Pathak, learned counsel for the non-\napplicants.\n     Applicant has filed this application seeking initiation\nof action for contempt on the ground that inspite of order\npassed on 17\/09\/09 in M. Cr. C. No. 8952\/09, non-\napplicants have not released the vehicle to the petitioner.\n     An application was filed by the petitioner under\nSection 482 of the Cr. P. C. Inter alia contending that a\nTata Sumo vehicle bearing no. M.P.04 B.A. - 0259 has\nbeen seized by the police authorities on the ground that\n234 bulk litres of illicit liquor was being transported in the\nsaid vehicle. Contending that the application filed before\nthe Judicial Magistrate First Class to relase the vehicle on\n'Supurdgi' has been rejected, the application was filed\nseeking release of the vehicle.\n     Initially on 17\/09\/09, this Court directed for release\nof the vehicle on 'Supurdgi' on applicant's furnishing a\nbank guarantee of Rs. 2,00,000\/-.      Subsequently, on an\napplication filed by the applicant in M. Cr. C. No. 8952\/09,\nthe order passed earlier was modified and instead of\nfurnishing a bank guarantee of Rs. 2,00,000\/- , petitioner\nwas granted liberty to submit a solvent surety of Rs.\n2,00,000\/- or pledge his immovable property before the\nsaid Court.\n     Inter alia contending that inspite of compliance made,\nthe vehicle is not being released and the respondents are<\/pre>\n<p> not granting possession of the vehicle, this application for<br \/>\ncontempt has been filed and one of the ground raised is<br \/>\nthat the vehicle has been damaged, many parts are missing<br \/>\nand it is not in the same condition in which it was seized.<br \/>\nHowever, considering the fact that inspite of order passed<br \/>\nby this Court, non-applicants were not releasing the<br \/>\nvehicle, this Court issued notices to the non-applicants<br \/>\nwho are Station House Officers of the concerned police<br \/>\nstation and appear personally before this Court, they are<br \/>\npresent today and from the reply filed by the respondents,<br \/>\nit is seen that on a certified copy of the order passed by<br \/>\nthis Court being filed by the petitioner in the Court of<br \/>\nJudicial Magistrate First Class, the Judicial Magistrate<br \/>\nFirst Class vide Annexure R-4 dated 25\/09\/09 directed the<br \/>\n&#8216;Nazir&#8217; of Budhni to seize the vehicle and submit it in the<br \/>\nCourt.\n<\/p>\n<p>     Records    indicate   that   in   pursuance    to   the<br \/>\ndirections issued, non-applicants have produced the<br \/>\nvehicle in the Court and the vehicle is available in the<br \/>\ncourt premises since 28\/09\/09 as is evident from the<br \/>\ndocuments available on record.         It is therefore clear<br \/>\nthat in pursuance to the order passed by this Court,<br \/>\nboth the non-applicants have produced the vehicle in<br \/>\nthe Court on 28\/09\/09 and, thereafter, possession of<br \/>\nthe vehicle is not taken by the petitioner mainly on<br \/>\nthe ground that the vehicle is not in the same<br \/>\ncondition in which it was seized and contending that<br \/>\nthe vehicle will be taken away after proper mechanical<br \/>\nreport is submitted, the vehicle still remains in the<br \/>\nCourt premises.    Order sheets Annexure C-3 indicate<br \/>\n that the Court having found the mechanical report<br \/>\nearlier submitted to be in order has rejected the<br \/>\nfurther prayer of the petitioner for getting further<br \/>\nmechanical report of the vehicle.\n<\/p>\n<p>       Be it as it may be, from the facts that have come<br \/>\non record, it is clear that as far as non-applicants are<br \/>\nconcerned, they have produced the vehicle in the<br \/>\nCourt and the vehicle is lying in the Court premises<br \/>\nand    on   the   ground    that        respondents   have      not<br \/>\nproduced the vehicle in the same condition in which it<br \/>\nwas seized, applicant has not taken possession of the<br \/>\nvehicle, that being so now no case is made out for<br \/>\ninitiating action of contempt against the respondents.<br \/>\nThe grievance of the applicant is that the vehicle is<br \/>\nnot in the same condition in which it was seized and,<br \/>\ntherefore, petitioner wants to get the vehicle in the<br \/>\nsame    condition    in   which    it     was   seized,    on   the<br \/>\naforesaid   ground     action     for    contempt     cannot    be<br \/>\ninitiated against the respondents.           In case, petitioner<br \/>\nhas any grievance with regard to the vehicle not being<br \/>\nin the proper condition it is for the trial Court to take<br \/>\nany action. It gives a fresh cause to the petitioner to<br \/>\ninitiate proper proceedings or to seek a direction from<br \/>\nthe trial Court on the aforesaid ground.              Action for<br \/>\ncontempt cannot be taken against the respondents on<br \/>\nthis ground.      Petitioner by misrepresenting the facts<br \/>\nhas induced this Court to issue notice and seek<br \/>\npersonal appearance of the respondents.                   For this,<br \/>\nrespondents are liable to be suitably compensated, in<br \/>\nview of the fact that they have produced the vehicle in<br \/>\n the Court and the same is lying in the Court premises,<br \/>\neven though petitioner by filing certain documents<br \/>\nvide    Annexure      C-3     has   brought       on   record      the<br \/>\nproceedings of the Court but the contention of the<br \/>\npetitioner and the prayer made is that respondents<br \/>\nno. 1 and 2 are not producing the vehicle and,<br \/>\ntherefore, they be punished, this assertion is not<br \/>\nfactually correct.      As respondents contemnor nos. 1<br \/>\nand 2 in pursuance to the directions issued by this<br \/>\nCourt    on     25\/09\/09,      much      before    filing    of    this<br \/>\ncontempt application on 13\/11\/09 had produced the<br \/>\nvehicle on 28\/09\/09 and had given custody to the<br \/>\ntrial Court, they are entitled to be compensated by<br \/>\npayment of cost for being unnecessarily dragged into<br \/>\nthese proceedings and under the circumstances that<br \/>\nhave come on record, this Court does not find any<br \/>\nground     to    initiate    any    proceedings        against     the<br \/>\nrespondents, instead respondents have to be paid<br \/>\ncompensatory       cost.
