(1) 524\n JT 1993  Supl.\t   171\t  1993 SCALE  (4)553\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nK.JAYACHANDRA REDDY, J.- These three appeals are filed by<br \/>\nthe  original  accused 1 and 3 against the judgment  of\t the<br \/>\nPunjab &amp; Haryana High Court.  The two appellants along\twith<br \/>\nBawa  Singh  and  Bir  Singh,  original\t accused  2  and   4<br \/>\nrespectively  were  tried  for\toffences  punishable   under<br \/>\nSections  302  and 307\/34 IPC for causing the death  of\t one<br \/>\nGulab  Singh and for attempting to commit the murder of\t the<br \/>\nwitnesses.   The  trial court convicted the  two  appellants<br \/>\nunder  Sections\t 302\/34 IPC and sentenced each\tof  them  to<br \/>\nundergo\t imprisonment for life and to pay a fine of Rs\t1000<br \/>\nin  default of payment of which to undergo six\tmonths&#8217;\t RI.<br \/>\nThe  two  appellants were also\tseparately  convicted  under<br \/>\nSection\t 25  of the Arms Act and sentenced  to\tundergo\t one<br \/>\nyear&#8217;s\tRI.   Questioning  those  convictions  the   accused<br \/>\npreferred three appeals to the High Court and all the  three<br \/>\nappeals were dismissed.\t Hence the present appeals.\n<\/p>\n<p>2.  The prosecution case is as follows: The  deceased  Gulab<br \/>\nSingh  and  the\t material  witnesses  including\t the   three<br \/>\neyewitnesses  PWs 4, 5 and 6 belong to Village Mehma  Sarja.<br \/>\nPW  4 is the son of the deceased.  There was enmity  between<br \/>\nthe  deceased  and his family members and the  accused.\t  On<br \/>\nDiwali<br \/>\n<span class=\"hidden_text\">526<\/span><br \/>\nprevious  to the present occurrence one Beant Singh  brother<br \/>\nof Gurdev Singh, the second appellant was murdered.  Lakhbir<br \/>\nSingh,\tthe  first  appellant lodged a\treport\tagainst\t the<br \/>\ndeceased for the said murder.  The police during the enquiry<br \/>\nfound Gulab Singh to be innocent and instead of Gulab Singh,<br \/>\nappellant  1 and his brother and some others were  challaned<br \/>\nand the case was still pending.\t On September 12, 1981 Gulab<br \/>\nSingh,\tthe deceased had gone for purchasing medicines\tfrom<br \/>\nGoniana\t Mandi\tas he was not feeling well.  PW\t 4,  son  of<br \/>\ndeceased   also\t came  to  Goniana  Mandi   for\t  purchasing<br \/>\ninsecticides  and also to procure money from the  Commission<br \/>\nAgent.\t At about 6 p.m. the deceased was standing near\t the<br \/>\nrailway\t crossing  for going to his village.  PW 4  met\t the<br \/>\ndeceased when he talking to Jarnail Singh, PW 5 and  Gulzara<br \/>\nSingh,\tPW 6 who belonged to their village.  PWs 4, 5 and  6<br \/>\nwent  near the hand pump for drinking water which was  at  a<br \/>\ndistance  of about 10 karmas from the pitter (sic)  jeep  in<br \/>\nwhich  the deceased was sitting on the front seat.   Lakhbir<br \/>\nSingh,\tA-  1  came there from the  side  of  Gurduwara\t and<br \/>\nentered the jeep from behind along with other accused.\t Bir<br \/>\nSingh,\tthe  acquitted accused is alleged to have  raised  a<br \/>\nlalkara.  Hearing the same PWs 4, 5 and 6 looked towards the<br \/>\njeep and found A- 1 taking out a 12 bore country-made pistol<br \/>\nand  firing at the back of the deceased.  Gurdev Singh,\t A-3<br \/>\nwas also armed with a 12 bore country-made pistol.  He fired<br \/>\na shot simultaneously which hit the deceased on the head  on<br \/>\nthe right side.\t All the witnesses ran towards the jeep\t and<br \/>\nraised\tcries and it is alleged that the  acquitted  accused<br \/>\nBawa Singh fired a shot with his 12 bore country-made pistol<br \/>\nbut  the same did not hit anybody.  When the  witnesses\t saw<br \/>\nthe  accused  reloading the pistols they ran  away  and\t the<br \/>\naccused\t left  the  place.  PWs 4, 5 and  6  went  near\t the<br \/>\ndeceased  and found him dead on the front seat of the  jeep.<br \/>\nLeaving PW 5 at the place of occurrence, PWs 4 and 6 went to<br \/>\nthe  police  station which was nearby and  lodged  a  report<br \/>\nwhich  was  recorded  by  SI  Gurnam  Singh.   A  case\t was<br \/>\nregistered  and\t the  Sub-Inspector  reached  the  place  of<br \/>\noccurrence   and  got  the  photographs\t of  the  scene\t  of<br \/>\noccurrence taken.  He also recovered three empty  cartridges<br \/>\nfrom the scene of occurrence.  After holding the inquest  he<br \/>\nsent  the dead body for postmortem.  The Doctor, PW  1,\t who<br \/>\nconducted the postmortem, found four gunshot injuries and on<br \/>\ninternal  examination  he  found that  the  right  lung\t was<br \/>\ninjured\t and  he  opined  that injury Nos.   1\tand  2\twere<br \/>\nindividually  sufficient  to  cause death  in  the  ordinary<br \/>\ncourse\tof  nature  and that the  injuries  were  caused  by<br \/>\nfirearms.\n<\/p>\n<p>3.Immediately after the occurrence, the police went after<br \/>\nthe accused.  They saw three persons running.  Gurdev Singh,<br \/>\nthe  second  appellant was caught by ASI Gian Chand  and  he<br \/>\nrecovered  a  pistol  from  him.   The\tother  accused\twere<br \/>\narrested  later.   The\tprosecution  mainly  relied  on\t the<br \/>\nevidence  of  the eyewitnesses PWs 4, 5 and 6.\tThe  accused<br \/>\nwhen examined under Section 313 CrPC denied the offence\t and<br \/>\nstated\tthat they have been falsely implicated.\t  The  trial<br \/>\nJudge as well as the High Court accepted the evidence of PWs<br \/>\n4, 5 and 6 as against the two appellants who are alleged  to<br \/>\nhave shot at the deceased and accordingly convicted them  as<br \/>\nstated above.\n<\/p>\n<p>4.Shri\tKohli, learned senior counsel appearing\t for  the<br \/>\nappellants  submitted  that  PWs  4,  5\t and  6\t are  chance<br \/>\nwitnesses and also highly interested and the failure on\t the<br \/>\npart   of  the\tprosecution  to\t examine  some\t independent<br \/>\nwitnesses  who\twould  have been present  at  the  scene  of<br \/>\noccurrence,  is fatal to the prosecution case.\tHis  further<br \/>\nsubmission is that the ballastic expert&#8217;s evidence<br \/>\n<span class=\"hidden_text\">527<\/span><br \/>\nwould show that the empty cartridges recovered at the  scene<br \/>\nof  occurrence\twould not have been fired from\tthe  weapons<br \/>\nseized.\t  He  also  submitted that in view  of\tthe  medical<br \/>\nevidence the prosecution version that the accused shot\tfrom<br \/>\nbehind at the close range is belied.\n<\/p>\n<p>5.PW  4,  the  principal eyewitness is\tthe  son  of  the<br \/>\ndeceased.   Immediately after the occurrence within a  short<br \/>\nwhile he lodged the FIR.  In the said report all the details<br \/>\nof  the occurrence are given.  It is clearly mentioned\tthat<br \/>\nthe  two appellants shot at the deceased who was sitting  in<br \/>\nthe  jeep.  He also mentioned the names of PWs 5 and 6,\t the<br \/>\nother  two  eyewitnesses.   If PW 4 had\t not  witnessed\t the<br \/>\noccurrence, he would not have given a correct version of the<br \/>\noccurrence  within such a short time.  A perusal of the\t FIR<br \/>\nwould  show  that  it  could have  been\t given\tonly  by  an<br \/>\neyewitness.   The criticism that PWs 4, 5 and 6\t are  chance<br \/>\nwitnesses  has\tno force.  All the three  eyewitnesses\thave<br \/>\ngiven reasons as to why they came to Goniana Mandi.  It is a<br \/>\nmatter\tof common knowledge that the villagers do come to  a<br \/>\ntown  and since they belonged to the same village they\talso<br \/>\nmoved  together.   PW  4 knew that his father  had  gone  to<br \/>\nGoniana\t Mandi\tand he also came later and met\this  father.<br \/>\nThere is nothing unnatural about it.  Therefore it cannot be<br \/>\nsaid that the eyewitnesses are chance witnesses.\n<\/p>\n<p>6.The  next criticism is that the prosecution has  failed<br \/>\nto  examine independent witnesses.  Sometimes even  assuming<br \/>\nthat  some people there had witnessed the  occurrence,\tthey<br \/>\nmight  not have come forward to speak about the\t occurrence.<br \/>\nFurther\t the  occurrence has taken place  suddenly  and\t the<br \/>\npeople\tin the nearby shops might not have seen\t the  actual<br \/>\nattack and further they could not have known the  assailants<br \/>\nsince they belonged to a different place.  The facts in\t the<br \/>\ncase  would show that this was a preplanned murder.  At\t any<br \/>\nrate  when  the evidence of PWs 4, 5 and 6 is  found  to  be<br \/>\ncreditworthy,\tnon-examination\t of  some  persons  in\t the<br \/>\nvicinity does not affect the prosecution case.\n<\/p>\n<p>7. PWs 4, 5 and 6 have been cross-examined at length. Except<br \/>\neliciting  some omissions in respect of minor  details\tthey<br \/>\nhave not been shaken. So far as the medical evidence and the<br \/>\nexpert evidence in respect of nature of the weapons used and<br \/>\nthe distance from which the shots were fired, are concerned,<br \/>\nwe  do\tnot  come  across  any\tserious\t infirmity  in\t the<br \/>\nprosecution  case.  The\t Doctor,  PW  1\t who  conducted\t the<br \/>\npostmortem,  has  stated  that the  injuries  found  on\t the<br \/>\ndeceased  must have been caused by firearms. As a matter  of<br \/>\nfact some pellets also were removed from the body. Therefore<br \/>\nthere  cannot be any doubt that the firearms were  used.  He<br \/>\nwas  cross-examined but he asserted that the  distance\tfrom<br \/>\nwhere the pellets were recovered from the entrance wound  on<br \/>\nthe  head may be more than 6&#8243; and that injury Nos. 1  and  2<br \/>\nwere  caused  from  a  very close range.  In  view  of\tthis<br \/>\npositive  evidence even if some of the recovered weapons  as<br \/>\nper  the  ballistic expert&#8217;s evidence could  not  have\tbeen<br \/>\nused,  that  by\t itself\t is not\t a  serious  infirmity.\t The<br \/>\neyewitnesses  have  categorically stated  that\tcountry-made<br \/>\npistols\t were used and the medical evidence shows  that\t the<br \/>\ndeath  was due to injuries caused by firearms.\tThis  aspect<br \/>\nhas  been considered by the Sessions Court in detail-and  it<br \/>\nhas  been  rightly observed that the shots have\t been  fired<br \/>\nfrom  country-made pistols. There was every  possibility  of<br \/>\nthe holes caused being slightly bigger than muzzle. We\thave<br \/>\ncarefully gone through the evidence of the eyewitnesses\t and<br \/>\nreasons given by the two courts for believing their<br \/>\n<span class=\"hidden_text\">528<\/span><br \/>\nevidence.   We\tsee  absolutely\t no grounds  to\t come  to  a<br \/>\ndifferent   conclusion.\t   Accordingly,\t the   appeals\t are<br \/>\ndismissed.\n<\/p>\n<p><span class=\"hidden_text\">529<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Lakhbir Singh vs State Of Punjab on 26 November, 1993 Equivalent citations: 1994 AIR 1029, 1994 SCC Supl.
