Gandhi Maidan, district Patna at\npresent posted as Laboratory Technician in Infection Disease\nHospital, Unit of Nalanda Medical College and Hospital, Agamkuan,\nPatna.\n                                                -------- Petitioner\n                                Versus\n1. The State of Bihar through the Commissioner-cum-Secretary,\n   Department of Health, Medical Education and Family Welfare,\n   Government of Bihar, Patna.\n2. Director in Chief, Health Services, Department of Health,\n   Medical Education and Family Welfare, Government of Bihar,\n   Patna.\n3. Superintendent, Nalanda Medical College and Hospital, Patna.\n                                                 ------ Respondents\n                             -----------\n<\/pre>\n<p>9       19.08.2011            No    one      appears      on   behalf     of   the<\/p>\n<p>                     petitioner.\n<\/p>\n<p>                              From perusal of the record as also<\/p>\n<p>                     the nature of relief sought for in this writ<\/p>\n<p>                     application,       it    becomes      clear      that     the<\/p>\n<p>                     petitioner wants creation of a joint cadre.<\/p>\n<p>                              The        respondents,           however,       had<\/p>\n<p>                     explained in the counter affidavit that the<\/p>\n<p>                     petitioner     holds      the     post     of   Laboratory<\/p>\n<p>                     Technician, which is a State cadre post and,<\/p>\n<p>                     therefore, the same cannot be clubbed with<\/p>\n<p>                     the   other   class-3     post of         Nalanda    Medical<\/p>\n<p>                     College and its joint cadre.\n<\/p>\n<pre>                              As    a    matter      of   fact,      it   is   the\n\n                     prerogative        of   the     executive       to    either\n<span class=\"hidden_text\">                2<\/span>\n\n\n\n\n<\/pre>\n<p>amalgamate the cadres or bifurcate the cadres<\/p>\n<p>and no mandamus can be issued by this Court<\/p>\n<p>for either creation of cadre or bifurcation<\/p>\n<p>of cadre. It is only when a cadre is created<\/p>\n<p>affecting the vested rights of an incumbent<\/p>\n<p>either by amalgamating different cadres in<\/p>\n<p>one cadre or segregating the joint cadre in<\/p>\n<p>to many cadres that this Court make examine<\/p>\n<p>the rationale of such decision but, a prayer<\/p>\n<p>of this nature directing the respondents to<\/p>\n<p>create   a    joint       cadre    by   amalgamating       the<\/p>\n<p>cadre of employees of Class-3 at the Medical<\/p>\n<p>College level with the cadre employees of the<\/p>\n<p>State level cannot be allowed.<\/p>\n<p>         As a matter of fact, the solitary<\/p>\n<p>overemphasized aspect in the writ petition<\/p>\n<p>that since the petitioner or other Laboratory<\/p>\n<p>Technicians        were    being    transferred       to   the<\/p>\n<p>Medical College, they would be deemed to be<\/p>\n<p>part and parcel of the Medical College Cadre,<\/p>\n<p>is   itself        misconceived         inasmuch      as    an<\/p>\n<p>incumbent     of    a     State    cadre   can   be   posted<\/p>\n<p>anywhere on a cadre post without disturbing<\/p>\n<p>his seniority and other rights as they would<\/p>\n<p>still be governed in the cadre to which he<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>      belongs.\n<\/p>\n<p>                 That being so, this application is<\/p>\n<p>      wholly     misconceived   and   is,   accordingly,<\/p>\n<p>      dismissed.\n<\/p>\n<\/p>\n<p>                                 (Mihir Kumar Jha, J.)<br \/>\nRsh\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rabindra Prasad Sinha vs The State Of Bihar &amp; Ors on 19 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.7993 of 1998 Rabindra Prasad Sinha, son of late Pitamber Singh, resident of Mohalla Shalimpur Ahra, P.S.
