Justice M.N.KRISHNAN\n\n Dated :23\/10\/2009\n\n O R D E R\n                      M.N.KRISHNAN, J.\n                  ...........................................\n                  M.A.C.A.NO.1155 OF 2009\n                  .............................................\n           Dated this the 23rd day of October, 2009\n\n                          J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Kozhikode in OP(MV)No.873\/2004. The<\/p>\n<p>claimant, a 25 year old lady, sustained fracture in a road<\/p>\n<p>accident and one of her tooth was avulsed and there was a<\/p>\n<p>fracture of one of the incisor. The Tribunal awarded her a<\/p>\n<p>global compensation of Rs.8,000\/= and exonerated the<\/p>\n<p>insurance company from the liability and it is against that<\/p>\n<p>decision, the claimant has come up in appeal.<\/p>\n<p>     2. Heard the learned counsel for both sides.                    Let me<\/p>\n<p>first consider about the quantum. The learned counsel had<\/p>\n<p>brought to my notice that Ext.A3 series medical bills<\/p>\n<p>represented a sum of more than Rs.3,000\/= for medical<\/p>\n<p>expenses. It has to be accepted for the reason that even the<\/p>\n<p>Tribunal refers to the scan report and the medical bills.<\/p>\n<p>Avulsion of   tooth means displacement of tooth                     from its<\/p>\n<p>original position which means it required                        correctional<\/p>\n<p>procedure. The repair of the tooth is an expensive treatment<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.NO.1155 OF 2009<\/p>\n<p>which one has to undergo. When a 25 old lady sustains<\/p>\n<p>such injuries, certainly there will be a lot of difficulties for<\/p>\n<p>her physically and mentally and therefore taking note of<\/p>\n<p>the entire     situation, I   am inclined to     increase the<\/p>\n<p>compensation by 6,000\/=.\n<\/p>\n<p>      3. The next     important    question is regarding    the<\/p>\n<p>liability of the insurance  company.     The Tribunal repelled<\/p>\n<p>the    claim of the   applicant on the ground that      there is<\/p>\n<p>nothing to prove the payment of the additional premium. It<\/p>\n<p>is true that in <a href=\"\/doc\/423517\/\">United India Insurance Co.Ltd. v. Tilak<\/p>\n<p>Singh<\/a> (2006 (2) KLT SC) the court was considering the<\/p>\n<p>question of an act only policy and said that status of a<\/p>\n<p>pillion rider being that of gratuitous passenger, he will not<\/p>\n<p>be covered by an act only policy. A Full bench of this Court<\/p>\n<p>in one of the decisions held that in comprehensive policies if<\/p>\n<p>one has to go by the premium unless additional premium is<\/p>\n<p>paid for the coverage one will not be liable. Now there a<\/p>\n<p>situation has also arisen, that is by virtue of the terms<\/p>\n<p>and    conditions of the insurance contract,    the insurance<\/p>\n<p>company undertakes to indemnify the owner.           The terms<\/p>\n<p><span class=\"hidden_text\">                              : 3 :<\/span><br \/>\nM.A.C.A.NO.1155 OF 2009<\/p>\n<p>and conditions of the policy has been produced before this<\/p>\n<p>Court and it reads as follows:\n<\/p>\n<pre>             \"Death of or bodily injury       to  any\n       person including occupants      carried in the\n<\/pre>\n<p>       vehicle (provided such occupants are not<br \/>\n       carried for hire or reward) but except so far<br \/>\n       as it is necessary to meet the requirements of<br \/>\n       the Motor Vehicles Act.&#8221;\n<\/p>\n<p>  4. A Division Bench in the decision reported in New India<\/p>\n<p>Assurance Co.Ltd. Hydrose (2008 (3) KLT 778) considered<\/p>\n<p>the clause     and held that by virtue of the terms and<\/p>\n<p>conditions, the insurance company is bound to indemnify.<\/p>\n<p>Later, the Division Bench in the decision reported in <a href=\"\/doc\/1457758\/\">Mathew<\/p>\n<p>v. Shaji Mathew<\/a> (2009 (3) KLT 813)            considered the<\/p>\n<p>wordings &#8216;except so far as it is relate&#8217; and held that just<\/p>\n<p>because of the word except is used the benefit which is<\/p>\n<p>conferred cannot be taken away and the benefit given under<\/p>\n<p>the Hydrose&#8217;s case has to be extended in such cases as<\/p>\n<p>well.     So, in the light of these       two    authoritative<\/p>\n<p>pronouncements     it has    to be held that   the insurance<\/p>\n<p>company is bound to indemnify the owner.            Therefore,<\/p>\n<p>MACA is disposed of as follows:\n<\/p>\n<p>     1. The claimant is awarded an additional compensation<\/p>\n<p><span class=\"hidden_text\">                                : 4 :<\/span><br \/>\nM.A.C.A.NO.1155 OF 2009<\/p>\n<p>of Rs.6,000\/= with 7.5% interest on the said sum from the<\/p>\n<p>date of the petition till realisation and the respondent<\/p>\n<p>insurance company is directed to pay the amount.<\/p>\n<p>      2. The order exonerating the insurance company from<\/p>\n<p>the liability is set aside and the insurance company is bound<\/p>\n<p>to pay the entire amount awarded both under this judgment<\/p>\n<p>as well as the earlier award to the claimant and such<\/p>\n<p>amount shall be deposited within a period of 60 days from<\/p>\n<p>the date of receipt of a copy of this judgment.
