Justice V.GIRI\n\n Dated :23\/07\/2008\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                    W.P.(C).22133\/2008\n                        --------------------\n            Dated this the 23rd day of July, 2008\n\n                        JUDGMENT\n<\/pre>\n<p>      Petitioner, a 3rd Grade Overseer in the Public Works<\/p>\n<p>Department, was deployed to the LSGD by order dated<\/p>\n<p>31.12.2004. Deployment was originally for a period of<\/p>\n<p>three years.    But    petitioner continues on deployment<\/p>\n<p>even now. An Engineering Cadre was set up in the LSGD<\/p>\n<p>by the Government. Options were sought for. But the<\/p>\n<p>petitioner did not opt for the same. In fact he filed Ext.P2<\/p>\n<p>representation    before      the      Chief  Engineer, PWD<\/p>\n<p>(Administration), seeking cancellation of his deployment<\/p>\n<p>and repatriation to the parent department. Orders are yet<\/p>\n<p>to be passed thereon.\n<\/p>\n<\/p>\n<p>2.    In the meanwhile, under Ext.P4 order, petitioner has<\/p>\n<p>been transferred to the Balussery             Panangad Grama<\/p>\n<p>Panchayat. Petitioner is aggrieved that his request for<\/p>\n<p>cancellation of deployment has not been considered. But<\/p>\n<p>he continues to be treated as deployed in the LSGD and<\/p>\n<p>he is even transferred to another station also. Petitioner<\/p>\n<p>W.P.(C).22133\/2008<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>submits that the statement in Ext.P5, to the extent to<\/p>\n<p>which it says that the petitioner&#8217;s transfer is also on a<\/p>\n<p>request, is a wrong statement of fact. Petitioner has<\/p>\n<p>submitted Ext.P5 before the first respondent, the Chief<\/p>\n<p>Engineer, in the LSG Department           and the same is<\/p>\n<p>pending consideration.\n<\/p>\n<\/p>\n<p>3.    Having heard learned counsel on both sides, writ<\/p>\n<p>petition is disposed of in the following terms:-<\/p>\n<blockquote><p>        (i).   Third respondent shall consider the<\/p>\n<p>        petitioner&#8217;s request under Ext.P2 and take<\/p>\n<p>        a decision thereon, within a period of six<\/p>\n<p>        weeks from the date of receipt of a copy of<\/p>\n<p>        this judgment.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>        (ii). Once such an order is passed, it shall<\/p>\n<p>        be communicated to the first respondent<\/p>\n<p>        and first respondent shall proceed to pass<\/p>\n<p>        orders on Ext.P5 on the basis of the decision<\/p>\n<p>        taken by the third respondent on Ext.P2.<\/p><\/blockquote>\n<p>        (iii). On receipt of the decision taken by the<\/p>\n<p>W.P.(C).22133\/2008<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>        third respondent,     first respondent shall,<\/p>\n<p>        within two weeks thereafter, take a decision<\/p>\n<p>        on Ext.P5.\n<\/p>\n<\/p>\n<p>        (iv).
