Dabhi, learned APP waives service of notice of Rule for<br \/>\nrespondent State.\n<\/p>\n<p>2.\tThe<br \/>\napplicant has taken out present application under Section 438 of the<br \/>\nCode of Criminal Procedure, 1973 seeking anticipatory bail in<br \/>\nconnection with the offences registered with Bhadarwa Police<br \/>\nStation bearing M Case No.7 of 2010 punishable under<br \/>\nSections 465, 467, 468, 471, 120B and 114 of<br \/>\nthe I.P.C.\n<\/p>\n<p>3.\tHeard<br \/>\nMr.Shah, learned advocate for the applicant.\n<\/p>\n<p> 4.\tMr.Shah,<br \/>\nlearned advocate for the applicant has submitted that prima-facie<br \/>\nthere is no evidence against the present applicant except that he had<br \/>\nsigned as a witness in the Power of Attorney. He has further<br \/>\nsubmitted that the applicant has neither signed any bogus document<br \/>\nnor made any bogus document as well as he is not beneficiary in the<br \/>\nland at all.\n<\/p>\n<p>5.\tMr.Shah,<br \/>\nlearned advocate, has also further submitted that by order dated<br \/>\n12.05.2011, the purchaser has also been granted bail and that<br \/>\ntherefore, present application may be granted.  He has submitted that<br \/>\napplicant is ready to abide by any condition that may be imposed.<br \/>\nMr.Shah, learned advocate for the applicant has also stated that the<br \/>\napplicant will be available whenever his presence is required. He<br \/>\nrequests that the applicant, at this stage, may be granted<br \/>\nanticipatory bail.\n<\/p>\n<p>6.\tHeard<br \/>\nMr.L.B. Dabhi, learned APP for the respondent-State of Gujarat.\n<\/p>\n<p>7.\tMr.\n<\/p>\n<p>Dabhi, learned APP opposed the submissions of the learned advocate<br \/>\nfor the applicant on the ground that the applicant has committed<br \/>\nserious offences and the incident is not in dispute. He has requested<br \/>\nthat present application may not be entertained.\n<\/p>\n<p>8.\tHaving<br \/>\nheard to the fact that the accused is only a signatory to the witness<br \/>\nand not the beneficiary to the disputed transaction and having regard<br \/>\nto the fact that one of the accused has been released on bail vide<br \/>\norder dated 25.4.2011 in Criminal Misc. Application No.5167 of 2011<br \/>\nand by order dated 12.05.2011, the purchaser has also been granted on<br \/>\nbail and having regard to the submissions made by the learned counsel<br \/>\nfor both the sides and considering the facts and circumstances of the<br \/>\ncase as well as the documents and other material produced on record<br \/>\nof this case, the gravity of the offence, the quantum of punishment,<br \/>\nthe allegations against the applicant and the manner in which the<br \/>\napplicant is allegedly involved in the case, I am of the view that<br \/>\nthe applicant deserve to be released on bail. Therefore, I am<br \/>\ninclined to allow this application and release the applicant.\n<\/p>\n<p>9.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant. This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Stalingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors.<\/a> reported in [2011]1 SCC 694,<br \/>\nwherein the Apex Court reiterated the law laid down by the<br \/>\nConstitutional Bench in the case of Shri Gurubaksh Singh Sibbia<br \/>\n&amp; Ors. reported in [1980]2 SCC 565. Hence,<br \/>\nthis application is allowed and it is directed that in the event of<br \/>\nthe arrest of the abovenamed applicant in connection with M Case No.7<br \/>\nof 2010 registered with the Bhadarwa Police Station, Vadodara, he<br \/>\nshall be released on bail, in respect of the offences alleged against<br \/>\nhim in this application, on him executing and furnishing a bond of<br \/>\nRs.10,000\/- (Rupees: Ten Thousand Only) with one solvent surety of<br \/>\nlike amount, by the concerned police officer, and on condition that<br \/>\nhe :-\n<\/p>\n<p>(a)<br \/>\nshall cooperate with the investigation and shall, without failure or<br \/>\ndelay, make himself available for interrogation whenever and wherever<br \/>\nrequired.\n<\/p>\n<p>(b)<br \/>\nshall not in any manner, hamper or obstruct the investigation.\n<\/p>\n<p>(c)<br \/>\nshall not either himself or through others and directly or indirectly<br \/>\nmake any inducement, promise or threat of whatsoever nature to any<br \/>\nwitness or anyone else concerned in the case or to any witness or<br \/>\nperson acquainted with the facts of the case so as to dissuade him<br \/>\nfrom disclosing such facts to the Court or to any police officer and<br \/>\nshall not cause any harassment to the complainant.\n<\/p>\n<p>(d)<br \/>\nshall remain present on 20.06.2011 before the<br \/>\ninvestigating \/police officer of the Adalaj Police Station between<br \/>\n11.00 a.m. to 2.00 p.m. and then at any time as<br \/>\ninformed and required by such officer and shall not leave the revenue<br \/>\nlimit of District Vadodara.\n<\/p>\n<p>(e)\tshall<br \/>\nnot enter the limits of Savli.\n<\/p>\n<p>(f)\tshall<br \/>\nremain present before the trial Court regularly as and when directed<br \/>\nand on the dates fixed.\n<\/p>\n<p>(g)\tshall<br \/>\nnot play any type of mischief with the evidence collected or yet to<br \/>\nbe collected by the police and shall not try to influence, in any<br \/>\nmanner, any witness or any person connected with the case and \/ or<br \/>\nacquainted with the facts of the case.\n<\/p>\n<p>(h)<br \/>\nat the time of execution of bond, shall furnish his present and<br \/>\npermanent residential address to the investigating officer and to the<br \/>\nCourt concerned and shall not change the residence\/address till the<br \/>\nfinal disposal of the case or till further orders.\n<\/p>\n<p>(i)<br \/>\nshall not leave India \/ State of Gujarat without the permission of<br \/>\nthe Court and shall, if holding a passport, surrender and deposit the<br \/>\nsame before the trial Court on or before 20.6.2011.\n<\/p>\n<p>10.\tIt<br \/>\nwould be open to the investigating officer to file an application for<br \/>\nremand if he considers it just and proper and the competent Court<br \/>\nshall decide the same in accordance with law and on merits without<br \/>\nbeing influenced by this order or the observations made herein.\n<\/p>\n<p>11.<br \/>\nDespite this order, it would be open for the Investigating Agency to<br \/>\napply to the competent Magistrate, for police remand of the<br \/>\napplicant. The applicant shall remain present before the learned<br \/>\nMagistrate on the first date of hearing of such an application and on<br \/>\nall subsequent occasions, as may be directed by the learned<br \/>\nMagistrate. This would be sufficient to treat the accused in the<br \/>\njudicial custody for the purpose of entertaining application of the<br \/>\nprosecution for police remand. This is, however, without prejudice to<br \/>\nthe right of the accused to seek stay against an order of remand, if<br \/>\nultimately granted, and the power of the learned Magistrate to<br \/>\nconsider such a request in accordance with law. It is clarified that<br \/>\nthe applicant, even if, remanded to the police custody, upon<br \/>\ncompletion of such period of police remand, shall be set free<br \/>\nimmediately, subject to other conditions of this anticipatory bail<br \/>\norder.\n<\/p>\n<p>12.\tIt<br \/>\nis clarified that the observations in this order are only for limited<br \/>\npurpose of considering the request made in this application and are<br \/>\npurely tentative and prima facie and does not in any manner indicate<br \/>\nopinion of this Court about the allegations or merits of the case.\n<\/p>\n<p>13.\tThe<br \/>\napplication is allowed. Rule made absolute.
