KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nNanavati, J.\n<\/p>\n<p>     The appellant  has been  convicted\t by  the  Designated<br \/>\nCourt. Assam,  in TADA\tSessions Case  No.  126\/93,  on\t his<br \/>\npleading guilty\t to the\t charge\t that  on  22.10.91  in\t the<br \/>\nnotified area,\the was\tfound in  possession of two guns and<br \/>\ntwo cartidges which were intended to be used for carrying on<br \/>\nterrorist and disruptive activities.\n<\/p>\n<p>     Learned counsel  for the  appellant has  challenged the<br \/>\nconviction on  the ground  that the Designated Court wrongly<br \/>\nconstrued the  statement of the appellant as an admission of<br \/>\nguilt.\n<\/p>\n<p>     The charge\t framed against\t the appellant was &#8220;That you<br \/>\non or  about 22.10.91  kept concealed  DBBL gun No. 7083 and<br \/>\n42250 with  12 Bore  two cartidges  (red in  colour) without<br \/>\nlicence or  authority for  using the  same in  terrorist and<br \/>\ndisruptive activities  and there  by  committed\t an  offence<br \/>\nU\/s.5 of  TADA (p)  Act.&#8221;  After  framing  the\tcharge,\t the<br \/>\nquestion that  was put\tto  the\t appellant  was\t that  &#8221;  on<br \/>\n22.10.91 police\/Military  recovered from  your\tEngar  Khowa<br \/>\nhouse SBBL Gun No. 7083 and SBBL Gun No. 42250 and &#8216;120 Bore<br \/>\ncartridge 2 Nos. led by you.&#8221;\n<\/p>\n<p>     To this question, the appellant replied as under:<br \/>\n     &#8220;It was  recovered from the house of other person which<br \/>\nis situated  at a distance of one and half\/two K.M. distance<br \/>\nfrom my house. One Sri Atul Nath President, Anchalik Parisad<br \/>\nof ULFA\t directed to  keep that\t in that  house. I  lead the<br \/>\nPolice but  I am  not extremist\t and I am not connected with<br \/>\nthe occurrence&#8221;.\n<\/p>\n<p>     Treating this  answer as  an admission  of\t guilt,\t the<br \/>\nDesignated Court  convicted him. Immediately after the order<br \/>\nof conviction and sentence was passed, the appellant gave an<br \/>\napplication to the court complaining that he had no layer to<br \/>\nassist him, that the court had also not appointed any Lawyer<br \/>\nto assist  him and that he was fully ignorant about the case<br \/>\nand had\t no idea  about law.  He also stated that he had not<br \/>\nunderstood anything  about what\t the learned Judge had asked<br \/>\nhim. Thereafter,  he stated  that he  wanted legal aid to be<br \/>\nprovided to him. The Designated Judge, thereafter, passed an<br \/>\norder upholding the submission of the learned Special Public<br \/>\nProsecutor that\t the court  having passed the final order of<br \/>\nconviction and\tsentence had no jurisdiction to deal further<br \/>\nwith the  case. The  second order  is also challenged by the<br \/>\nappellant.\n<\/p>\n<p>     We\t are  of  the  opinion\tthat  the  Designated  Court<br \/>\ncommitted a  grave error  of law in convicting the appellant<br \/>\non the\tbasis of  the answer  given by\thim. It\t was alleged<br \/>\nagainst the appellant that the said fire arms were recovered<br \/>\nfrom  his   Engar  Khowa   house.  While  replying  to\tthat<br \/>\nallegation he  clearly stated that it was recovered from the<br \/>\nhouse of another person situated at a distance of 1-1\/2 to 2<br \/>\nkms. from  his house.  Though he  stated that &#8220;One shri Atul<br \/>\nNath, President,  Achalik Parishad of ULFA, directed to keep<br \/>\nthat in\t that house&#8221;  he did  not say  that  Atul  nath\t had<br \/>\ndirected him  to keep\tthose fire arms in that house. While<br \/>\nadmitting that\the led\tthe police  to that  house he denied<br \/>\nthat he\t was an extrimist and that he was connected with the<br \/>\n&#8220;occurrence&#8221;. If these statements made by the appellant were<br \/>\nconsidered carefully  by the  Designated Court it would have<br \/>\nrealised that  they did not consitute an admission of guilt.<br \/>\nOnly inference\tthat can  be drawn  from the answer given by<br \/>\nthe appellant is that he knew that the said two guns and the<br \/>\ncartidges were\tkept at\t that place  but mere knowledge that<br \/>\nthey were  kept at  that place\tcannot amount  to  conscious<br \/>\npossession of  those things.  It is, therefore, abvious that<br \/>\non the basis of the said answer it was not proper to convict<br \/>\nthe appellant under Section 5 of the TADA Act.\n<\/p>\n<p>     We, therefore,  allow  these  appeals,  set  aside\t the<br \/>\nconviction under  Section 5  of the TADA  Act and direct the<br \/>\ntrial  court   to  proceed  further  with  the\ttrial  after<br \/>\nproviding legal\t assistance to him.\n<\/p>\n<p>     In view of the facts and circumstances of this case, we<br \/>\ndirect the  Designated Court  to dispose of the case against<br \/>\nthe appellant as early as possible.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Khudeswar Dutta vs State Of Assam on 2 April, 1998 Author: Nanavati Bench: G.T.
