PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 28\/03\/2011\n \n\nORAL\nJUDGMENT<\/pre>\n<p>This<br \/>\n\tappeal is directed against the judgment and order dated 16th<br \/>\n\tJanuary, 1998 passed by the learned Additional Sessions Judge,<br \/>\n\tNadiad in Sessions Case No. 146 of 1994, whereby the appellant has<br \/>\n\tbeen convicted for the offences punishable under Sections 325 and<br \/>\n\t323 of the Indian Penal Code. The learned trial Judge was pleased to<br \/>\n\tconvict the appellant under Section 325 of the Indian Penal Code and<br \/>\n\tordered to undergo simple imprisonment for a period of one year and<br \/>\n\talso imposed fine of Rs.500\/-, and in default of payment of fine,<br \/>\n\tordered to undergo simple imprisonment for a further period of three<br \/>\n\tmonths.  The learned trial Judge was also pleased to convict the<br \/>\n\tappellant for the offence punishable under Section 323  and ordered<br \/>\n\tto undergo simple imprisonment for a period of one month. However,<br \/>\n\tboth the sentences were ordered to run concurrently.\n<\/p>\n<p>The<br \/>\n\tcase of the prosecution is that on 20th June, 1993 at<br \/>\n\tabout 20.45 hours, the appellant along with four other accused<br \/>\n\tforming an unlawful assembly and attacked on the father of the<br \/>\n\tcomplainant with deadly weapons.  It is also the case of the<br \/>\n\tprosecution that the appellant, who was having Dharia in his hand,<br \/>\n\thad given Dharia blow on the head of the father of the complainant.<br \/>\n\tThe original accused No.2 caught hold of the father of the<br \/>\n\tcomplainant and the appellant gave second blow of Dharia on the left<br \/>\n\tside of abdomen of the father of the complainant. The original<br \/>\n\taccused No.3 had given a stick blow to the complainant&#8217;s father.<br \/>\n\tTherefore, the complainant, his mother, his maternal aunty, his<br \/>\n\tsister intervened and made shouts. It is also the case of the<br \/>\n\tprosecution that the accused had also given stick blow to the<br \/>\n\tcomplainant&#8217;s sister. Thereafter, as the other people of street<br \/>\n\tgathered, the accused had run away.\n<\/p>\n<p>Therefore,<br \/>\n\ta complaint to the said effect was registered with Vaso Police<br \/>\n\tStation. Thereafter, necessary<br \/>\n\tinvestigation was carried out and statements of several witnesses<br \/>\n\twere recorded. Panchnama of seen of offence came to be drawn. Even<br \/>\n\tfrom the possession of the present appellant, weapon Dharia was<br \/>\n\tseized and panchnama was also drawn. During the course of<br \/>\n\tinvestigation, as sufficient material was found against the accused,<br \/>\n\tthey were arrested. After completion of investigation,<br \/>\n\tcharge-sheet was filed in the competent Court but, the same was<br \/>\n\tcommitted to the Sessions Court, Nadiad for trial.\n<\/p>\n<p>During<br \/>\n\tthe trial, the prosecution has examined several witnesses and also<br \/>\n\tproduced on record documentary evidence to prove their case.\n<\/p>\n<p>At<br \/>\n\tthe end of trial, the Court below convicted the accused and imposed<br \/>\n\tsentenced as narrated above and therefore, the appellant has filed<br \/>\n\tthe present appeal.\n<\/p>\n<p>Mr.B.C.\n<\/p>\n<p>\tDave, learned counsel for the appellant, has submitted that the<br \/>\n\tdispute between the parties have amicably settled outside the Court<br \/>\n\ton account of the intervention of responsible people of the<br \/>\n\tcommunity. Mr.Dave has also contended that the appellant and the<br \/>\n\tcomplainant and the injured witnesses are residing in same village.<br \/>\n\tHe has further submitted that no untoward incident has taken place<br \/>\n\tbetween the parties after the alleged incident and that the original<br \/>\n\tinjured witness has willingly and under no duress has sought<br \/>\n\tpermission of this Hon&#8217;ble Court to compound the offences.\n<\/p>\n<p>In<br \/>\n\tsupport thereof, the learned counsel has produced the affidavit<br \/>\n\tdated 28th March, 2011 filed by the complainant and the<br \/>\n\tinjured person at one side and the appellant-original accused at<br \/>\n\tother side. In the said affidavit, it has been stated that the<br \/>\n\tparties have amicably settled the dispute between them and they are<br \/>\n\twilling to compound the offences.  The learned counsel has,<br \/>\n\ttherefore, prayed that the appellant may be released by treating the<br \/>\n\tsentence already undergone by the appellant as sufficient.\n<\/p>\n<p>I<br \/>\n\thave given my anxious consideration to the case and also the plea<br \/>\n\tput forward for seeking permission to compound the offences. I have<br \/>\n\talso examined the provisions of Section 320 of Code of Criminal<br \/>\n\tProcedure which deals with compounding of offences.\n<\/p>\n<p>The<br \/>\n\tparties are residents of village Mitral, Taluka Nadiad, District<br \/>\n\tKheda and no untoward incident had taken place after the alleged<br \/>\n\tincident. I am satisfied that the complainant and the original<br \/>\n\tinjured witness have voluntarily desire to compound the offence with<br \/>\n\tthe appellant-accused person for sufficient and genuine reasons<br \/>\n\tstated in the affidavit.\n<\/p>\n<p>In<br \/>\n\tthe case of <a href=\"\/doc\/268959\/\">Mahesh Chand &amp; Anr. v. State of Rajasthan<\/a> reported<br \/>\n\tin AIR 1988 SC pg. 2111, <a href=\"\/doc\/376885\/\">State of U.P. v. Fazilur Rehman<\/a> reported in<br \/>\n\tJ.T. 2002 (10) SC pg. 137, Badrilal v. State of M.P. Reported in<br \/>\n\t2005 SCC (Cri,) 1597, Jetha Ram v. State of Rajasthan reported in<br \/>\n\t2006 (9) SCC 255, Ishwar Singh v. State of M.P. Reported in AIR 2009<br \/>\n\tSC 675 and Manoj &amp; Anr. v. State of M.P. Reported in 2009 (2)<br \/>\n\tGLH 56, the Apex Court while taking into account the fact of<br \/>\n\tcompromise between the parties, has reduced the sentence imposed on<br \/>\n\tthe accused to already undergone though the offences were not<br \/>\n\tcompoundable.  Thus, the compounding of offences is legal and valid.\n<\/p>\n<p>Considering<br \/>\n\tthe totality of the facts in the background of the settled legal<br \/>\n\tposition, I allow the parties to compound the offences.   Thus, the<br \/>\n\tappeal is partly allowed. The impugned judgment and order dated 16th<br \/>\n\tJanuary, 1998 passed by the learned Additional Sessions Judge,<br \/>\n\tNadiad in Sessions Case No. 146 of 1994 is modified in view of the<br \/>\n\tcompromise arrived at between the parties, more particularly the<br \/>\n\taffidavit filed by the complainant &#8211; Govindbhai Gotabhai<br \/>\n\tChavda and the injured person named Gotabhai Chhaganbhai Chavda and<br \/>\n\talso in view of the settled principles of law of compounding the<br \/>\n\tnon-compoundable offences to the extent herein below :\n<\/p>\n<p>The<br \/>\n\tconviction recorded by the Court below is confirmed; however, so far<br \/>\n\tas the sentence part is concerned,  the same is modified to the<br \/>\n\textent that the sentence already undergone by the appellant-accused<br \/>\n\tshall be treated to be sufficient sentence, in view of the<br \/>\n\tcompromise arrived at between the parties. Appellant-original<br \/>\n\taccused is on bail and, therefore, this bail bond stand discharged.<br \/>\n\tThe sentence with regard to payment of fine is not disturbed. If the<br \/>\n\tappellant has not paid the fine amount, he will pay the said amount<br \/>\n\twithin a period of four weeks from today. Record and Proceedings, if<br \/>\n\tany, be sent back to the Court below forthwith.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
