He also submitted that from the bare<br \/>\nreading of FIR, the role on the part applicant is not clearly<br \/>\nreflected.  Accused No.2 has been released on bail by the trial<br \/>\nCourt. Prima facie, it appears that there is no involvement of the<br \/>\napplicant. He also submitted that co-accused has been released by<br \/>\nthis Court. Therefore, the applicant may kindly be released on bail<br \/>\nby imposing suitable conditions.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Ms. Shah strongly opposed the application of the applicant and<br \/>\nstated that the applicant is involved in serious offence punishable<br \/>\nunder Sections 420, 465, 467, 468 and 471 of the Indian Penal Code.<br \/>\nHe also stated that discretion may not be exercised in favour of the<br \/>\napplicant considering the seriousness of offence.\n<\/p>\n<p>4.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nprovisions of Sections 420, 465, 467, 468 and 471 of the Indian Penal<br \/>\nCode, quantum of punishment and co-accused has been released by this<br \/>\nCourt, I am of the view that the applicant deserves to be enlarged on<br \/>\nbail.  At this stage of bail, this Court is not entering into merit<br \/>\nof the case.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. I- 68 of 2011 registered at Kadodara GIDC Police Station,<br \/>\non his executing a bond of Rs.10,000\/- [Rupees ten thousand only]<br \/>\nwith one surety of the like amount to the satisfaction of the Trial<br \/>\nCourt and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[f]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>8.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid extent.
