ABDUL REHIM, J\n                 -------------------------------\n               WP(C) NO. 27793 OF 2010\n               -------------------------------------\n        Dated this the 13th day of September, 2010\n\n\n                         JUDGMENT\n<\/pre>\n<p>     Consequent to default committed in repayment of a<\/p>\n<p>housing loan availed by the petitioner from the<\/p>\n<p>respondent Bank, proceedings under the Securitisation<\/p>\n<p>and Reconstruction of Financial Assets and Enforcement<\/p>\n<p>of Security Interest Act, 2002 (SARFAESI Act) was<\/p>\n<p>initiated. When steps as contemplated under Section 14<\/p>\n<p>(1) of the Act was initiated, the petitioner had invoked the<\/p>\n<p>remedy as provided under Section 17(1) and an<\/p>\n<p>application was filed before the Debt Recovery Tribunal<\/p>\n<p>as S.A. No. 141\/2010. An interim order was issued by<\/p>\n<p>that Tribunal on 19.02.2010, as per Ext.P3, imposing<\/p>\n<p>condition on the petitioner to make deposit of a sum of<\/p>\n<p>Rs.3 lakhs on or before 27.03.2010. It is noticed that as<\/p>\n<p>per Ext.P5 order dated 05.08.2010 the time for complying<\/p>\n<p>with the condition was subsequently extended till<\/p>\n<p>03.09.2010. According to the petitioner he is not in a<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><br \/>\nWP(C) No. 27793\/2010<\/p>\n<p>position to comply with the condition imposed under<\/p>\n<p>Exts.P3 and P5. The petitioner is approaching this Court<\/p>\n<p>when coercive steps for sale of the movable property was<\/p>\n<p>proposed.\n<\/p>\n<p>     2.     Learned counsel appearing for the respondent<\/p>\n<p>Bank submitted that the petitioner had approached the<\/p>\n<p>Tribunal on different occasions seeking modifications\/<\/p>\n<p>extension of time with respect to the interim order, and<\/p>\n<p>inspite of indulgence shown by the Tribunal he had failed to<\/p>\n<p>comply with the conditions stipulated. It is further stated<\/p>\n<p>that the Bank had already approached the Chief Judicial<\/p>\n<p>Magistrate invoking Section 14(1) of the Act.<\/p>\n<p>     3.     It is evident that the petitioner had already<\/p>\n<p>approached the appellate authority challenging proceedings<\/p>\n<p>initiated under the SARFAESI Act, and the appeal is<\/p>\n<p>pending disposal before the Tribunal.    It is evident that<\/p>\n<p>exercising the discretionary jurisdiction vested on that<\/p>\n<p>Tribunal interim orders were already issued on different<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><br \/>\nWP(C) No. 27793\/2010<\/p>\n<p>occasions. Under such circumstances, I do not find any<\/p>\n<p>merit in this Writ Petition to interfere with any such orders<\/p>\n<p>as it could not be said that there is any erroneous exercise<\/p>\n<p>of jurisdiction by the Tribunal. I am not convinced to hold<\/p>\n<p>that the conditions imposed by the Tribunal is per se illegal,<\/p>\n<p>arbitrary or unreasonable. However, it is for the petitioner<\/p>\n<p>to seek appropriate relief from the Tribunal itself if he is<\/p>\n<p>finding it difficult to comply with the condition. It will be<\/p>\n<p>highly improper for this Court to interfere in any manner<\/p>\n<p>and to impose any conditions for restraining coercive steps,<\/p>\n<p>when the matter is in seizin of the Tribunal.<\/p>\n<p>     4.     Under the above circumstances, the Writ Petition<\/p>\n<p>is dismissed, reserving liberty to the petitioner to seek<\/p>\n<p>appropriate remedies either from the Debt Recovery<\/p>\n<p>Tribunal or from the Chief Judicial Magistrate&#8217;s Court, as<\/p>\n<p>the case may be.\n<\/p>\n<\/p>\n<p>                                    C.K.
