Nanavati with Ms. Anuja Nanavati for<br \/>\nthe petitioner.\n<\/p>\n<p>2.\tLearned<br \/>\nAssistant Government Pleader Ms. Manisha Narsinghani  files affidavit<br \/>\nof one Shri A.P. Rayiada, Office Superintendent of  D.G. and I.G.P.<br \/>\nThe contentions raised by the petitioner are replied by the deponent<br \/>\nin para Nos. 5,6, and 7, which read as under:-\n<\/p>\n<p>&#8220;5.\tI<br \/>\nrespectfully say that only two persons namely Shri RA Patel<br \/>\n(appointed on 22.07.75) as Unarmed PSI now retired) ad Shri<br \/>\nHargovanbhai Desai (appointed on 1.06.94 Armed PSI)  were appointed<br \/>\nas PSI though they were not having the prescribed qualification as<br \/>\nmentioned in The Police Sub Inspector (Unarmed Branch, Class III)<br \/>\nRecruitment Rules, 2003 and The Police Sub Inspector Armed Branch. It<br \/>\nis further submitted Additional Director General of Police (Armed<br \/>\nUnit, Gandhinagar) vide letter dated 17.09.2010 addressed to Police<br \/>\nCommissioner, Ahmedabad has directed the Police Commissioner to<br \/>\ninquire in the case of Shri Hargovanbhai Desai and submit the report.<br \/>\nThe copy of the said letter is annexed hereto and marked as Annexure<br \/>\n&#8216;R-I&#8217;.\n<\/p>\n<p>6.\tI<br \/>\nrespectfully say that as per the said rules one should have passed<br \/>\nStandard XII. It is further submitted that it is prescribed under the<br \/>\nsaid rules that preference may be given to the candidate who possess<br \/>\nN.C.C. &#8220;C&#8221; Certificate Examination.\n<\/p>\n<p>7.\tI<br \/>\nrespectfully say that petitioner is not having the said prescribed<br \/>\nqualification under the rules. It is further submitted even if in<br \/>\nsome cases appointments have been made by mistake or  wrongly that<br \/>\ndoes not confer any right on another person.
