Justice M.SASIDHARAN NAMBIAR\n\n Dated :15\/09\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n            CRL.M.C.NO.3806 OF 2010\n           ---------------------------------------------\n           Dated 15th          September, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>          Petitioners are the accused and<\/p>\n<p>second respondent, the de facto complainant<\/p>\n<p>in  crime  No.77\/2010               of       Edacheri      police<\/p>\n<p>Station registered for the offences under<\/p>\n<p>Sections 498A and 406 read with Section 34<\/p>\n<p>of Indian Penal Code on Annexure-A FIR<\/p>\n<p>based  on   Annexure-A5                 complaint           filed<\/p>\n<p>before Judicial First Class Magistrate&#8217;s<\/p>\n<p>Court, Vadakara and sent for investigation<\/p>\n<p>under Section 156(3) of Code of Criminal<\/p>\n<p>Procedure. Petition is filed under Section<\/p>\n<p>482 of Code of Criminal Procedure                        to quash<\/p>\n<p>the  proceedings           contending                that  entire<\/p>\n<p>matrimonial       disputes                        between     the<\/p>\n<p>petitioners and second                       respondent were<\/p>\n<p>Crmc 3806\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>settled       amicably   and   consequent  to   the<\/p>\n<p>settlement second respondent has no grievance<\/p>\n<p>against the petitioners and therefore, entire<\/p>\n<p>proceedings is to be quashed.\n<\/p>\n<p>            2. Second respondent appeared through a<\/p>\n<p>counsel and filed an affidavit stating that<\/p>\n<p>after registration of the case on the complaint<\/p>\n<p>filed       by   the   second   respondent,  entire<\/p>\n<p>matrimonial disputes were settled amicably and<\/p>\n<p>consequent to the settlement second respondent<\/p>\n<p>has no objection for quashing the proceedings.<\/p>\n<p>            3.   Learned  counsel appearing for the<\/p>\n<p>petitioners,      second  respondent   and  learned<\/p>\n<p>Public Prosecutor      were heard.<\/p>\n<p>            4. Affidavit   filed   by   the  second<\/p>\n<p>respondent establishes that      entire matrimonial<\/p>\n<p>disputes      were  settled  amicably  due  to  the<\/p>\n<p>intervention      of  mediators  subsequent to  the<\/p>\n<p>Crmc 3806\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>registration of the case. As held by the Apex<\/p>\n<p>Court in B.S.Joshi        and others   v. State of<\/p>\n<p>Haryana and another (2003(4) SCC 675)          when<\/p>\n<p>matrimonial disputes       are settled amicably, it<\/p>\n<p>is not in the interest of justice       to stand on<\/p>\n<p>technicalities and continue the prosecution.<\/p>\n<p>            Petition is allowed.
