PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Ms. Mini Nair, learned APP, waives service of rule for the<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tThe present<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder sec. 439 of the Code of Criminal Procedure.\n<\/p>\n<p>3.\tThe applicant-accused<br \/>\nis charged with having committed offence under section 409 of IPC for<br \/>\nwhich FIR, being C.R. No. I-40\/2010, has been registered with<br \/>\nIchchhapore Police Station, Surat.\n<\/p>\n<p>4.\tLearned advocate Mr.<br \/>\nPande referred to the Fir and submitted that FIR has been filed after<br \/>\ntwo years and he is accused of temporary embezzlement of an amount of<br \/>\nRs. 14,000\/- which is again deposited. He therefore submitted that<br \/>\nconsidering the nature of offence, the present application may be<br \/>\nallowed.\n<\/p>\n<p>5.\tLearned APP Ms. Nair<br \/>\nresisted the application.\n<\/p>\n<p>6.\tHaving<br \/>\nheard learned advocate Mr. Pande and learned APP Ms. Nair and having<br \/>\nconsidered  the nature of offence, the manner in which it is<br \/>\ncommitted, the role attributed and also considering the guidelines<br \/>\nwith regard to grant of bail,  the present application deserves to be<br \/>\nallowed.\n<\/p>\n<p>7.\tThe application is<br \/>\naccordingly allowed.  The applicant  is ordered to be released on<br \/>\nbail in connection with C.R. No. I-40\/2010 registered with<br \/>\nIchchhapore Police Station, Surat  on his executing a personal bond<br \/>\nof Rs. 5,000\/- (Rupees Five Thousand only) with one solvent surety<br \/>\nfor the like amount to the satisfaction of the lower court and<br \/>\nsubject to the further conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the charge sheet is<br \/>\nfiled.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
