No.1772 of 2006\n              ------------------------------------\n           Dated, this the 19th    day of June, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>           The respondents in the writ petition are the<\/p>\n<p>appellants. The brief facts of the case are as follows:<\/p>\n<p>           2. The writ petitioner\/respondent herein joined the<\/p>\n<p>Revenue Department as peon on 10.9.1975. He retired from<\/p>\n<p>service on 29.2.2000 while working in the post of Upper<\/p>\n<p>Division Clerk from the Munsiff-Magistrate Court, Perambra.<\/p>\n<p>Before his entry in service in 1975, the respondent has worked<\/p>\n<p>as L.D.C. on provisional basis from 14.10.1969 to 31.12.1969.<\/p>\n<p>After  his  retirement,       respondent    preferred   Ext.P1<\/p>\n<p>representation   before the Accountant General praying that<\/p>\n<p>the provisional service rendered by him from 14.10.1969 to<\/p>\n<p>31.12.1969 may be reckoned as qualifying service for<\/p>\n<p>computing pensionary benefits. As per Ext.P2, the Accountant<\/p>\n<p>General called for the service records for taking a decision on<\/p>\n<p>his representation. Thereafter, by Ext.P3 dated 9.1.2001, the<\/p>\n<p><span class=\"hidden_text\">W.A. No.1772 of 2006           &#8211; 2 &#8211;<\/span><\/p>\n<p>Accountant General&#8217;s Office rejected his representation. The<\/p>\n<p>reason given was that the provisional service rendered by him<\/p>\n<p>mentioned above has not been reckoned             for granting<\/p>\n<p>increments. Feeling aggrieved by Ext.P3, this writ petition was<\/p>\n<p>filed.   The petitioner relied on Exts.P4 and P5 Government<\/p>\n<p>orders in support of his claim.   Learned Single Judge allowed<\/p>\n<p>the writ petition holding that all provisional service prior to<\/p>\n<p>1.1.1994 is liable to be counted for      pensionary benefits.<\/p>\n<p>Feeling aggrieved by the said direction,    this writ appeal is<\/p>\n<p>filed.\n<\/p>\n<p>            3. We heard the learned Government Pleader for<\/p>\n<p>the appellants. He pointed out that Ext.P4 Government Order<\/p>\n<p>provides that provisional service rendered with or without<\/p>\n<p>break up to 30.9.1994 which qualifies for earning increments in<\/p>\n<p>terms of Government Decision No.2 under Rule 33, Part I,<\/p>\n<p>K.S.R. will be reckoned as qualifying service. Learned<\/p>\n<p>Government Pleader submitted that the service rendered by<\/p>\n<p>the petitioner\/respondent     as L.D.C. in 1969    for about 3<\/p>\n<p>months was not reckoned for grant of increments and could not<\/p>\n<p><span class=\"hidden_text\">W.A. No.1772 of 2006             &#8211; 3 &#8211;<\/span><\/p>\n<p>have been reckoned for increments also. Decision NO.2 under<\/p>\n<p>Rule 33 which enables reckoning of provisional service for<\/p>\n<p>grant of increments has been deleted by Ext.P6 with effect<\/p>\n<p>1.10.1995.       According to the learned Government Pleader,<\/p>\n<p>going by the Decision No.2 under Rule 33 of Part I, KSR, the<\/p>\n<p>claim of the petitioner is unsustainable.<\/p>\n<p>            4.    It is common ground that provisional service<\/p>\n<p>rendered before 1994 could be reckoned for grant of<\/p>\n<p>pensionary benefits provided the said service qualifies for<\/p>\n<p>increment as provided in Decision No.2 under Rule 33 of Part I,<\/p>\n<p>K.S.R. which remained in force up to 30.9.1994.          The said<\/p>\n<p>decision reads as follows:\n<\/p>\n<blockquote><p>                &#8220;Government Decision No.2:\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                      Provisional service on regularisation<\/p>\n<p>         with or without break in the same category or<\/p>\n<p>         post will be treated as officiating service ab<\/p>\n<p>         initio for the limited purpose of granting of<\/p>\n<p>         increments. Provisional service followed by a<\/p>\n<p>         regular appointment with or without break in<\/p>\n<p>         the same category of post will also be treated<\/p>\n<p>         as officiating service ab initio for the limited<\/p>\n<p><span class=\"hidden_text\">W.A. No.1772 of 2006            &#8211; 4 &#8211;<\/span><\/p>\n<p>         purpose of granting of increments.<\/p>\n<\/blockquote>\n<blockquote><p>                The term &#8216;same category&#8217; of post for the<\/p>\n<p>         purpose denotes posts satisfying the following<\/p>\n<p>         conditions:-\n<\/p><\/blockquote>\n<blockquote><p>                (i) The posts should carry the same or<br \/>\n         identical scale of pay.\n<\/p><\/blockquote>\n<blockquote><p>                (ii) The qualification and method of<br \/>\n         appointment should be the same.<\/p>\n<\/blockquote>\n<blockquote><p>                (iii) The post should fall in the same<br \/>\n         service.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                The above decision shall be deemed to<\/p>\n<p>         have come       into  force with   effect   from<\/p>\n<p>         1.11.1956 but the monetary benefit thereof<\/p>\n<p>         will be admissible only with effect from<\/p>\n<p>         24.7.1967.&#8221;.<\/p><\/blockquote>\n<p>            5. Going by the above decision, we have no doubt<\/p>\n<p>in our mind that the relevant provisional service does not<\/p>\n<p>qualify for increment. The petitioner drew his first increment in<\/p>\n<p>the post of peon. His provisional service was in the post of<\/p>\n<p>L.D.C. Those posts were always carrying different scales of<\/p>\n<p>pay and qualification for those posts are also different.     In<\/p>\n<p>view of the above position, the provisional service of the<\/p>\n<p><span class=\"hidden_text\">W.A. No.1772 of 2006             &#8211; 5 &#8211;<\/span><\/p>\n<p>petitioner cannot be counted for granting increment. If that be<\/p>\n<p>so, the same cannot be reckoned for grant of pensionary<\/p>\n<p>benefits also.\n<\/p>\n<p>            In the result, the writ appeal is allowed. The<\/p>\n<p>judgment under appeal is reversed and the original petition is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>                                                 Sd\/-\n<\/p>\n<p>                                       K.
