SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 681 of 2010\n                    ---------------------------\n            Dated this the 24th day of February, 2010\n\n                           O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is accused No.2 in<\/p>\n<p>Crime No. 672 of 2009 of Balaramapuram Police Station.<\/p>\n<p>       2. The offence alleged against the petitioner is under<\/p>\n<p>Section 8(1)(2) of the Abkari Act.\n<\/p>\n<p>       3. The prosecution case is that on 1\/12\/2009, accused<\/p>\n<p>Nos.1 and 2 were found transporting 175 litres of spirit in an<\/p>\n<p>autorickshaw. On seeing the police party, they ran away<\/p>\n<p>abandoning the autorickshaw. On search of the vehicle, a<\/p>\n<p>quantity of 175 litres of spirit was found. The petitioner was<\/p>\n<p>arrested on 27\/1\/2010 and he was remanded to judicial custody.<\/p>\n<p>       4. The learned Public Prosecutor submitted that the<\/p>\n<p>petitioner is involved in another abkari offence in Crime<\/p>\n<p>No.235\/2008 of Neyyattinkara Police Station.<\/p>\n<p>       5. The learned counsel for the petitioner submitted that<\/p>\n<p>the petitioner undertakes not to commit any offence of similar<\/p>\n<p>nature while on bail in the present case. This undertaking is<\/p>\n<p>recorded.\n<\/p>\n<p>       6. Taking into account the facts and circumstances of the<\/p>\n<p>B.A. No. 681\/2010<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and also the undertaking,<\/p>\n<p>I am of the view that bail can be granted to the petitioner on<\/p>\n<p>stringent conditions.\n<\/p>\n<p>        7. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-III, Neyyattinkara subject to the following conditions:-<\/p>\n<blockquote><p>              A)   The petitioner shall report before the<br \/>\n                  Investigating Officer between 9 A.M. and<br \/>\n                  11 A.M. on all Mondays and Thursdays, till<br \/>\n                  the final report is filed or until further<br \/>\n                  orders.\n<\/p><\/blockquote>\n<blockquote><p>              B)   The petitioner shall     appear before the<br \/>\n                  Investigating Officer for interrogation as<br \/>\n                  and when required.\n<\/p><\/blockquote>\n<blockquote><p>              C)  The petitioner shall not try to influence the<br \/>\n                  prosecution witnesses or tamper with the<br \/>\n                  evidence.\n<\/p><\/blockquote>\n<blockquote><p>              D)  The petitioner shall not commit any offence<br \/>\n                  or indulge in any prejudicial activity while<br \/>\n                  on bail.\n<\/p><\/blockquote>\n<blockquote><p>              E)  In case of breach of any of the conditions<br \/>\n                  mentioned above, the bail shall be liable to<br \/>\n                  be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>        The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                    K.T.
