No.952 of 2008\n                  MANOJ KUMAR CHAUDHARY &amp; ORS\n                             Versus\n                      HIRA KANT JHA &amp; ORS\n                          -----------\n<\/pre>\n<p>2   8.7.2008           Heard counsel for the petitioners.<\/p>\n<p>                       The    petitioners      are   aggrieved    by   an   order<\/p>\n<p>               dated 12.3.2008 whereby and whereunder the Court<\/p>\n<p>               below has rejected the application filed by the<\/p>\n<p>               petitioners as with regard to the maintainability<\/p>\n<p>               of   the      suit   on   the   ground   that     the   same   was<\/p>\n<p>               clearly barred under Section 16 of Bihar Public<\/p>\n<p>               Land Encroachment Act, 1956, hereinafter referred<\/p>\n<p>               to as the \u201eAct\u201f.\n<\/p>\n<p>                       Counsel for the petitioners would submit that<\/p>\n<p>               as a matter of fact, if the plaint is read along<\/p>\n<p>               with its        schedule-II it would become clear that<\/p>\n<p>               the suit has been filed in respect of a land for<\/p>\n<p>               which an order has been passed by the authorities<\/p>\n<p>               under the Act declaring the said land to be public<\/p>\n<p>               land.      He    therefore,       submits       that    when    an<\/p>\n<p>               application with regard to the maintainability of<\/p>\n<p>               the suit was raised under the provisions of Order<\/p>\n<p>               VII Rule, 11 of the Code of Civil Procedure, the<\/p>\n<p>               Court below was duty bound to reject the plaint<\/p>\n<p>               and accordingly dismiss the suit.\n<\/p>\n<p>                       In the opinion of this Court such submission<br \/>\n<span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>of the counsel for the petitioners is devoid of<\/p>\n<p>any    merit,    Section         16    of      the   Act     reads      as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>            &#8220;No suit or other legal proceeding<\/p>\n<p>        shall lie in any Court in respect of<\/p>\n<p>        any order passed under this Act&#8221;.<\/p><\/blockquote>\n<p>       The aforesaid clear provision under Section<\/p>\n<p>16 of the Act leaves nothing for speculation that<\/p>\n<p>only    such     civil     suits        are     barred      which      are<\/p>\n<p>directly or substantially questioning any order of<\/p>\n<p>the    authorities       passed       under    the   Act.        In    the<\/p>\n<p>present case, the relief which has been sought by<\/p>\n<p>the plaintiff\/opposite party is as follows:-<\/p>\n<blockquote><p>         A) That on the consideration of aforesaid<\/p>\n<p>            facts        and    circumstances        a     decree      for<\/p>\n<p>            declaration of title to and confirmation<\/p>\n<p>            of    possession           in   favour    of     plaintiff<\/p>\n<p>            along with defendant 3rd party over suit<\/p>\n<p>            land     i.e.        schedule-II         of     plaint      be<\/p>\n<p>            passed.\n<\/p><\/blockquote>\n<blockquote><p>         B) That     a    decree       of     permanent     injunction<\/p>\n<p>            restraining          the    defendants         1st   and   2nd<\/p>\n<p>            parties            from     any      interference           in<\/p>\n<p>            possession of plaintiffs over suit land<\/p>\n<p>            and also from changing present status-<\/p>\n<p>            quo of the suit land be passed.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                             -3-<\/span><\/p>\n<blockquote>\n<p>               C) That a decree of cost against defendants<\/p>\n<p>                     be also passed.\n<\/p><\/blockquote>\n<blockquote><p>               D) That a decree for any other relief or<\/p>\n<p>                     reliefs     which    the    Court,     deems     proper<\/p>\n<p>                     and   fit    be     and    passed    in     favour    of<\/p>\n<p>                     plaintiff.\n<\/p><\/blockquote>\n<blockquote><p>             In the opinion of this Court, none of the<\/p>\n<p>      four    aforementioned        reliefs       sought       for   by    the<\/p>\n<p>      plaintiff\/opposite party in any event, questions<\/p>\n<p>      any    order    of   the    authority       under     the      Act   and<\/p>\n<p>      consequently the Court below has rightly held that<\/p>\n<p>      the question of maintainability of the suit on the<\/p>\n<p>      ground of its barred under Section 16 of the Act<\/p>\n<p>      is    wholly    misconceived        and    its     order    rejecting<\/p>\n<p>      such application of the petitioner does not suffer<\/p>\n<p>      from any jurisdictional error.<\/p>\n<p>        This Court in exercise of power under Section<\/p>\n<p>      115 would also take no different view as there is<\/p>\n<p>      no error in the impugned order.<\/p>\n<\/blockquote>\n<blockquote><p>             Accordingly, this Civil Revision application<\/p>\n<p>      being wholly misconceived is hereby dismissed.<\/p>\n<\/blockquote>\n<pre>BCJ                                             (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manoj Kumar Chaudhary &amp;Amp; Ors vs Hira Kant Jha &amp;Amp; Ors on 8 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA C.R.
