Justice M.N.KRISHNAN\n\n Dated :25\/06\/2007\n\n O R D E R\n                            M.N.KRISHNAN, J.\n\n                    -----------------------------\n\n                         Tr.P.C.No. 110 OF 2007\n\n                    -----------------------------\n\n                   Dated this the 25th June , 2007.\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      This   transfer   petition   is   filed   seeking   a   transfer   of<\/p>\n<p>O.P.252\/07   pending   before   the   Family   Court,   Thrissur   to<\/p>\n<p>Ernakulam   where   the   maintenance   case   filed   by   the   transfer<\/p>\n<p>petitioner as M.C.7\/07 is pending.   The grounds alleged are<\/p>\n<p>that   the   travelling   time   between   Angamaly   to   Ernakulam   is<\/p>\n<p>45   minutes   whereas   to   travel   Thrissur   is   two   hours.     The<\/p>\n<p>petitioner is having a minor child aged about two years and<\/p>\n<p>she   cannot   undertake   a   long   journey   with   the   child   and<\/p>\n<p>lastly   her   parents   are   very   old   and   they   are   unable   to<\/p>\n<p>accompany   her   to   a   long   distance   and,   therefore,   it   is<\/p>\n<p>practically impossible for her to go to Thrissur to conduct<\/p>\n<p>the case.   Respondent served.  He has not filed any counter<\/p>\n<p>affidavit   and   has   not   entered   appearance   in   this   court<\/p>\n<p>through   counsel.          So,   the   averments   in   the   transfer<\/p>\n<p>petition   remain   uncontroverted.     It   is   also   submitted   that<\/p>\n<p>the  case  before  the  Family  Court,  Thrissur  is  a  filed  as  a<\/p>\n<p>counterblast   to   the   maintenance   case   filed   by   her   in   the<\/p>\n<p>Family   Court,   Ernakulam.     Considering   the   fact   that   she   is<\/p>\n<p>having   a   very   small   child   and   the   parents   are   old   and   her<\/p>\n<p>financial capacity, it is only just and reasonable that the<\/p>\n<p>case   pending   before   the   Family   Court,   Thrissur   is<\/p>\n<p><span class=\"hidden_text\">Tr.P.C.110\/07                       2<\/span><\/p>\n<p>transferred   to   Family   Court,   Ernakulam.               Therefore<\/p>\n<p>O.P.252\/07   pending   before   the   Family   Court,   Thrissur   is<\/p>\n<p>transferred   to   the   Family   Court,   Ernakulam.             Before<\/p>\n<p>effecting   transfer   intimation   may   be   given   to   both   parties<\/p>\n<p>by   the   Family   Court,   Thirssur.
