SUMAN KUMAR MISHRA, SON OF SHRI LAL BAHADUR\n               MISHRA, RESIDENT OF VILLAGE MALA, POLICE\n               STATION CHAPRA (M), DISTRICT SARAN AT CHAPRA\n                                    ********\n<\/pre>\n<p>2   05\/08\/2011               This application has been filed challenging<\/p>\n<p>                 the order dated 04.12.2007 passed in Chapra (T) Police<\/p>\n<p>                 Station Case No. 128 of 1996 (Trial No. 3180 of 2007)<\/p>\n<p>                 by which the Sub Divisional Judicial Magistrate, Saran<\/p>\n<p>                 at Chapra has dismissed the discharge application filed<\/p>\n<p>                 on behalf of the petitioner.\n<\/p>\n<p>                             On perusal of the impugned order, it<\/p>\n<p>                 appears that charges were to be framed on 17.01.2008,<\/p>\n<p>                 and as such, this Court presumes that the charge have<\/p>\n<p>                 been framed by now.\n<\/p>\n<p>                             In any event, it appears that the Court below<\/p>\n<p>                 has referred to the fact that after investigation by the<\/p>\n<p>                 Central Bureau of Investigation, the case was found to<\/p>\n<p>                 be prima facie true against the petitioner under various<\/p>\n<p>                 sections of the Indian Penal Code.\n<\/p>\n<p>                             Considering the facts that the Court below<\/p>\n<p>                 has found sufficient materials in the case diary against<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        the petitioner to proceed with the case, I see no reason<\/p>\n<p>        to differ with the order impugned.\n<\/p>\n<p>                   This application is accordingly dismissed.<\/p>\n<pre>Anand                                        (Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
