Through \u00a0 his \u00a0 RTI\u00adapplication \u00a0 dated \u00a0 06.02.2010, \u00a0 appellant \u00a0 raised\u00a0<br \/>\nfour\u00a0queries\u00a0to\u00a0be\u00a0answered\u00a0by\u00a0the\u00a0Deputy\u00a0Secretary,\u00a0AD\u00adIV,\u00a0Government\u00a0<br \/>\nof \u00a0 India, \u00a0 Ministry \u00a0 of \u00a0Finance, \u00a0 Department \u00a0 of \u00a0 Revenue. \u00a0 \u00a0 He \u00a0received \u00a0 a\u00a0<br \/>\nreply \u00a0 from \u00a0 the \u00a0 CPIO, \u00a0 Shri \u00a0 K.K. \u00a0 Khattar, \u00a0 Under \u00a0 Secretary \u00a0 dated\u00a0<br \/>\n04.03.2010\u00a0in\u00a0respect\u00a0of\u00a0his\u00a0queries\u00a0at\u00a0Sl.Nos.III\u00a0and\u00a0IV.\u00a0 \u00a0CPIO\u00a0further\u00a0<br \/>\ninformed \u00a0 him \u00a0 that \u00a0 as \u00a0 the \u00a0 other \u00a0 queries \u00a0 in \u00a0 his \u00a0 application \u00a0 related \u00a0 to\u00a0<br \/>\nSections \u00a0 AD\u00adIV, \u00a0 AD\u00adIIB \u00a0 and \u00a0 AD\u00adIIIB, \u00a0 these \u00a0 where \u00a0 transferred \u00a0 to \u00a0 those\u00a0<br \/>\nSections\u00a0to\u00a0furnish\u00a0replies\u00a0to\u00a0the\u00a0appellant.\n<\/p>\n<p>3.      When\u00a0this\u00a0matter\u00a0was\u00a0taken\u00a0in\u00a0first\u00adappeal,\u00a0Appellate\u00a0Authority,\u00a0in\u00a0<br \/>\nhis \u00a0 order \u00a0 dated \u00a0 19.04.2010, \u00a0 gave \u00a0 directions \u00a0 to \u00a0 the \u00a0 CPIO \u00a0 in \u00a0 regard \u00a0 to\u00a0<br \/>\nitems\u00a0at\u00a0Sl.Nos.III\u00a0and\u00a0IV\u00a0in\u00a0appellant&#8217;s\u00a0RTI\u00adapplication,\u00a0i.e.\u00a0to\u00a0approach\u00a0<br \/>\nDOPT\u00a0for\u00a0the\u00a0information\u00a0relating\u00a0to\u00a0item\u00a0III\u00a0and\u00a0to\u00a0make\u00a0renewed\u00a0search\u00a0<br \/>\nfor\u00a0information\u00a0requested\u00a0through\u00a0appellant&#8217;s\u00a0point\u00a0at\u00a0IV.\n<\/p>\n<p>4.    Following \u00a0 Appellate \u00a0 Authority&#8217;s \u00a0 order, \u00a0 CPIO \u00a0 provided \u00a0 to \u00a0 the\u00a0<br \/>\nappellant\u00a0another\u00a0reply\u00a0on\u00a020.05.2010.\u00a0\u00a0Appellant\u00a0was\u00a0informed\u00a0that\u00a0the\u00a0<\/p>\n<p>CIC_AT_A_2010_000701_M_45062.doc\u00a0<br \/>\n                                                                             Page\u00a01\u00a0of\u00a02<br \/>\n file\u00a0through\u00a0which\u00a0an\u00a0earlier\u00a0letter\u00a0dated\u00a009.05.1991\u00a0was\u00a0issued\u00a0was\u00a0not\u00a0<br \/>\ntraceable,\u00a0possibly\u00a0weeded\u00adout\u00a0and\u00a0destroyed.\n<\/p>\n<p>5.    Appellant, \u00a0 in \u00a0 his \u00a0 second\u00adappeal, \u00a0 had \u00a0 stated \u00a0 that \u00a0 the \u00a0 information\u00a0<br \/>\nCPIO\u00a0claims \u00a0to\u00a0have\u00a0been\u00a0destroyed\u00a0was\u00a0actually\u00a0lying\u00a0with\u00a0the\u00a0public\u00a0<br \/>\nauthority \u00a0 and \u00a0 the \u00a0 CPIO \u00a0 was \u00a0 willfully \u00a0 suppressing \u00a0 it. \u00a0 \u00a0 He \u00a0 has \u00a0 further\u00a0<br \/>\npointed\u00a0out\u00a0that\u00a0the\u00a0DOPT\u00a0instructions\u00a0were\u00a0not\u00a0fully\u00a0followed\u00a0in\u00a0working\u00ad<br \/>\nout\u00a0seniority\u00a0of\u00a0employees\u00a0at\u00a0his\u00a0level.\u00a0\u00a0Junior\u00a0officers\u00a0were\u00a0promoted\u00a0as\u00a0<br \/>\nInspectors \u00a0 earlier \u00a0 than \u00a0 seniors, \u00a0 which, \u00a0 appellant \u00a0 believes, \u00a0 was \u00a0 against\u00a0<br \/>\nfundamental\u00a0rights\u00a0and\u00a0was\u00a0unconstitutional.\n<\/p>\n<p>6.     I\u00a0find\u00a0from \u00a0what \u00a0appellant \u00a0has \u00a0stated \u00a0in\u00a0his\u00a0second\u00adappeal \u00a0he\u00a0is\u00a0<br \/>\nattempting \u00a0 to \u00a0 engage \u00a0 the \u00a0 public \u00a0 authority \u00a0 in \u00a0 a \u00a0 debate \u00a0 about \u00a0 DOPT\u00a0<br \/>\ninstructions \u00a0 about \u00a0 promotions \u00a0 and \u00a0 their \u00a0 compliance \u00a0 by \u00a0 the \u00a0 public\u00a0<br \/>\nauthority.\u00a0\u00a0RTI\u00a0provides\u00a0no\u00a0scope\u00a0for\u00a0such\u00a0engagements.\n<\/p>\n<p>7.     I \u00a0 have \u00a0 no \u00a0 reason \u00a0 to \u00a0 believe \u00a0 that \u00a0 CPIO \u00a0 was \u00a0 hiding \u00a0 any \u00a0 facts \u00a0 in\u00a0<br \/>\nstating\u00a0that\u00a0files\u00a0referred\u00a0to\u00a0by\u00a0the\u00a0appellant\u00a0were\u00a0untraceable,\u00a0possibly\u00a0<br \/>\ndestroyed. \u00a0 \u00a0 As \u00a0 these \u00a0 were \u00a0 old \u00a0 files \u00a0 and, \u00a0 given \u00a0 the \u00a0 weeding\u00adout \u00a0 and\u00a0<br \/>\ndestruction \u00a0 schedules, \u00a0 there \u00a0 was \u00a0 a \u00a0 strong \u00a0 probability \u00a0 that \u00a0 these \u00a0 have\u00a0<br \/>\nbeen\u00a0put\u00a0to\u00a0the\u00a0shredder.\n<\/p>\n<p>8.    In\u00a0view\u00a0of\u00a0the\u00a0above,\u00a0I\u00a0find\u00a0no\u00a0infirmity \u00a0in\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0CPIO,\u00a0<br \/>\nwhich\u00a0is\u00a0upheld.\n<\/p>\n<p>9.     Appeal\u00a0closed.\n<\/p>\n<p>10.
