RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n           W.P.(C).No.1389 of 2009-M\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n    Dated this the 30th day of January, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>The petitioner  attended    a  written   test   on<\/p>\n<p>25-3-2007 pursuant to a notification issued by<\/p>\n<p>respondents 1 and 2 to fill the post of Peon and<\/p>\n<p>Watchman. She attended interview on 18-6-2008.<\/p>\n<p>She is second in the ranked list, stated to be<\/p>\n<p>still in force. Respondents 1 and 2 do not<\/p>\n<p>dispute the fact that there is one post of Peon<\/p>\n<p>existing as at present. The petitioner, a female,<\/p>\n<p>is now aged 38 years and is likely to be over-<\/p>\n<p>aged  shortly  for   appointments   in   different<\/p>\n<p>sectors. She also says that she had worked in the<\/p>\n<p>society on contract basis in 2004. By Ext.P4, the<\/p>\n<p>third respondent had forwarded the request of the<\/p>\n<p>petitioner to the society for consideration. The<\/p>\n<p>Board  of   Directors   of  the   society   would,<\/p>\n<p>therefore, have the request of the petitioner<\/p>\n<p><span class=\"hidden_text\">WP(C)1389\/2009       -: 2 :-<\/span><\/p>\n<p> considered and an appropriate decision taken,<\/p>\n<p> having regard to the totality of the facts and<\/p>\n<p> circumstances of this case.
