claim petition for compensation and see-king  enhanceriient "of

The appvell*anlttl  seeking enhancement of
\ncompensationlfamrardedlf:-~ pl Commissioner for Workmen’s
\nCompensation, ” No.WCA\/NFC\/CR.18\/2005 dated<\/p>\n
21   the claim petition claiming compensation<\/p>\n
lion account Qyih\u00e9lltdisab\ufb02ity caused to him in a road traffic accident,<\/p>\n
.1  occurred at about 3.301 p.m on 20″! of March 2005 while<\/p>\n
\u00b0-llxdisclialrgingl his duties as a driver of autorikshaw bearing registration<\/p>\n
 ‘  No~\u00ab.:K\u00a7AlO4~8663 at Frazer town–Queens road\u00ab~Thim.maiah road junction.<\/p>\n
3r<\/p>\n
The claimant was aged about 55 years. According to him, he was<\/p>\n
getting salary of Rs.6,000\/ — per month.<\/p>\n
i<\/p>\n
3. The owner of the vehicle contended that he only’<\/p>\n
Rs.3,000\/– per month and Rs.50\/– as battamlper.  j <\/p>\n
been examined to show the nature of injury
\ndisability. The claimant has sustained fr.actut’eJ “of ‘clavicle.
\nAccording to the Doctor, the c1aizrgnant.icannot”‘lift heavyweights and he<\/p>\n
assessed the disabitity at 20%.  it  C<\/p>\n
4. The   of the ckaimant at
\nRs.4,500\/–   disability, has awarded
\ncompensationlof  1  interest per annum. Being not
\nsatis\ufb01ed with thelabove  theipresent Appeal is filed.<\/p>\n
 5.;lW.e hVa’v.e*h.eard the learned Counsel appearing for both the<\/p>\n
  it\u00bb contended by the appellant’s Counsel that the disability<\/p>\n
‘A’-llfconsidleredwby the Commissioner is contrary to the evidence available<\/p>\n
.  ‘ ~.__on–\u00abr:ecord. Therefore, he requested the Court to enhance compensation.<\/p>\n

7. Per contra, learned Counsel appearing for the Insurance
\nCompany contends that the compensation awarded \ufb01by the<\/p>\n
Commissioner itseif is on the higher side, since the claimant-ch-asvvrjnot<\/p>\n

been disabled to drive the autorikshaw as a driver oneaccount”c-flthe\u00e9<\/p>\n

9.    by the claimant is a
\nfracture of left clavicle.’ is led in to show that left clavicle is
\nnot united and as alliesjulthvlof he is unable to drive the vehicle and
\n hasjgdeposed ‘is that on account of the said injury, he is<\/p>\n
unable   fwe_j1…ghts. Admittedly, fracture is caused to the left<\/p>\n
lv.__AA’cl’avicle. A  claimant is an autorikshaw driver. Under such<\/p>\n

  As it is not the case of the claimant that he cannot drive<\/p>\n
