The writ petition has been filed seeking<br \/>\ndirections against the respondents to withdraw the<br \/>\nelectricity bill in respect of the meter bearing K<br \/>\nNo. 79742775. It is stated in the petition that the<br \/>\npetitioner is residing at S-93, WZ-221, Ground Floor,<br \/>\nVishnu Garden, New Delhi where the electricity meter<br \/>\nwas installed. On 15.6.92 a notice was served on t he<br \/>\npetitioner to show cause in view of the fact that the<br \/>\ntampering of the glass of the meter was found on<br \/>\ninspection. An FIR was also lodged on 17.6.1992 for<br \/>\ntheft of electricity and the meter was removed. It is<br \/>\nstated in the petition that the petitioner was<br \/>\ndischarged on 18.7.1996 from the criminal case though<br \/>\nthe copies of the orders have not been annexed to the<br \/>\nwrit petition. It is further stated that though the<br \/>\nmeter was removed yet the electricity bills are still<br \/>\nbeing sent and a bill of Rs. 34,32,232\/- has been sent<br \/>\neven though the sanctioned load is of 0.25 KW. Since<br \/>\nno response was forthcoming form the respondent, the<br \/>\nwrit petition has been filed.\n<\/p>\n<p>2. In the counter affidavit it is stated that the<br \/>\naction was taken by the respondent in view of<br \/>\ninspection report dated 29.4.1992. The petitioner<br \/>\nfiled suit bearing No. 786\/92 in October, 1992 and the<br \/>\ntrial court was pleased to pass an order for<br \/>\nrestoration of electricity and accordingly the<br \/>\nelectricity was restored. The petitioner, however,<br \/>\nfailed to make the payment even after the reconnection<br \/>\nof electricity. The suit was subsequently dismissed<br \/>\nfor non-prosecution and the electricity was again<br \/>\ndisconnected. All these facts have not been disclosed<br \/>\nin the writ petition.\n<\/p>\n<p>3. It is stated in the counter affidavit that in<br \/>\npursuance to the inspection report dated 29.4.1992 a<br \/>\ncase of theft was made out along with load violation<br \/>\nand a bill of Rs. 8,77,296.29 was raised in the month of<br \/>\nSeptember, 1992. This  bill was raised as per the<br \/>\ntariff provisions prevalent at that time in terms<br \/>\nwhereof the bill had to be raised for a period of 3<br \/>\nyears preceding from the date of inspection. The<br \/>\nelectricity had been restored on 14.10.92 in pursuance<br \/>\nto the orders of the Civil Judge for domestic purposes<br \/>\nor a load of 0.25 KW and supply again was disconnected<br \/>\non 14.7.1994. The bill is stated to have been raised<br \/>\non the following basis after approval from the<br \/>\ncompetent authority:-\n<\/p>\n<p> i) The petitioner has been charged on load basis<br \/>\nfrom 11th March, 1992 to 17th June, 1992 i.e., the date<br \/>\nof the removal of the meter and lodging of the FIR.\n<\/p>\n<p>ii) From 14th October, 1992 to 14th July, 1994,<br \/>\nthe petitioner has been charged on domestic tariff on<br \/>\nthe load of 0.5 KW and six months M.G. have been<br \/>\ncharged after the disconnection of the supply and meter<br \/>\nrent up to date;\n<\/p>\n<p>iii) The petitioner has also been charged LPSC<br \/>\nof Rs. 9368.10 paise on F.A.E. bill plus 3% LPSC from<br \/>\nOctober, 1993 to March, 1999 per month plus 1-1\/2 LPSC<br \/>\nper month from April, 1998 till date for an amount of<br \/>\nRs. 8,77,296.29.\n<\/p>\n<p>4. It is also stated in the counter affidavit that<br \/>\nthe provisional demand had been subsequently withdrawn<br \/>\nand the bill revised in terms whereof the net amount<br \/>\npayable is Rs. 30,55,573.27. A copy of the bill has<br \/>\nbeen annexed to the counter affidavit. It is also<br \/>\nstated that the connected load of 37.246 KW was being<br \/>\nused for industrial purposes and that is the reason why<br \/>\nbill is of such a high value which includes the<br \/>\nparameters as mentioned above. It is stated that it is<br \/>\nnot a case of only tampering of glass but also of<br \/>\ndirect tapping for industrial purpose. This is<br \/>\napparent from the discrepencies mentioned in the notice<br \/>\ndated 15.6.1992 which is as under:-\n<\/p>\n<p>1. Phase of electric supply directly for<br \/>\nworking three phase supply.\n<\/p>\n<p>2. Tampering with glass of meter no.343571<br \/>\nagainst K.No.7974275.\n<\/p>\n<p>3. Tampering of service line against<br \/>\nK.No. 84-145\/63.\n<\/p>\n<p>5. Learned counsel for the petitioner sought to<br \/>\ncontend that there was no explanation for such a high<br \/>\nvalue when the connected load was only 0.25 KW.<br \/>\nHowever, on a specific question being put the learned<br \/>\ncounsel had no answer as to why there was no disclosure<br \/>\nin the writ petition of the earlier suit proceedings or<br \/>\nof the fact that why the suit was not prosecuted<br \/>\nfurther.\n<\/p>\n<p>6. The aforesaid facts show that the petitioner<br \/>\napproached the civil court and obtained a reconnection<br \/>\nof the electricity, failed to pay electricity charges<br \/>\nand thereafter did not pursue the suit and let the suit<br \/>\nbe dismissed. In my considered view this itself is an<br \/>\nabuse of the process of court proceedings.\n<\/p>\n<p>7. The petitioner has also not further come with<br \/>\nclean hands before this court. The petitioner has<br \/>\nfailed to disclose the facts regarding the past<br \/>\nproceedings for which there is no explanation. The<br \/>\npetitioner is thus guilty of suppression of material<br \/>\nfacts.\n<\/p>\n<p>8. Even in respect of the merits of the controversy<br \/>\nit has been correctly explained in the counter<br \/>\naffidavit that the case of the petitioner was not one of<br \/>\nmere tampering with the glass and theft of electricity<br \/>\nbut of direct theft also from direct tapping on 3rd<br \/>\nphase for using for industrial purposes and the<br \/>\ntampering of the service line. It was in fact found<br \/>\nthat against an original sanctioned load of 0.25 KW the<br \/>\nconnected load was 37.264 KW.\n<\/p>\n<p>9.
