\nHonourable Court itself.\n<\/p>\n
(C)YOUR LORDSHIPS may kindly
\nbe pleased to take suitable actions against the Office of Official
\nLiquidator for not complying the order of this Honourable Court dated
\n15.09.2009.\n<\/p>\n
(D)\tYOUR LORDSHIPS may be
\npleased to grant such other and further relief(s) as may deed just
\nand proper in the facts and circumstances of the case .\n<\/p>\n
2.\tHeard
\nlearned Advocate for the Applicant. Attention is invited to paragraph
\nNo.7 of order dated 15.9.2009 made in Company Application No. 314 of
\n2007 between the same parties. It is submitted that despite the
\nperiod of two weeks stipulated by the Court having ended as no
\npayment was received on 2.11.2009  notice was issued by the learned
\nAdvocate  calling upon the Official Liquidator to comply with the
\norder made by the Court despite which as there was no compliance, the
\nApplicant workman has been constrained to approach this Court by way
\nof this Application.\n<\/p>\n
3.\tLearned
\nAdvocate appearing for Official Liquidator on advance copy states,
\nunder instructions, that a lapse has occurred in the Office of the
\nOfficial Liquidator for which necessary steps have been initiated to
\nconduct an inquiry and fix the responsibility as to the person who
\nhas committed the lapse. Learned Advocate further states that cheque
\nfor a sum of Rs.21,087\/- drawn on Punjab National Bank, Ashram Road
\nBranch being No. 498712 dated 3.2.2010  is ready and the learned
\nAdvocate representing the Official Liquidator is ready to  tender the
\nsame.\n<\/p>\n
4.\tLearned
\n Advocate for the Applicant states that the Applicant is personally
\npresent in the Court. Hence, learned Advocate for the Applicant is
\ndirected to collect the payment from the learned Advocate of the
\nrespondent and hand over to the Applicant.\n<\/p>\n
5.\tAt
\nthis stage, the applicant, who is personally present in the Court,
\nexpressed his unwillingness to accept the cheque and hence the
\nOfficial Liquidator is
\ndirected to send the said cheque by Regd. Post A.D. at the last known
\naddress of the applicant.\n<\/p>\n
6.\tAt
\nthe request of learned advocate for the applicant, the matter was
\nkept back in the second session. When the matter is called out Shri
\nK.I. Kazi, learned advocate appears on behalf of Mr.A.A. Ansari and
\nstates that Mr.Ansari is not willing to represent the applicant. The
\nCourt does not permit Mr.Ansari to withdraw his appearance without
\ncomplying with the relevant Rules of this High Court in this regard.\n<\/p>\n
7.\tAs
\norally directed at the time of hearing Official
\nLiquidator shall compute the interest @ 10% p.a. for the
\nperiod commencing from 01.10.2009 and ending on 31.01.2010 on the
\naforesaid amount of Rs.21,087\/- and send a separate cheque for the
\nsame under Regd. Post A.D. to the applicant at the last known
\naddress. It will be open to the Official Liquidator to recover the
\nsaid amount of interest from the person who is ultimately found
\nliable for the lapse, due to which the liquidator has been required
\nto pay interest for non-compliance of order made by this Court on
\n15.09.2009.\n<\/p>\n
8.\tIn
\nrelation to the second aspect as to additional amount, if any, which
\nmay be due to the Applicant suffice it to state that same shall be
\ndetermined after receipt of verification report from the Chartered
\nAccountant as directed by the Court in its order dated 15.09.2009. It
\nwill be open to the Applicant to move the Court in this regard by way
\nof an independent application, in the event the Applicant desires to
\nchallenge the report of the Chartered Accountant.\n<\/p>\n
9.\tCompany
\nApplication stands disposed of accordingly.\n<\/p>\n
