Patnaik<\/div>\n<pre>                          IN THE SUPREME COURT OF INDIA\n\n\n\n                  CIVIL ORIGINAL JURISDICTION\n\n\n          WRIT PETITION (CIVIL) NO. 473 OF 2005\n\n\nSampurna Behura                                               .....Petitioner\n\n\n\n                                  Versus\n\n\n\nUnion of India and Others                                .....Respondents \n\n\n\n\n\n                               O R D E R \n<\/pre>\n<p>      In   this   Writ   Petition   under   Article   32   of   the <\/p>\n<p>Constitution,   the   Court   has   been   monitoring   the <\/p>\n<p>implementation of the Juvenile Justice (Care and Protection <\/p>\n<p>of   Children)   Act,  2000  (for   short   `the   Act&#8217;).    The  Court   has  <\/p>\n<p>already   passed   several   orders   for   constitution   of   Juvenile <\/p>\n<p>Justice Boards under Section 4 of the Act and Child Welfare <\/p>\n<p>Committees under Section 29 of the Act in different States <\/p>\n<p>and   Union   Territories   and   most   of   the   States   and   Union <\/p>\n<p>Territories   have   taken   steps   to   constitute   the   Juvenile <\/p>\n<p>Justice Boards and the Child Welfare Committees.  As there <\/p>\n<p>were   complaints   that   in   many   districts   Child   Welfare <\/p>\n<p>Committees   were   not   operational   or   functional   and   even <\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>Juvenile   Justice   Boards   had   not   been   constituted   in   the <\/p>\n<p>manner provided in the Act, in our order dated 19.08.2011 <\/p>\n<p>we   have   requested   the   State   Legal   Services   Authorities   to <\/p>\n<p>coordinate with the respective Child Welfare Department of <\/p>\n<p>the   States   to   ensure   that   the   Juvenile   Justice   Boards   and <\/p>\n<p>Child   Welfare   Committees   are   established   and   are <\/p>\n<p>functional with the required facilities.\n<\/p>\n<p>2.    We   think   that   we   must   now   monitor   the <\/p>\n<p>implementation   of   the   provisions   of   the   Act   relating   to <\/p>\n<p>Special Juvenile Police Unit.  Section 63 of the Act is quoted <\/p>\n<p>hereinbelow:\n<\/p>\n<blockquote><p>        &#8220;63. Special juvenile police unit.- (1) In order <\/p>\n<p>        to   enable   the   police   officers   who   frequently   or <\/p>\n<p>        exclusively   deal   with   juveniles   or   are   primarily <\/p>\n<p>        engaged   in   the   prevention   of   juvenile   crime   or <\/p>\n<p>        handling of the juveniles or children under this <\/p>\n<p>        Act   to   perform   their   functions   more   effectively, <\/p>\n<p>        they shall be specially instructed and trained. <\/p>\n<p>        (2)   In   every   police   station   at   least   one   officer <\/p>\n<p>        with   aptitude   and   appropriate   training   and <\/p>\n<p>        orientation may be designated as the &#8216;juvenile or <\/p>\n<p>        the   child   welfare   officer&#8217;   who   will   handle   the <\/p>\n<p>        juvenile   or   the   child   in   co-ordination   with   the <\/p>\n<p>        police.\n<\/p><\/blockquote>\n<blockquote><p>        (3)   Special   juvenile   police   unit,   of   which   all <\/p>\n<p>        police   officers   designated   as   above,   to   handle <\/p>\n<p>        juveniles   or   children   will   be   members,   may   be <\/p>\n<p>        created in  every district and  city  to  co-ordinate <\/p>\n<p>        and   to   upgrade   the   police   treatment   of   the <\/p>\n<p>        juveniles and the children.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<\/blockquote>\n<p>3.    The   Home   Departments   and   the   Director   Generals   of <\/p>\n<p>Police   of   the   States\/Union   Territories   will   ensure   that   at <\/p>\n<p>least one police officer in every police station  with aptitude <\/p>\n<p>is given appropriate training and orientation and designated <\/p>\n<p>as   Juvenile   or   Child   Welfare   Officer,   who   will   handle   the <\/p>\n<p>juvenile or child in coordination with the police as provided <\/p>\n<p>under sub-section (2) of Section 63 of the Act.  The required <\/p>\n<p>training   will   be   provided   by   the   District   Legal   Services <\/p>\n<p>Authorities   under   the   guidance   of   the   State   Legal   Services <\/p>\n<p>Authorities   and   Secretary,   National   Legal   Services <\/p>\n<p>Authoritiy   will   issue   appropriate   guidelines   to   the   State <\/p>\n<p>Legal   Services   Authorities   for   training   and   orientation   of <\/p>\n<p>police officers, who are designated as the Juvenile or Child <\/p>\n<p>Welfare Officers.   The training and orientation may be done <\/p>\n<p>in phases over a period of six months  to one year in every <\/p>\n<p>State and Union Territory.\n<\/p>\n<p>4.    The   Home   Departments   and   the   Director   Generals   of <\/p>\n<p>Police   of   the   States\/Union   Territories   will   also   ensure   that <\/p>\n<p>Special Juvenile Police Unit comprising of all police officers  <\/p>\n<p>designated as Juvenile or Child Welfare Officer be created in <\/p>\n<p>every   district   and   city   to   coordinate   and   to   upgrade   the <\/p>\n<p><span class=\"hidden_text\">                                          4<\/span><\/p>\n<p>police treatment to juveniles and the children as provided in <\/p>\n<p>sub-section (3) of Section 63 of the Act.\n<\/p>\n<p>5.
